Over the past two days, I’ve had much to say about the relationship of the tragic murder of two cops in New York City, the insane and inflammatory rhetoric and blame by PBA President Patrick Lynch, the similarly insane threats made by other crazies against police, and the ratcheting up of antagonism all around. But I haven’t been able to do so because of computer problems. I’ve been on the road this week, and for reasons that have no good explanation, my laptop picked two days ago to decide that its operating system didn’t like its programs, and so they failed to function. The failures were pervasive, and even now as I type it’s via a few workarounds that I’ve found, using highly limited functionality. It’s not good.  I blame Microsoft and Dell, the manufacturer of this ultrabook, not that blaming anyone does any good.  After hours of talking to a pretty good tech guy at Dell, it appears that the answer is the Windows 8.1 has…

Rachel T. Hollibaugh, 38, of Dietrich, ID., was driving southbound on Interstate 15, near milepost 65, in a 2001 Ford F250 pickup. Rachel lost control of the vehicle and drove off the left side of the road, into the median. The vehicle rolled, coming to rest on its top. Rachel T. Hollibaugh and her daughter, Tanessa Hollibaugh, 14, were pronounced dead at the crash scene. Five minor children of Rachel were transported by ground ambulance to Portneuf Medical Center in Pocatello, ID. Next of kin has been notified. DSP Initials do / sc -------------

The issue of legal fees and how much you should pay for a DUI is a complicated subject, but some people just want a direct answer. This very short article will answer the question, "How much do you charge?" I decided to put this article in front of the one that follows, although it covers the very same subject. As I noted, this can turn into a rather detailed discussion, and for the person pondering who to hire, and what he or she should pay, I think that a more detailed analysis is warranted. Yet I cannot deny that some people want to get right to the point, so this is my salute to them. While marijuana is now able to be used legally for medicinal purposes in some states, being charged with possession of marijuana is not as minor as many people may think. Because the state of Louisiana has mandatory minimum sentences, even a first-time offender can face years in prison depending on the amount of marijuana in his or her possession. If you are found in possession of 60 pounds or more of marijuana, it is classified as a felony drug possession offense, and the mandatory minimum sentence starts at five years in prison. Those possessing 2,000 to 10,000 pounds of marijuana are subject to a mandatory minimum sentence of 10 years in prison, and the minimum sentence for more than 10,000 pounds is 25 years. Charges of distributing marijuana also carry mandatory minimum sentences, no matter the amount of the substance. The mandatory minimum for a first-time offender is five years in prison. When William Desmond contended that he and his fellow Harvard law students deserved to have their final exams delayed so they would “no longer be spectators to injustice,” was he suggesting they would be hitting the road to Ferguson to chant “hands up, don’t shoot”? We recognize that this is a moment for change. If not us, then who? Nowhere in his inelegant apologia does he mention how “us” plans to achieve this role in history. In the 1960s, Freedom Riders took the road, and some paid with their life for their efforts. Desmond sought to don the mantle, but what was he going to do with it? Create a Facebook page? Clay County Sheriff's Office pays settlement to another innocent person wrongly jailed, accused of serious felony

For the second time this year, the Clay County Sheriff's Office has paid tens of thousands of dollars to a person who had the same name as a suspect, but was still held in jail for a crime he or she did not commit. The second settlement was announced this month, as police paid $50,000 after a teen sued following a month in jail accused of sexual battery on a child younger than 12, according to a report in the Florida Times-Union. Police were looking for another teen with the same name at the same high school, but did not show the alleged victim a photo of the person they arrested before they locked him up, the newspaper reported. Earlier this year, the sheriff's office settled another suit, paying $67,000 to a woman who was extradited from Louisiana on a charge and was falsely arrested twice, the newspaper reported. Our criminal defense lawyers at the Law Offices of Leifert & Leifert are fascinated, though not surprised, by recent research showing that teenage marijuana use in America is dropping, despite more and more states embracing legal access to marijuana. To be sure, this is part of a much larger, and encouraging, trend. As reported by the Washington Post, teenagers are smoking cigarettes far less than they used to, they're drinking way less alcohol, and, as noted above, they're smoking less pot. What's notable here is that of the three substances mentioned above, the only one that's recently become legal in a number of states is marijuana. Critics of marijuana legalization have argued, since the days of Richard Nixon and still today, that legalizing pot will make it more accessible, and more susceptible to abuse, especially by the younger members of society.
