A recent report from a coalition of Texas immigrant advocacy organizations alleges that a group of approximately 80 African immigrants have suffered multiple serious human rights violations while incarcerated at the West Texas Detention Facility (WTDF) in Sierra Blanca, Texas. These violations allegedly occurred during a period of about a week in early 2018. LaSalle Corrections, a private prison company, operates WTDF. All of the detained individuals were being held for deportation after receiving final orders of removal, and many of them had been detained for months or even years due to difficulties in returning them to Somalia. Many of the detained men, who were primarily Somalian nationals, claim that they suffered numerous instances of abuse by correctional officers, including physical abuse, sexual abuse, and verbal abuse. The men allegedly endured dangerous and unsanitary living conditions at the detention facility, were denied appropriate medical and mental health care,…

Criminal Defense Lawyer Zak Goldstein The Pennsylvania Superior Court has decided the case of Commonwealth v. Weber, reversing Weber’s conviction for fleeing or eluding where the trial court precluded him from presenting the statutorily-recognized “personal safety defense." The Facts of Commonwealth v. WeberIn Weber, the defendant was charged with fleeing or eluding police in violation of 75 Pa.C.S. Sec. 3733. At trial, police testified that they saw the defendant driving through an intersection in Pittsburgh at a high rate of speed. The officers were in uniform and driving a marked police vehicle. They followed the defendant and learned that his vehicle’s registration sticker had expired. When the defendant stopped at an intersection, the officers pulled up next to him and were able to see that his car had valid, but expired inspection and emission stickers, as well. Based on these…

Neal Davis Gains Leniency for Federal White Collar Crime

You may have heard the term “white collar crime” before and assumed it meant crimes committed solely by people who have well-paying jobs — or so-called “white collar” professions. That’s not always the case. Case in point: A retired Fort Bend County jail guard was recently charged with a federal offense for a non-violent white collar crime which involved the misappropriation of money. As reported in the Houston Chronicle, Burnie Joseph Haynes pocketed nearly $290,000 in military pension checks which had been sent over a 20-year period to his uncle, who died in 1996. Such fraud is a federal white collar offense. On March 22, Haynes pleaded guilty in federal court to the theft of public money, a jailable offense. He admitted taking $286,302 from a bank account for which he’d been a signatory with power of attorney. But Haynes was able to get probation and avoid jail time — thanks to his attorney, Neal Davis. As the Chronicle…
