A recent case in which a Romanian man was sent to a federal prison for a year illustrates how aggressive cyber gaming tactics can cross a line and become a criminal offense. Last month, a federal judge sentenced hacker Calin Mateias after he launched a series of cyber attacks after he became angry in the popular online role-playing game “World of Warcraft.” A report in Courthouse News noted how the 38-year-old Romanian attacked the servers of “Blizzard Entertainment, the company that owns the game. He intended to get an unfair advantage over fellow players. Mateias was extradited to the United States to face federal charges. He pleaded guilty in Los Angeles earlier this year to a single felony count of causing intentional damage to a protected computer. The cyber attacks in 2010 followed disputes with other players in Europe. They impacted World of Warcraft servers in the United States and across Europe. On September 7, 2017, Stergios Economos was driving in Burbank, CA when he struck Michelle Ann Landes, age 64, who was walking to her job at Walt Disney Studios, striking three other vehicles and injuring at least one other person in the process. In the state of Texas, immigrants have stepped in to fill many healthcare industry jobs, including those in both the formal and informal caretaker industry. Unfortunately, many of these healthcare industry jobs go unfilled by Americans because they traditionally pay low wages and have poor working conditions. Furthermore, when immigrant workers are undocumented, they may be more susceptible to the exploitation that often pervades informal personal care arrangements. These low-level jobs, however, may be some of the only jobs within reach of undocumented immigrants, since they may not require a high school diploma or even any work experience. The DC Court of Appeal in TOWNSEND v. DC on May 31, 2018, remanded a DUI (“Driving Under Influence”) conviction based on erroneous admission of scientific evidence. Townsend was found behind the wheels of a running car partially on a curve, and on the wrong side of a street by the police officers. As she appeared under the influence and incoherent, the officers had administered several field sobriety tests to determine or to establish drug or alcohol use. The standardized field sobriety tests performed were: Walk and turn test: To place the right foot on a line and the left foot in front of it, connecting heel to toe while putting both hands to side and taking nine heel to toe steps while counting out loud and keeping arms to side. After completing the nine steps, the defendant was to turn around and take nine heel to toe steps backwards also counting out loud. Grandchildren Transported in Dog Kennels on 95-Degree Day

On Saturday evening, a grandmother of two was arrested and accused of endangering her grandchildren when she took a drive with them placed in dog kennels in the back of her SUV for the trip. Tennessee resident 62-year-old Leimome Cheeks is the grandmother of two children, ages 7 and 8. According to testimony given by some of her neighbors, she is known for being a good person and has often been seen outside playing with her grandchildren and dogs. Cheeks reportedly took a road trip on the 95-degree evening going from Whitehaven to Collierville, with the children in tow. Cheeks had recently gotten two puppies and had their kennels in the rear of her vehicle. Her SUV was allegedly too full of items to allow the children to use the standard seats, so Cheeks asked them to ride in the kennels for the 30-minute trip instead. Continue reading →

US v. Edling, No. 16-10457 (6-8-18)(Watford w/Thomas and Rawlinson). The 9th vacates and remands a Guidelines sentence for being a felon in possession under 2K2.1. The district court found three prior offenses of “crimes of violence.” This raised the defendant’s offense level using a categorical approach.On appeal, the 9th determines that: (1) assault with a deadly weapon under Nevada assault statute was a COV given the element of use or threatened use of violence; however, neither (2) robbery nor (3) coercion were COVs. The former —robbery — was not a categorical match as it involved violence against property as well as person.  It swept too broadly. Coercion was not a COV because state courts have defined “force” in other statutes as not necessarily requiring violence or causing bodily pain or harm. Winning two out of three ain’t bad.  Thus, with only one COV, the sentence is vacated and remanded and the offense level…
