Defense counsel seeks to have this Criminal Court vacate a condition of defendant's sentence of probation wherein the Court directed that the defendant reimburse Nassau County for the costs associated with its investigation of the defendant. Defense counsel asserts that the portion of the sentence directing restitution "was illegally imposed, unauthorized and invalid as a matter of law in that neither the Nassau County District Attorney nor the Nassau County Police Department is a 'victim' qualified to receive restitution for public monies received in the pursuit of solving crimes. In response to defense counsel's application and argument, the People do not contest defense counsel's assertion that the restitution portion of criminal defendant's sentence was unauthorized, but maintain that "... the entire sentence imposed by this Court on March 7, 1997 should be vacated and the matter should be scheduled for resentencing" It…

Family Law Lies Endanger “Save China’s Tigers Charity”

Stuart Bray met his wife Li Quan in 1990 and quickly embraced her passion to save China’s tigers and to develop a breeding program to reintroduce China’s tigers back to their wild reserves. Each of them invested huge sums of money, time, and energy into their joint charity called “Save China’s Tigers” which was established in the United Kingdom in 2000. Mr. Bray had a successful career in finance and banking before leaving the Deutsche Bank with a libel judgment in his favour for $20 million pounds. Ms. Quan and Mr. Bray began living together in 1997 and married in 2001. Regrettably, the couple’s marriage floundered, in part because they could not agree about future policy for their tiger project. Ms. Quan commenced divorce proceedings in the divorce capital of Europe, London, England, and was removed from the directorship of the charity. She alleged in Court that the millions of dollars held by the charity had been used by her husband as…

Photo: Stanley Mozee (left) and Dennis Allen (right) are greeted by family, supporters and the media after being released in Dallas Tuesday. (Credit: Lara Solt) Dennis Lee Allen and Stanley Orson Mozee walked out of a Dallas County courtroom today after the judge ruled that their murder convictions from 2000 should be overturned based on previously withheld evidence. The Innocence Project and the Innocence Project of Texas had petitioned for the pair's release based on evidence that indicates serious prosecutorial misconduct, which was discovered in the prosecutor's original file under the "open file" policy adopted by District Attorney Craig Watkins in 2008, as well as the favorable results of recent DNA testing on bloodstains and other key evidence from the crime scene. District Attorney Watkins and his Conviction Integrity Unit agreed that the prosecutor withheld exculpatory evidence and joined the lawyers for Mozee and Allen in seeking today's…

The defendant was indicted by a Nassau County Grand Jury on September 23, 1985, charged with Grand larceny, Second Degree. In the indictment, it is alleged that, on or about July 15, 1985, the defendant stole a 1984 Pontiac Trans-Am from an automobile dealership in Hicksville, New York. A Nassau County Criminal lawyer said that on August 19, 1985 the defendant was charged in a felony complaint with stealing the aforesaid Pontiac, and on September 23, 1985 he was indicted for Grand larceny in the Third Degree in connection with that alleged theft." The People do not contest the factual allegations set forth by defense counsel only his legal conclusions. The fundamental principle that a defendant may not be placed twice in jeopardy for the same offense is embodied in the federal and New York State constitutions, and in the statutory law of this state. In the instant case, there is no federal constitutional issue involved even though the 5th Amendment prohibition was ruled…
