The 14th Amendment to the Federal Constitution provides, among other things, a guarantee of equal protection under the laws.  Few clauses within American jurisprudence are more well known, but few citizens actually understand the general nature of the equal protection guarantee.  To understand the nature and scope of the guarantee, one must first go back in time to its ratification.  Shortly after the end of the American civil war, Congress proposed and the states ratified what has come to be known as the Reconstruction Amendments.  These include: the 13th, 14th, and 15th Amendments.  The legislative history–i.e., the proceedings leading to the enactment of a law, including reports and floor debates–clearly indicates that Congress was concerned with the discrimination and harassment of minorities, especially slaves recently emancipated under the 13th Amendment’s proscription of slavery. When the Obama administration placed the young children separated from their immigrant parents for unlawfully crossing the border outside “concentration camp” walls, it swiftly turned into an opportunity for human traffickers to get free slaves. That was certainly terrible and unacceptable, and something had to be done. Children of a very tender age need to be held. comforted and cared for. But if adults in a facility provide them with the human contact they desperately need, they expose themselves to allegations of sexual molestation. At the very least, they commit nonconsensual touching, and America is better than that. Molesting the children of incarcerated immigrant parents is outrageous and unacceptable, and something must be done. When the Obama administration created a path to citizenship, people from other nations saw the opportunity to get here, any way they could, to give their children a better life. How cool is it that Google has this app called “Translate,” and anybody can get it right on, wait for it, their smartphone? Even a cop in Kansas. Imagine you’re driving in a foreign country and a police officer stops you on the road. You don’t speak the cop’s language and they don’t speak yours, so a halting exchange ensues using a laptop and Google Translate. You’re not always sure what the officer is asking, and you end up agreeing to something you didn’t quite understand, and are arrested. After employing traditional surveillance techniques, the Government successfully applied for two wiretaps on Washington’s cell phone. The evidence presented at appellants’ trial consisted largely of recorded conversations and Washington’s interpreting language in his conversations with the three defendants. A jury convicted Stoddard and Woodruff under 21 U.S.C. §§ 841(a)(1), 841(b)(1), and 846 for conspiracy to distribute and possess with intent to distribute heroin. Google may sell advertisements based on searches for “chest pain.” But in the criminal justice world, we can be sloppy, and dangerously so. As Anna Roberts explains in her forthcoming article, Arrests as Guilt, there is a marked tendency to interpret the eleven million arrests made every year as findings of guilt. That is, we see that someone is arrested, and we conclude that the person is guilty of a crime. That assumption, made too often by journalists, academics, and the public, creates a host of problems. As state courts have proven extremely reluctant to give any slack to the right to keep and bear arms under the Second Amendment, exercising the right without being arrested first has often been honored primarily in the breach. Possess a gun, get arrested and, only afterward, get cut loose provided the person possesses the requisite permits. But an Illinois appellate court’s analysis in an opinion by Justice P. Scott Neville, Jr. challenges the “outdated” assumption. Schemes that involve the skimming of money are very difficult to detect, investigate, and ultimately prove. These types of schemes are carried out before money is recorded in a company’s accounting system. Because of this “off-books” nature of the crime, little to no trail is created for investigators to follow. Skimming happens at the point of entry of money into a business. The gatekeeper who receives those funds is the most likely person to steal the money. Typical jobs that might involve access to funds in this way include bank teller, waitress, store cashier, salesperson, or medical billing clerk. Hundreds of jobs could afford someone an opportunity to skim funds from a company, but these common examples illustrate the ease of theft but the difficulty of investigation.
