Illinois Driver’s License & ID Fraud

0

The Illinois Secretary of State is cancelling large numbers of driver’s licenses and state IDs due to fraud. The Secretary of State processes and compares the photos of anyone who applies for or renews a driver’s license or state ID in a central digital database. Therefore, if you obtained a license or ID under a false name, date of birth or social security number, there is a high probability that the Secretary of State’s facial recognition system will flag your application. While you may initially leave the facility with a temporary permit (paper license), the official plastic license or ID may never arrive. Months later, in it’s place, you may receive a Notice of Cancellation which indicates that you “committed a fraudulent offense in the making of an application” directing you to contact the Illinois Secretary of State Fraudulent Review Unit. In turn, the matter is turned over to a Secretary of State Police investigator. It…

If you have been charged with driving under the influence, you need to reach out to a seasoned New York DWI attorney who understands this area of law. At the Law Offices of Mark A. Siesel, we can examine the facts of your case and make sure that none of your rights were violated when you were stopped or arrested. With 31 years of experience, we are dedicated to providing strong, effective, and experienced advocacy throughout the entire legal process. In New York, the basic offense of driving while intoxicated (DWI) consists of operating a motor vehicle with a blood alcohol concentration (BAC) of 0.08 percent or higher. In other words, someone with a BAC of 0.08 percent or more is legally considered drunk or intoxicated. DWI is not the only alcohol-related charge that New York drivers potentially face. Drivers could also face a charge of driving while ability impaired (DWAI), which is charged when a person’s BAC is between 0.05 percent and 0.07 percent, a lower threshold…

Power of Attorney Signatures on Immigration Applications No Longer Valid

U.S. Customs and Immigration Services (USCIS) issued a new policy memorandum in mid-February, the provisions of which took effect on March 18, 2018. The memorandum concerns signatures on immigration applications, petitions, requests, and other documents filed with USCIS. More specifically, the memorandum reversed the policy in a previous interim memorandum that permitted power of attorney signatures on immigration documents. USCIS reportedly made these changes due to concerns about consistency, fraud, and program integrity. Under the new memorandum, all individuals submitting an application, petition, request, or other document to USCIS must contain personal signatures. An individual’s signature must be a handwritten sign or mark in order to be valid; USCIS will not accept signatures with a word processor, typewriter, stamp, or another type of device. Although the original handwritten signature must be in ink, USCIS will accept a photocopied or scanned copy of the…

DC Marijuana POP-UP Events — Legal? DC CRIMINAL LAWYER

In the midst of another major arrests at the pop-up marijuana event this past Saturday (June 17, 2018) in the NE DC where about thirty vendors were arrests, the legality of these events certainly has been put to the test. The vendors and the event coordinators have pushed the limits of law and in effect have forced the narcotic task force to intervene and make arrests. In the Saturday’s events three weapons were also seized which will heighten the DC police scrutiny of these events. At the heart of promulgation of these events is the DC decriminalization Statute that for some may have been misconstrued. The Statute specifically provides in the pertinent part: It is unlawful for any person knowingly or intentionally to manufacture, distribute, or possess, with intent to manufacture or distribute, a controlled substance. Notwithstanding any provision of this chapter to the contrary, it shall be lawful, and shall not be an offense under District of Columbia law, for any…

Feds To Support Baltimore Police This Summer

0

While the crime rate in Baltimore slightly decreased over the last year, violence in the city remains at an unacceptable level.  So far in 2018 there have been 130 homicides within the city limit, and hundreds more non-fatal shootings.  Just last weekend 5 people were killed and 7 more were shot in Baltimore, which lends credence to the fact that summer always brings a spike in crime to the area.  Whether it’s the long days or the warm nights, people spend more time out on the streets during summer, and the streets are where the large majority of violent crimes occur.  Baltimore Police has over 3,000 sworn police officers patrolling these streets, but the department has its limitations, especially in times of elevated violence. For the last few years federal law enforcement agencies have increased their presence in Baltimore, and this summer more than ever the feds plan to lend a hand in taking down the most violent of city criminals.  The mayor…

