The state can’t rely on parole status to justify a bad search when the officer didn’t know that defendant was on parole. Also, the state’s inevitable discovery argument was expressly waived in the trial court. People v. Coleman, 2013 IL App (1st) 130030, 2013 Ill. App. LEXIS 886 (December 18, 2013). Defendant had no standing to challenge the arrest of codefendants or the search of their car, which was valid anyway under the automobile exception and inventory. United States v. Acosta-Colón, 2013 U.S. App. LEXIS 25107 (1st Cir. December 18, 2013).* Eight minute delay for drug dog was not unreasonable where the reasonable suspicion for the detention was the officer’s reasonable belief the occupants of the car were under the influence from their glazed eyes and slow movements. State v. Valenti, 2013-Ohio-5564, 2013 Ohio App. LEXIS 5811 (9th Dist. December 18, 2013).*

CHP Busts Long Beach Area Motorcycle Theft Ring

A two year undercover investigation by the California Highway Patrol led to the arrest of 51 people allegedly involved in a ring of motorcycles thefts, trafficking in stolen parts and other crimes. Operation Wheel Spin began as a social media project where it is common for motorcycle parts to be offered for sale. CHP officers on the case say that the plastic parts of motorcycles do not carry serial numbers as other metal parts do. These plastic parts can be sold without being traced back to their original owners. The recent bust by the Calfiornia State police agencey recovered 110 stolen motorcycles and parts from 29 more. The arrests have triggered further investigations into San Bernardino County and even Las Vegas, Nevada. Police said parts were being sold to other counties and even out of the country. The main group of players was said to have set up shop (or chop shop) in Long Beach, California. However investigators said other groups were set up in Santa Fe Springs and the San Fernando Valley. The shops primarily focused on parts from "sport bikes" made by Japanese manufacturers. Police indicate there is high profit in the sale of stolen parts from sport bikes and owners should be careful about where they park, how they lock and generally keeping close tabs of their motorcycles. CHP also warns that if you are in the market for parts for your motorcycle, be careful of deals that seem "to good to be true". Police also warn people to be careful about leaving gifts or exposed items inside your car for fear of making yourself a victim of crime during the holidays. Many people are unaware that the California Highway Patrol conducts undercover operations. The agency has investigators that work out of most of their stations. Their investigations often involve vehicles and vehicle related crimes like auto theft, and vehicle fraud. Courts of other jurisdictions have similarly held that requirements of Megan's Laws of other states did not amount to punishment and could be legitimately considered remedial. A statute that can fairly be characterized as remedial, both in its purpose and implementing provisions, does not constitute punishment even though its remedial provisions have some inevitable deterrent impact, and even though it may indirectly and adversely affect, potentially severely, some of those subject to its provisions. Such a law does not become punitive simply because its impact, in part, may be punitive unless the only explanation for that impact is a punitive purpose. The court agreed with the Legislature that sex offenders' past behavior is a strong predictor of future conduct. Drug possession was not involved. Remedial statutes are those which are made to supply some defect or abridge some superfluity in the former law, or which supply a remedy where none previously existed. Remedial statutes are also referred to as statutes designed to correct imperfections in prior law by generally giving relief to the aggrieved party. The court has reviewed documents from the man's case from the District Court including copies of the indictment and authenticated copies of the presentence investigation report. The latter was prepared by a United States Probation Officer, United States District Judge, after the defendant's plea and before imposition of sentence. The report contains several types of documents, including an analysis of the crime committed by the defendant and the sentencing options and recommendations of the Government, as well as copies of the e-mail communications between the defendant and the undercover postal agent who posed as a seller of pornographic videotapes and communicated with the defendant regarding the defendant's purchase of these videotapes. The e-mails between the defendant and the agent contain information regarding the age of the minors in tapes the defendant attempted to purchase. Specifically, the tapes ordered by defendant were to contain child pornography depictions of 5 or 6 year olds, 11 year olds, or 14 year olds. The document is accepted by this court under the common-law hearsay exception for public records. The court may receive an authenticated document and take judicial notice of the authenticity of the document with a proper official seal or signature affixed by an officer of the Federal Government. The man offered no evidence to the contrary or otherwise challenged the presentence investigation report. Therefore, based upon the available, reliable and admissible facts of the defendant's federal conviction, the court finds that the defendant was convicted of a felony which contains the essential elements of a New York felony, and he must register as a sex offender under SORA.
