The NY Times here described Attorney General Eric Holder, Jr's., speech to the ABA this week where he announced that the DOJ will no longer include drug amounts in indictments for low level drug dealers so as  to circumvent the triggering of minimum mandatory sentences, as a "transformational moment.". They doth gush too much-eth. On closer examination we see the following:1) Nothing in the speech about making the policy retroactive or giving any inmates serving "bone crushing" sentences a chance to benefit from this United States's new found enlightenment when it comes to incarceration on minor drug offenses. 2) The Attorney General's desire is just that: a desire. Individual charging decisions will still be left to local prosecutors who have discretion to include drug amounts in indictments, thus triggering the minimum mandatory sentences. So here is what will happen:AUSA: "Hey counsel, I didn't include the drug amounts in the indictment. Your guy can plead to the charges and get those easy 84 months."Defense Attorney: "No, my client says he's innocent. He wants a trial."AUSA: "Pardon me a moment while I call my secretary to schedule time before the grand jury. I will be re-indicting your client and including so many minimum mandatory sentences that he will still be in when the sun goes super nova in a few billion years. From Holder's speech: “too many Americans go to too many prisons for far too long, and for no truly good law enforcement reason."Rumpole's riposte:  You've been attorney general for six fricking years and you just figured that out? A 49-year-old Pasco County teacher was arrested and charged with driving under the influence Thursday afternoon after his car was allegedly found in a ditch by Pasco sheriff's deputies. The man teaches at a school in Dade City. According to reports, at 2 p.m. on Thursday he was placed in the back seat of a deputy's car, talking with a Florida Highway Patrol trooper. The trooper claims he smelled of alcohol, and when he tried to get out of the car to talk with the officer, he fell over. According to the arrest report, the man could not walk without assistance. His car was found in a ditch on the south side of State Road 54, just west of Foster Lane. The man apparently agreed to perform sobriety tests at the scene, but reports indicate he could not stand by himself to try to walk in a straight line or stand on one leg. A trooper allegedly found a prescription bottle of Temazepam, which is used to treat insomnia, in his front left pocket and a two-thirds full bottle of Jack Daniel's whiskey on the front driver's side seat of his car. Shortly before 3 p.m., the man told the trooper he had chest pains and extreme pain in his right leg. He was taken by ambulance to Florida Hospital Zephyrhills. According to a Florida Highway Patrol spokesman, a test showed he had a blood-alcohol level of 0.183. In Florida, a driver is presumed impaired at 0.08. handcuffed.jpgThe man was arrested and booked into the Land O'Lakes jail Thursday night. He was released a few hours later on his own recognizance. 3 Mental Mistakes That Led to Your Pasadena DUI Arrest

You made a mistake – a big one – now you face a Pasadena DUI charge.pasadena-dui-mistakes.jpg The question is: Why? What errors, mental or otherwise, did you make before getting behind the wheel? Here are five very common errors of judgment, which often land otherwise community-oriented drivers behind bars, facing penalties like license suspension, mandatory IID installation, alcohol school, and exploding car insurance rates. 1. "I’ve only had x number of drinks, so I’m okay to get behind the wheel." You’ve see the charts – the ones that tell you that, if you're X gender, and you weigh Y pounds, and then you can drink Z number of alcoholic drinks before becoming DUI in Pasadena. While those charts can be helpful, they're just rough guides. The body’s relative sensitivity to alcohol depends on a huge number of factors, including: • Whether you’ve had food to eat or not; • Whether you're metabolically comprised in any way; • How quickly the alcohol entered your system; • Whether you’ve consumed other kinds of substances, such as over-the-counter medications. 2. “I smoked medicinal marijuana, and I only had one drink an hour ago, so I’m not DUI.” Not necessarily! First of all, you could get what’s known as a Pasadena drug DUI. For obvious reasons, it’s not legal (nor is particularly smart) to get behind the wheel after you’ve taken medicinal marijuana (or any strong medicine, for that matter). When on meds, your ability to react rapidly and acutely to events degrades. You are slower. You are less likely to make the right decisions in emergencies. Etc. 3. “I'm only a few blocks from home – besides, I don’t want to have to leave my car at this party/bar overnight, because it would be a pain to do so.” This kind of thinking might feel rational in the moment, but it’s definitely not. The reason why it’s not, however, is elusive. Human beings have a difficult time understanding risks, particularly low percentage risks. If you’ve never driven a motorcycle before – if it’s an unfamiliar activity – you would never in a million years think to “just drive it a few blocks home” while under the influence. Because you recognize the inherent folly of doing that. But if you know how to drive a car well, sober, you might reason that you could get away with it. In other words, the short-term convenience seems worth the small risk. But it’s really not! For instance, let’s say the odds are only one in 5,000 that you will get into a fatal accident. But if that happens, your life is literally over! The horror of that long-term “game over” consequence should trump the short-term inconvenience of having to take a cab, if you're being strictly rational. No matter what happened – why you got a Pasadena DUI arrest – you now need to contend with the consequences. Franklin Hartley and Thomas Merenda, Lauderhill, Florida Police Officers, Arrested for Simple Battery

