New Jersey’s highest court has determined that juvenile sex offenders will no longer be held on the state’s sex offender registry for life.  New Jersey, which pioneered the sex offender registry, intended on utilizing this tool in an effort to protect community members and their families from potential harm. The Supreme Court unanimously determined that placing such requirements on individuals directly violates their due process rights under the Constitution. It was determined that requiring a juvenile offender to remain on the state’s sex offender registry greatly inhibits their ability to rehabilitate and integrate back into society as they make their way into adulthood. The landmark Megan’s Law, which initiated the sex offender registry, was enacted in 1994. In 2002, New Jersey adopted federal law which placed much more stringent punishments upon sex offenders including the lifetime registry requirement. The new legislation requires all sex…

Heroin Charge Dismissed in Lawrence District Court

In August of 2014 MD, a 48 year old woman from NH, was a passenger in a car with NH plates that was being observed by under cover cops in Lawrence. The police observed the car being driven in an area which the police said was a high crime area – specifically for sales of heroin. The car stopped and a woman approached and was let into the car. The car drove around the block and then the woman was let out. The police believed that a drug transaction had taken place in the car and pulled the car over. A subsequent search of the car and MD’s pocketbook revealed packets of heroin and straws. Both MD and the woman driving the car were arrested and charged with possession of heroin. MD went to Lawrence District Court and was appointed a public defender. Eventually MD entered the Essex County Drug Diversion Program. As part of the program MD was subject to random drug testing. MD failed to appear for several of her drug tests and then tested positive. MD was sent a notice…

Teen Daycare Worker Accused of Abusing Toddlers

A young woman who worked at a daycare center located in Bryant, Arkansas, has been brought up on charges after a video was captured allegedly depicting her administering abusive behavior toward two young children. 19-year-old McKenzie Howell had worked with youngsters at the Kid’s Academy Daycare in Bryant for over a year when another employee, who is also the mother of a 2-year-old boy enrolled at the center, had concerns that her son was being mistreated when he was in Howell’s care. Upon reviewing a security video recorded at the facility showing a woman that is believed to be Howell acting in a manner that alarmed her, she notified the Child Abuse Hotline and the authorities. The police watched the video footage and saw a woman that they suspect is Howell being forceful with the way she handled a little boy and little girl who were said to be about two-years-old. As we all know, the Fourth of July traditionally features fireworks, get-togethers with family and friends - and arrests for drinking and driving. One of those arrested this past holiday was Arizona Cardinals general manager Steve Keim. We usually avoid celebrity gossip postings about famous people arrested for various charges. However, this one is important because of what has already occurred. A Chandler police report originally claimed that Keim misidentified himself as the team's director of security after he was stopped. But after release of the officer's body camera footage of the DUI arrest, police reversed course and said the officer would correct the record. A statement from Chandler police said that after the review of the camera footage, it became clear that Keim said Shawn Kinsey was director of Cardinals security. No criminal prosecution will occur in a Florida case involving four teens, and an adult male who drowned as the teens watched, laughed, and filmed his struggles. On July 9 2017, Jamel Dunn screamed for help as he struggled to keep his head above water in a small pond in Cocoa, Florida. Not only did the young onlookers not help, they filmed the tragic situation and mocked Dunn as he took his final breaths. In the video, which the teens later posted on YouTube, they can be heard mocking and taunting Dunn. “Ain’t nobody gonna help you, you dumb (expletive),” says one, and another laughs, saying, “We just (let) buddy die. It is illegal in all 50 states to purchase, and even to possess, alcohol if you are under the age of 21.  And although it is illegal for anyone to drive under the influence of alcohol, individuals under age 21 are prohibited from driving with even the slightest trace of alcohol in their system. For example, while in most states the legal blood alcohol concentration (BAC) is anything below 0.08 percent for “of age” drivers, a BAC of 0.02 percent or less can result in an OUI if you’re under 21. This law is referred to as Zero Tolerance. In MA, due to Zero Tolerance Laws, it is a crime for drivers under the age of 21 to operate a motor vehicle with a BAC of 0.02 percent or higher. In layman’s terms, you don’t need to feel drunk—or even buzzed—to get an OUI if you’re under 21 in MA. Although these laws are intended to prevent the dangers of underage drinking, they can sometimes do more harm than good. Imagine, for example, that…

Driver’ Was Watching Hulu During Deadly Accident Involving Self-Driving Uber, Criminal Charges May Follow

Earlier this year, an Arizona woman was killed when she was struck by an Uber self-driving test vehicle. Elaine Herzberg was crossing a Tempe street with her bicycle when the tragic accident occurred. In response, Uber immediately pulled all self-driving test vehicles from cities nationwide. Although the Uber test vehicle was in autonomous (self-driving) mode when the fatal crash occurred, there was a human operator behind the wheel in case of an emergency. According to the Tempe Police Department, Rafaela Vasquez was watching Hulu when she was supposed to be watching the road. Police also commented that the crash was “entirely avoidable.” Was it Criminal? Tempe police were able to obtain records from the online service that was monitoring the autonomous Uber.