Understanding Hospice Care

0
0
What is Hospice care? Hospice care can be very difficult for families to come to terms with, but can be a beneficial care option for those caring for a terminally ill loved one. The purpose of hospice care is to provide comfort and quality of life for a terminally ill person. Hospice care can allow the patient to remain at home and can provide ways to alleviate pain and make the person more comfortable. It is a great option for those who are seriously ill, who have exhausted their treatment possibilities, or who do not wish to continue treatment for a terminal illness. How is Hospice care obtained? In order to be placed under hospice care, normally a patient must receive a prognosis from two doctors that the patient has six months or less to live. Since there is no way to be sure how long a patient will live, the patient must continue to qualify every 60 to 90 days. What are the benefits of Hospice care? A hospice team will work with other healthcare professionals, including…

Boston Drunk Driving Accidents involving Commercial Vehicles

0

Most Boston drunk driving accidents involve one or more personally owned vehicle.  They also typically occur late at night or in the overnight hours after the bars close since this is the most likely time for someone to be out on the road while drunk.  While this is certainly the norm in terms of Boston drunk driving crashes, it is not the only time drunk driving accidents occur in Boston and around the nation and not every accident involves  personal vehicles. In some cases, we have seen drivers of vehicles, such as a semi tractor trailer or other large commercial vehicle, involved in a Massachusetts drunk driving collision.  Because of the size of these commercial vehicles,  there is so much weight that is transferred into energy in a crash that smaller vehicles and pedestrians or bike riders do not really stand a chance.  These vehicles also take a lot longer to stop than a standard passenger vehicle. Increased Stop Times For Commercial Motor…

Supreme Court Issues Influential Native American Jurisdiction Case

Supreme Court Hears Native American Jurisdiction Case In May of 2018, the United States Supreme Court decided to hear a case about Native American territory and a murder in 1999, which could significantly affect issues involving tribal sovereignty and state legal authority. How this case is decided will have a significant impact on where criminal cases are heard. How the Criminal Case Arose The case arose when the state court convicted the defendant of mutilating and murdering his girlfriend’s former love. The defendant later initiated a legal action against the state based on the argument that the federal government instead of the state has jurisdiction over the case because the crime occurred within the tribal territory and the defendant and the man who was killed are members of the Muscogee Creek Nation. In 2017, a federal appeals court later overturned the defendant’s conviction based on the argument that Congress never dissolved the boundaries of the Muscogee…

20-Minute Observation Defense for DWI Cases in New Jersey

A DWI conviction can have long-lasting consequences for a person’s life. If you have been charged with a DWI, you need to reach out to a seasoned New Jersey DWI attorney who can help. When a person has been arrested for a DWI, there are certain procedural safeguards that must be obeyed by law enforcement. Unfortunately, these rules are not always followed. We can examine the merits of your case and determine whether any of your rights was violated. The basic offense of driving while intoxicated (DWI) consists of operating a motor vehicle with a blood alcohol concentration (BAC) of 0.08 percent or higher. Alcohol is not the only basis for a DWI in New Jersey. You can also be arrested or charged with a DWI if you are behind the wheel of a motor vehicle under the influence of drugs – whether legal, illegal, or prescription. A possible defense in New Jersey DWI cases is that the police did not watch you for 20 minutes prior to administering the breath test to measure…

DOJ Keeps Legal Orientation Program for Detained Immigrants in Place

The U.S. Department of Justice (DOJ) recently announced that it will keep the Legal Orientation Program in place, which provides legal assistance for immigrants detained in federal immigration detention centers. Although the DOJ originally had stated its intent to end the program as of April 30, 2018, it later agreed to leave the program intact at the request of Congress. However, U.S. Attorney General Jeff Sessions still has made it clear that the administration plans to review the overall cost-effectiveness of the program. The Legal Orientation Program has been in place since 2003 and is overseen by New York’s Vera Institute of Justice. The focus of the program is to help detained immigrants navigate the notoriously complex immigration system and secure pro bono legal counsel to help them in deportation proceedings. The program also conducts campaigns and workshops designed to educate immigrants facing potential deportation about their legal rights. Assistance through…
