IDAHO STATE POLICE NEWS RELEASE District 4 Patrol 218 West Yakima, Jerome, ID 83338-5904 (208) 324-6000 Fax (208) 324-7897 For Immediate Release: 10/11/2014 8:55 p.m. Please direct questions to the District Office The Idaho State Police is currently investigating a single vehicle fatality crash that occurred at approximately 6:30 p.m. on Saturday, October 11, 2014. A 1999 Ford Ranger was driving east on Interstate 84 when it blew a tire near milepost 137 in Gooding County. The male driver lost control and rolled several times into the median. A female passenger was ejected and died on scene. Neither occupant was wearing their seatbelts. The male was transported by ground ambulance to North Canyon Medical Center in Gooding. Emergency personal are still on scene with blockage to the east bound left lane. Names are not being released until notifications have been made. This crash is under investigation by the Idaho State Police. DSP Initials KL/HG -------------

Section 1297 of the Penal Law, which is involved in this case, states that 'Grand larceny in the second degree is punishable by imprisonment for a term not exceeding five years'. Thus, it states an outside maximum of five years, but no minimum. In that respect it is similar to the statute in the Zuckerman case which involved Section 1935 of the Penal Law. That section too had an outside maximum, i. e., of seven years, but no minimum. It is also similar to the situation in the Potskowski case. Both here and there the maximum limit was five years, with no minimum mentioned. The District Attorney urges that upon a conviction for a felony in the County a criminal defendant may be sentenced by the County Court only to a term of imprisonment in a state prison, if there is no county penitentiary.
