Oklahoma death row exoneree Curtis McCarty recently sat down with Wichita Public Radio to discuss his wrongful conviction and life behind bars for a segment that focused on capital punishment in Kansas. Despite capital punishment being legal in the state, Kansas hasn't executed an inmate since 1965. In 1972, the U.S. Supreme Court ruled that the death penalty was unconstitutional. Four years later, the high court reversed the ruling and allowed states to carry out executions under certain guidelines. Since Kansas reinstated the death penalty a decade ago, there have since been 85 charges of capital murder and 13 convictions, nine of which still stand. Just across the state border, McCarty spent more than 20 years behind bars in Oklahoma. Since 1976, 111 individuals convicted of murder have been executed by lethal injection in that state. The Minnesota Vikings extended their lead as the NFL team with the most arrests since 2004 after defensive lineman Tom Johnson was arrested for disorderly conduct and trespassing at a popular Minneapolis nightspot over the weekend. Having played Thursday against the Packers, the Vikings had a few days off during the long break. According to the police report, Johnson was out at Seven Steakhouse on Saturday night and early into Sunday morning. He was apparently having such a good time that he didn’t want to leave the establishment after closing time. Police say Johnson was told to leave after closing time “repeatedly by security and officers and [he] refused.” Police decided to subdue Johnson and forcibly take him out of the restaurant, as the police report notes that Johnson “was sprayed with department-issue chemical irritants and forced outside.” Needless to say, Johnson wasn’t pleased that he had been pepper sprayed, and he reportedly…

The Constitution of the United States guarantees a right to remain silent, right?  Guess again.  What the Fifth Amendment actually says is, "No person ... shall be compelled in any criminal case to be a witness against himself ...."  That is not exactly the same thing.Emily Green has this story at NPR on a recent decision by the California Supreme Court on the use of silence as evidence of guilt, People v. Tom, and its predecessor case in the U.S. Supreme Court, Salinas v. Texas (2013).  The story has sound bites from several people, including yours truly, but the issue is more complex than can be covered in a brief story. 196th Street Closed After Drunk Driver Hits Electrical Pole

For about 12 hours following a car accident on Wednesday, October 1st, a portion of 196th Street SW in Lynnwood was closed to all traffic. The closure occurred after an SUV collided with an electrical pole, toppling the pole and knocking down power lines. Traffic was prohibited between 68th Avenue W. and 74th Avenue W. until 9:45 a.m. on Thursday morning while the hazardous situation was remedied. The driver who collided with the power pole is suspected of having been under the influence at the time of the incident. Law enforcement officials reported that there were no injuries as a result of the crash. The driver, a woman believed to be in her 40s, was arrested and is under investigation for driving under the influence. Even a first DUI carries harsh penalties in the state of Washington. If this was the driver's first offense, she could receive a sentence of a minimum of 24 hours in jail, hundreds of dollars in fines, and have her license suspended for up to 90 days. …

Penalties for a speeding infraction include: steep fines, insurance rate hikes, and added points on your driving record. In the past, I have just paid the ticket and tried not to speed in the future. Recently I have discovered this may not always be the best solution. In the past few days, I have represented two different clients on speeding ticket cases. In each one, the clients had been issued a citation for diving between 10 mph and 15 mph over the posted speed limit. After negotiating with the prosecutors, we were able to reduce the infraction from speeding to an “equipment violation.”…

Anknüpfungspunkte sind zumeist Urteile, die in den letzten Monaten viel Medienecho hervorgerufen haben. So zum Beispiel auch der Fall eines Lehrers, der nach einvernehmlichem Sex mit einer 14-Jährigen Schülerin nicht bestraft wurde, da er lediglich der Vertretungslehrer der Schülerin war.