Franklin Hartley and Thomas Merenda, both Lauderhill, Florida police officers, were arrested recently after they allegedly conducted a traffic stop on two women, had them drive to a secluded location, and requested sexual favors, news sources report. Hartley, 33, and Merenda, 34, were booked into police custody on charges of simple battery and unlawful compensation. They have both since bonded out of jail on unspecified amounts. The press did not specify an attorney for either of the defendants. According to reports, Hartley and Merenda work as officers for the Lauderhill Police Department, though it is not clear for how long. Their future with the station now hangs in the balance. "I and the men and women of the Lauderhill Police Department are truly disappointed with the nature of the allegations made against these two officers and if they are proven to be true, the consequences should be severe," a Lauderhill Police Department spokesperson reportedly said in a statement on Friday. It is not clear whether the pair has been officially suspended or released from their duties at the department. The incident began at around 4 a.m. on May 24, 2012 when Hartley pulled over a car at a Taco Bell located on West Commercial Boulevard in Tamarac. There were two women in the car who reports say had just left the Vegas Cabaret in Lauderhill and were under the influence of alcohol. Hartley spoke with the two women and told them they could possibly be arrested before asking them to follow him to a secluded area behind a building on West Commercial Boulevard, sources indicate. The women complied and followed Hartley, sources say. Based on reports, Hartley contacted Merenda and told him to meet him at the secluded location as well. Merenda, Hartley, and the two women met up at the specified area, and once there, Hartley engaged in an unspecified sexual act with the passenger, sources allege. Hartley and Merenda both reportedly inappropriately touched the victims as well. It is not clear whether these actions were consensual.

Louise Simo, Lauderhill, Florida Caregiver, Arrested for Exploitation of the Elderly

Louise Simo, a Lauderhill, Florida caregiver, was arrested Wednesday after she was accused of pawning around $100,00 worth of her elderly ward's jewelry, news sources report. Simo, 34, was booked into the Broward County Main Jail on charges of dealing in stolen property, false verification of ownership, and exploitation of the elderly. It was not immediately clear whether she qualified for a set bail bond amount. The press did not specify an attorney for Simo. According to reports, Simo was at some point charged as the caregiver of the elderly victim. It was not immediately known at press time how long Simo had been caring for the victim. During the time she spent at the victim's home, Simo allegedly took jewelry, at least six pieces, and gradually sold it at area pawnshops, sources allege. On July 3, the victim's daughter realized that her mother was missing a lot of expensive jewelry. Lauderhill police officers began investigating and made a list of the health aids who had worked or been at the victim's home in the past. This list was reportedly compared the list to a list of people who had sold jewelry at local pawnshops. Based on reports, Simo's name came up on both lists.

