Expanded Forgiveness of a Criminal Conviction

Earlier this year, I had the opportunity to participate in a national roundtable, sponsored by the American Law Institute and National Conference of State Legislatures, on current and possible approaches to relieving the consequences of a criminal conviction. We considered three basic approaches: “forgetting” convictions by expunging them or limiting access to information about them; “forgiving” convictions through, among other things, certificates of relief, also known as certificates of rehabilitation; and “forgoing” convictions by diverting matters before conviction or decriminalizing them altogether. In its recently-completed legislative session, the North Carolina General Assembly expanded the forgiveness approach by making it easier to get a certificate of relief. Annual DUI Study Ranks Suburbs For DUI Arrests

It’s that time of the year again. The Alliance Against Intoxicated Motorists has released its annual study that keeps track of DUI arrests throughout Illinois. Once again, Rockford and Elgin top the list of towns in Illinois reporting the most DUI arrests in 2017. In 2017, Rockford reported 490 DUI arrests compared to 459 in 2016. The 2017 figures represent a 6.8% increase over the 2016 DUI arrest figures. Elgin came in second with a total of 418 DUI arrests in 2017. Elgin had 365 DUI arrest in 2016, a 14.5% increase over 2017. Every year, Schaumburg based Alliance Against Intoxicated Motorists sends out surveys to roughly 700 police departments throughout the State of Illinois. Most of the police agencies respond to the surveys and the Alliance Against Intoxicated Motorists releases the figures for DUI arrests throughout all of the cities and towns in Illinois and gives us a picture of which towns are more aggressive when it comes to DUI arrests. At Texas Standard, we find a report on a new study by Shefali Patil out of the UT-Austin business school proclaiming that police accountability activism causes liberal cops to become dispirited and do a lesser job than their conservative colleagues.Basically, Dr. Patil and her researchers created four datasets: 1) They surveyed 164 officers at two agencies, then 2) had veteran police managers review body cam footage from those officers and score them. 3) They examined supervisors' ratings of 82 officers across four agencies. And 4) they ran a "time-lagged survey of 184 officers in a single agency."Leaving aside the small sample sizes described there, and the VERY small sample sizes from which the opinions of subsets of officers would be drawn, as it turns out, the peculiar definitions of "liberal" and "conservative" may underlie the conclusions in this study. The New York District Attorney’s Office recently announced that a Manhattan grand jury has indicted Harvey Weinstein for additional sexual assault charges relating to a third complainant. Specifically, Mr. Weinstein is facing an additional charge of Criminal Sexual Act in the First Degree (Penal Law Section 130.50). Mr. Weinstein was already facing a charge of Criminal Sexual Act in the First Degree based upon the allegation that he had forced a different woman to perform oral sex upon him against her will, and a separate count of Rape in the First Degree for allegedly raping a second complainant. Interestingly, he is also now facing two counts of Predatory Sexual Assault (Penal Law Section 130.95). These new charges significantly alter the forecast for Mr. Weinstein and seriously hamper his defense for tactical reasons discussed below. Last week, the U.S. State Department released its annual Trafficking in Persons report for 2018.  This year’s report stresses the importance of understanding human trafficking from a local perspective, and outlines community-based initiatives to combat the practice. The report puts forward a cross-cutting framework for cooperation among multiple stakeholders. In particular, cooperation must take place vertically between, national, regional, and local governments, and horizontally between law enforcement officials, service providers, and other key stakeholders, such as NGOs. According to the report, the most comprehensive model for community-based action would also involve the following steps: Conducting assessments of the nature and scope of the problem (How many potential victims are there? We recognized in our earlier posts that, at least as of now, there have not been any decisions from either the Minnesota Supreme Court nor the Minnesota Court of Appeals addressing the potential First Amendment problems associated with Minnesota’s revenge porn law. Nevertheless, we believe there is a compelling case that Minnesota’s revenge porn law suffers from constitutional infirmity. In other words, it is likely that Minnesota’s revenge porn law cannot withstand constitutional scrutiny.
