The SJW Dangerous Sexual Predator List

There has been much hemming and hawing online about the IGDA blacklist. Many have misrepreseted my position. They are falsely claiming that I said someone could sue for being blocked on Twitter, or could be sued because they were named as a member of some group. I said nothing of the sort. I have never said anyone can sue for being blocked on Twitter. That would be a madness. Blocklists are legal and even ethical. I wish people would "block" me on Twitter rather than come to my Twitter page, read my Tweets, and then claim I'm harassing them. (How I harass people by writing about them and not to them escapes my comprehension.) I have never said that anyone could sue because they were part of a group that was defamed. That would be madness, as group defamation claims are untenable.  If IGDA had simply said, "Here's a blocklist someone wrote in order to target what she views as online harassment," OK. Whatever. That'd be a bit sleazy,…

Prescription Abuse in Nevada – Legal Issues

Prescription Abuse in Nevada is Rising The abuse of prescription pills has been on the rise for several years in Las Vegas. The Las Vegas Sun reports that along with the skyrocketing use of painkillers, there is an increase of fatal overdoses. Prescriptions Drugs Related to Rise in Suicide The number of suicides attributed to prescription drugs is similar to the number of fatal deaths with firearms or car accidents with over 300 per year. The Sun studied the prescription drugs data from the Drug Administration, and they discovered that Nevada presently ranks fourth in the nation in the use of methadone, morphine and oxycodone. Young people now use hydrocodone, which is the main ingredient in oxycontin more than any other painkiller. The Nevada statute 453.128 legally defines a prescription as an order given specifically to the individual for whom it is prescribed from a licensed physician, dentist, optometrist, veterinarian, advanced registered nurse or their assistants. Not according to this New CDC study mentioned in the NY Times. According to the study, 90% of heavy drinkers are not alcohol dependent. In my experience, this does not surprise me. Frankly, most DUI's are because of "bad judgement"...

The Outrage of the Victim’s Rap Sheet Must End

In the press conference addressing the killing of Akai Gurley by probationary Police Officer Peter Liang, Commission Bill Bratton made one thing absolutely clear: “the victim, Akai Gurley, had done nothing to provoke a confrontation with the officers.” From the time of the shooting through the following day, the NYPD sought to excuse the killing by justifying why a cop would have a reason to be afraid of doing his job, but at least it shows the small degree of class, of integrity, by not following Rule 3 in the Cop Public Relations manual, smear the victim.  In an incident that left little to admire about the NYPD, this alone spoke well of its integrity. By the next day, it was gone. Gurley has 24 prior arrests on his record, police said. First, arrests are not convictions, but perhaps that’s just poor journalism, that whoever wrote this doesn’t understand the distinction. But why did the cops have to dive head first into the cesspool and…

Student Arrested for Battery After Attack in Front of Resource Officer

As a Jacksonville criminal defense attorney, brazen acts committed in front of authority figures are like nails on a chalk board. Perhaps the only things that could be worse for a Jacksonville criminal defense attorney are videos of the offense and confessions. Recently at Jacksonville's Wolfson High School, 18 year old Chynna Cinnamon Thompson allegedly attacked another student and the Dean of Discipline, Joshua Kristol, when he tried to intervene. According to firstcoastnews.com, both acts took place in front of a school resource officer. Thompson was arrested for misdemeanor battery, as well as, battery on a school employee. Battery occurs when someone intentionally touches or strikes another person against the person's will or intentionally causes bodily harm to another person. Battery is typically a 1st degree misdemeanor, but under Florida law, when certain classes of people become victims of a battery, the offense is automatically reclassified as a felony.…

Provocation and Queer Fear

At Volokh Conspiracy, Eugene notes an amendment to California’s provocation defense to voluntary manslaughter. Under U.S. law, killing someone is “voluntary manslaughter” rather than murder if the killer was (1) actually provoked into a rage by the victim, and (2) the killer’s reaction was seen as “objectively reasonable,” in the sense that the law empathized with the killer’s rage though not his conduct (which, after all, remains a crime, just a less serious crime). While saying this is “under U.S. law” is unfortunate, given that this is a matter of state statute, and there is no such thing as “U.S. law,” it’s a fair generic explanation of the theory behind provocation.  But California’s law deals with a specific issue, one that (no doubt, surprisingly to many) is fairly common: men who are outraged to learn that the person with whom they just engaged in a sex act is not female, and thereupon…

NFL WEEK 12 2014 : A THANKSGIVING SPECIAL

We roar into Week 12 of the 2014 NFL season with our Fantasy Football league very competitive, our two remaining survivor pool players in a death grip struggle for the title, and with football set for Sunday, Sunday night, two games Monday and then the traditional Thanksgiving day games. Is there any better week for football? With a cold front expected to hit our fair town Wednesday, its shaping up to be a great holiday week. Need some flow for Black Friday?  Try out these money makers. The Broncos had their let down game last week. So this is the week Peyton and company bounce back against our Dolphins. It's going to be warm, if not downright sticky, and Peyton does much better in warm weather than cold. Petyon has a palatial condo on the tip of  South Beach, so maybe he's had some home cooking and this isn't as much a road trip for him as say Buffalo.  But we like the Dolphins to keep it close. They have been playing well, are well…

When There Is No Room Left For Facts

Rarely do I mention when I’ve been interviewed, or quoted in a newspaper or appear on TV.  Not only do I find such shameless self-promotion distasteful, but it’s just not that big a deal.  So forgive me for bringing this up, but as the following will hopefully explain, the purpose is to show how views are influenced by the presentation of partial truths when time runs out. A couple of weeks ago, a call came in from a producer for PBS NewsHour.  He had read my post about Mayor Bill de Blasio’s implementation of Vision Zero in New York City, a plan to eliminate all pedestrian deaths caused by traffic accidents. The producer had read my post on it, and had questions about the “rule of two,” a poorly-named concept that requires something beyond a mere traffic infraction to elevate negligence to criminality.  In an earlier post about the Court of Appeals decision in the Brett Cabrera case, the “rule” is more thoroughly…

It's Not Like Knowing Would Matter

The thing that's different about Scott Panetti isn't that he's on death row even though he won his case in the U.S. Supreme Court.   The court didn't say he should be freed, after all.  It didn't even say they couldn't kill him.  Just that they had to reconsider.Nor is the thing that's different about Scott Panetti that he's on death row even though he's batshit crazy.  Panetti, after all, is on death row in Texas where that's no impediment.  After all, they keep Andre Thomas there, in a mental unit, and insist that they plan to kill him for the murder of his family, which they figure he understands well enough since he acknowledges that he did kill them even though he thinks they're still alive and the real reason they want to kill him is his superiority.  And there is that thing about Thomas having plucked out his eyes - eaten one and thrown away the other - but hey, drugs and alcohol and…

Ignition Interlock Bill Dies In Committee

Annie’s Law (H.B. 469) a bill that would have required all first-time OVI offenders to install an ignition interlock device in their vehicles has failed to garner enough votes to make it out of committee.  The bill, in its proposed form would have required a driver to blow into the the device to start the car, which would prevent the engine from starting if too much alcohol was detected on his or her breath. The bill faced opposition from the [Read the full post. . .]