John Quick of Davie, Florida Arrested for Exploitation of the Elderly

John Quick of Davie, Florida was arrested Thursday after he was accused of charging a 91-year-old man out of more than $1,000 for car repairs that were never completed, news sources report. Quick, 52, was booked into the Broward County Main Jail on charges of exploitation of the elderly, a charge he had been previously serving a 15-year probation period on, reports say. A judge set Quick's bond at $26,000 but ordered him to be held without bail for the probation violation. It is unclear whether Quick has hired an attorney. According to reports, Quick was arrested on January 13, 2005 in Fort Lauderdale on a charge of exploiting the elderly for between $20,000 and $100,000. The details of the past arrest were not immediately available at press time. Sources say Quick had been serving a 15 years of probation on that charge prior to his most recent arrest. In this latest incident, Quick reportedly approached a 91-year-old man who was stopped at a traffic light in Davie. Quick offered to perform repairs and bodywork on the man's vehicle, sources say. Quick and the victim later came to an agreement, and Quick charged the victim $825 for the work. Later on, Quick revisited the victim and charged $125, reports say. Sometime later, he charged the victim $165, sources allege. In the end, reports say Quick charged the victim but never completed the work he said he would perform.

Marcia Leiba of Tamarac, Florida Arrested for Grand Theft

Marcia Leiba of Tamarac, Florida was arrested Wednesday after she was accused of stealing checks from her elderly ward, forging his signature, and cashing them, news sources report. Leiba, 54, was booked into the Broward County Main Jail on charges of petit theft, grand theft, and uttering a false instrument. It is unclear whether she has qualified for a set bail bond. The press did not specify an defense attorney for Leiba. According to reports, Leiba had been hired to act as a nurse's aide for the elderly victim sometime around February and May of this year. It was not immediately clear at press time who had hired Leiba, or whether she worked alone or for a large business. It is similarly unclear how these charges will affect her ability to continue working as a nurse's aide. Sometime after Leiba was hired, she allegedly stole around 16 Vanguard Money Market checks from the elderly victim's checkbook. Leiba made all the checks out to "cash" and forged the victim's name on each of them, sources allege. From March to May, Leiba allegedly cashed 13 checks, valued at about $11,265, at Tubby's Drive Thru on West McNab Road in Tamarac. Sources say one of the checks Leiba took to Tubby's bounced, costing the store $2,178. Reports say Leiba cashed around three other checks for approximately $2,320 at different locations; detectives are still attempting to determine where those checks were cashed.

Two men in a small boat loaded with bales of marijuana were busted off the coast of Zuma Beach yesterday. Los Angeles County lifeguards in the area notified the United States Coast Guard of the presence of the occupied "panga" style boat just off the popular Southern California Beach. The U. S. Coast Guard deployed helicopters and boats to intercept the boat which had broken down in the area of Malibu near the Ventura County Line. Authorities overtook the boat and arrested two men on board. 26 bales of marijuana were seized by law enforcement and the Los Angeles County Sheriff took custody of the two men. When asked what they were doing, the two men indicated they were simply going to lunch at Neptune's Net and went by way of boat because parking is often a problem at the popular coastal eatery. Grammy winning singer and songwriter Miguel was arrested yesterday for DUI in Los Angeles, California. Miguel, whose full name is Miguel Pimentel, was pulled over by officers with Los Angeles Police Department's West Traffic Division and later taken into custody in the early morning hours. The singer was said to have submitted to a breath test for alcohol and tested .10, just over the legal limit in California. Miguel is due in court in Los Angeles on September 9, 2013. John Crook, 62, of Orem, Utah, was travelling southbound on State Highway 34 near milepost 70 in a Ford pickup pulling a trailer. Crook failed to negotiate a curve, crossed the center line, and struck a northbound Hyundai Sonata driven by David Eley, 51, of Providence Forge, Virginia. Eley had three passengers in his vehicle: Janet Eley, 51, also of Providence Forge; and Taylor and Laura Eley, both 24, of Midvale, Utah. All of the occupants in the vehicles were transported by ground ambulance to Caribou Memorial Hospital. The crash is still under investigation by the Idaho State Police. ***** Idaho State Police is currently investigating a crash on State Highway 34 near milepost 70, between Soda Springs and Henry.
