Justice John Roberts and the conservative Supreme Court of the United States of America strikes again. In an 8 to 1 decision written by Chief Justice John Roberts the court held that evidence gleaned from an otherwise illegal search and seizure can be used against the defendant if the stop was based on good faith. This is a horrible precedent to set for an already strained American people who are sick and tired of law enforcement overstepping their boundaries and in some cases making fatal decisions which go unanswered the courts. While this decision does not rise to the level of law enforcement killing suspects and police not being indicted, it does further offer the police a wide net to work with because evidence that was formerly obtained as the result of an illegal search and seizure was considered tainted and not usable in court; but as a result of this decision it appears that such evidence, if obtained under the color of law, even though mistaken will be permitted to…

Beware of DUI Roadblocks this Holiday Season

In Illinois, a common practice used by police to bust drunk drivers is the use of DUI Roadblocks, otherwise referred to as Safety Checkpoints. Use of roadblocks to identify intoxicated drivers is legally permissible, only if utilized correctly by police. If you have been arrested for DUI following a roadblock stop, do not automatically assume that the stop, search, and arrest was proper, as the Fourth Amendment of the U.S. Constitution still affords citizens protection against unlawful search and seizure. The U.S. Supreme Court has determined that, if done properly, roadblocks do not unreasonably intrude into an individual's privacy because intoxicated motorists pose a substantial risk to the safety and welfare of other motorists. With that said, police are not granted unfettered freedom of intrusion, and are still governed by principles of reasonable suspicion to stop an individual and probable cause to make an arrest. Massachusetts SJC Imposes New Rule on In-Court Identifications

In the recent case of Commonwealth v. Walter Crayton, the Massachusetts Supreme Judicial Court established a new standard for the admission at trial of an in-court identification of the defendant where the witness had not, prior to trial, been asked to participate in an out of court identification procedure.  The new rule imposes the burden on the Commonwealth to request. prior to trial, that the prospective witness be permitted to make an in-court identification if there has not been any previous identification of the defendant. Once the prosecutor makes this request, the burden remains on the defendant to establish that the proposed in-court identification would be “unnecessarily suggestive” and that there would be no “good reason” for it.  Examples of “good reason” for the first identification procedure by a witness against a defendant at trial may include circumstances where the eyewitness was familiar with the defendant before…

Although stories about celebrities facing Los Angeles DUI charges are reported every day, average citizens often act surprised when people in authority face similar charges. Oklahoma Senator Charged Republican senator Bryce Marlatt was recently charged with a subcategory of DUI known as actual physical control, or APC. APC indicates the vehicle was actually moving when the suspect was pulled over for the DUI. Woodward, OK, police found Marlatt asleep in his moving car.
