Massachusetts adopts FBI-based Background Check for School Officials

Recently, Governor Deval Patrick signed a new law that will require all Massachusetts teachers, school employees, child care providers, and school bus drivers to submit their fingerprints prior to starting the September 2013 school year. Even under the new record sealing laws, these particular entities had access to "sealed records" of potential employees due to their close contact with children. However, only a state background check was issued, unless certain circumstances known to the employer warranted a more comprehensive check of a particular candidate. Now, the FBI-based system will provide a national check of the person's criminal history. In addition to the background check going to the national level, the FBI-based system is more comprehensive in terms of "hits" on a check. In Massachusetts, even the most comprehensive background check, such as those done for teachers, only results in information generated from official court proceedings, starting with an arraignment. The arraignment date usually takes place on the next business day following an arrest, or on another date in which the defendant is summonsed to appear before the judge. However, there are certain cases in which a person is arrested and the case is disposed of prior to arraignment (for a variety of reasons), so these cases would not show up on a background check. However, these cases WOULD show-up on any FBI-based check, since a suspect's fingerprints are transmitted to the national database at the time he/she is booked at the police station following an arrest. As a result, if you are applying for a job as a school teacher in Massachusetts and have ever been arrested for any reason in the United States of America, you should be prepared for your potential employer to know of the charge(s), regardless of the eventual outcome of the case. SHREWBURY MAN FACES FEDERAL CHARGES FOR VARIOUS SEX CRIMES OUTSIDE THE UNITED STATES

Shrewsbury's unfortunate-named Conrad Gallant (hereinafter, the "Defendant") had an interesting take on "What happens in Vegas, stays in Vegas. ". The alleged result? Federal criminal charges for various sex crimes. Last Friday, the Defendant pleaded not guilty to charges that he traveled to the Dominican Republic to have sex with underage girls. The 62-year-old Defendant was now in federal court in Worcester. He faces charges including sexual exploitation of children and engaging in illicit sexual conduct in foreign places. He allegedly traveled to the county to have sex with minors at least four times between February 2011 and March, 2012, When he was arrested. He is being held without bail. The Defendant is accused of carrying on an affair with a 14-year-old Dominican girl(hereinafter, the “Girl”) for approximately one year. Not that this one girl was enough, mind you. Apparently, he needed two more. According to authorities, the matter came to light when National Tourist Police in the Dominican Republic encountered the Girl at a bus stop in Bavaro-Higuey. She explained to the police that she had stolen the Defendant’s credit card and withdrew 26,000 Dominican pesos, the equivalent of $671, after they had sex. He had, after all, promised to give her 20,000 Dominican pesos to take her mother to the doctor, but that did not quite work out as arranged. He did not give her the money. The Girl continued to tell the authorities about the year-long relationship which purportedly began in February, 2011. She explained that she had even lived with the Defendant for two days at an apartment and engaged in sexual acts with him before he returned home to Massachusetts. Which is where he is said to live in his ex-wife’s home.

The proposal would ban Class A felony child molesters and sex offenders convicted of child solicitation from sites such as Facebook. Republican Sens. Jim Merritt and John Waterman introduced a measure Monday that they say is narrow enough to comply with the 7th U.S. Circuit Court of Appeals ruling. The court found Indiana's 2008 ban violated the First Amendment because it was too broad. Guilty Plea in Home-Flipping Ponzi Scheme

An Arizona man entered a guilty plea to charges that he orchestrated a house-flipping Ponzi scheme that defrauded investors out of nearly $2 million.  Jere Parkhurst (f/k/a Jere Sessions) pled guilty to a single count of wire fraud in a criminal proceeding that was originally spawned from a series of civil lawsuits brought against Parkhurst by disgruntled investors.  After criminal authorities caught wind of the scheme, Parkhurst was indicted in 2011 on seventeen counts of wire fraud and ten counts of money laundering. Both wire fraud and money laundering each carry a maximum potential sentence of twenty years in prison along with a criminal monetary fine. Parkhurst owned and operated several companies that included C Street Holdings, LLC; Capital Real Estate Co. LLC; and Phoenix Financial Holdings (the "Companies").  Beginning in late 2006, Parkhurst began soliciting potential investors for what he described as the remodeling and resale of historic homes in the Phoenix area.  Investors were promised annual returns that ranged up to 25%, which in turn attracted other investors as original investors began spreading word about their success. However, according to authorities, Parkhurst misrepresented the use of investor funds, and instead operated the classic Ponzi scheme by using incoming investor funds to make interest and principal payments to existing investors.  Additionally, when Parkhurst actually did use investor funds to purchase real estate, he failed to keep current on mortgage, utility, and insurance payments.  When the real estate market began to head south, Parkhurst fell further behind in scheduled interest payments, which resulted in the filing of several civil lawsuits by burned investors.  Federal authorities began investigating Parkhurst and the Companies soon thereafter. In a troubling lesson of how valuable it can be for an investor to conduct due diligence before entering into any investment venture, one newspaper reported that several civil judgments had been entered against Parkhurst and his wife beginning in 2004 - several years before the scheme was hatched.  Such judicial records are easily retrievable by conducting an online records search. Parkhurst is scheduled to be sentenced April 15, 2013.

Judge Anthony Leonard QC sentenced Exley, of Clapton, to a three-year community order and ordered he undertake an internet sex offenders programme. Andrew Baker, 53, of St. Anthony, ID, was driving east on Interstate 86 near milepost 43, in a 2013 Kenworth tractor, pulling an empty 2008 Beall tanker trailer. Baker steered off the road into the median. The vehicle traveled through the median, off the top of an overpass and came to a stop partially on the roadway below the interstate. It is unknown whether Baker was wearing a seatbelt. Baker was transported by ground ambulance to Power County Hospital District in American Falls, ID. He was later transported by ground ambulance to Portneuf Medical Center in Pocatello, ID. The eastbound fast lane is still blocked at this time, as the tow company attempts safe removal of the vehicle.
