Like kale chips before it, California is leading the way to the new world order of consent. Oh sure, the “Yes means Yes” in college signed into law, but what are the chances that it will fundamentally alter life at the rocket propulsion lab at Cal Tech, right? Sheldon?  Well, anyway. While attention is devoted elsewhere, the California experience is proving to be difficult. It seems that many, women included, are finding affirmative consent unnatural. While rational people would recognize this failing to be the direct result of human nature and rational thinking, activists see it as both a failure to teach males affirmative consent early enough in life, and extend it beyond the confines of mere sexual relations. In other words, they want affirmative consent to be a way of life. Over the past week, I flew down to West Palm Beach, Florida, which bears the official title of “God’s Waiting Room,” to clean out my parent’s home.  They’ve been unceremoniously moved north to assisted living, after it became painfully clear that their independent living ticket expired. They weren’t happy about being ripped from their home of the past couple decades. The argument was that they wanted, no, needed, more time to decide how they should live the balance of their lives.  What they failed to realize was they had that opportunity, which we refer to as the last five years, but refused to acknowledge it. Contrary to assumptions, the downhill slide happens slowly, but happens nonetheless. No alarm bell rings when the time is up, as it comes in tiny, ever-increasing bits, until you realize that you should have dealt with it years earlier, but failed to see the now-obvious signs.  Be thankful that they didn’t run…

Peggy Fikac has a nice profile in the SA Express-News (Dec. 25) of incoming Texas Court of Criminal Appeals Judge Bert Richardson, whom Grits had supported in the GOP primary due primarily to his knack for not being Barbara Walther. I got to know him a bit over the course of the campaign, though, like him a lot, and am hopeful about his prospects.Fikac's story was prompted by Richardson presiding over Rick Perry's indictment, but given that in January he'll begin a six-year term on Texas' high criminal court, CCA watchers may be interested in the assessments offered of Richardson's background and judicial skills. It has now been a week since two New York police officers were senselessly murdered in their cars by a mentally-ill individual. “Today two of New York’s finest were shot and killed with no warning, no provocation,” Mr. Bratton said at Woodhull Hospital in Williamsburg, where the officers were declared dead. “They were, quite simply, assassinated — targeted for their uniform and for the responsibility they embraced to keep the people of this city safe.” I may disagree with Police Commissioner William J. Bratton – perhaps to the point of disagreeing with him over the motive for the murders – but I know of no sane person who would disagree that this was nothing short of cowardly, cold-blooded murder. In an important legal decision upholding the convictions of two defendants for criminal harassment, the Massachusetts Supreme Judicial Court (SJC) ruled that internet harassment (or “cyber-harassment”) does not constitute free speech, protected under the First Amendment to the U.S. Constitution. Veteran Boston Herald courthouse reporter Laurel Sweet reported on the story, noting that the case under review, Commonwealth v. William P. Johnson, involved two Andover real estate developers named William and Gail Johnson. Both of these defendants were convicted of criminal harassment in Lawrence District Court in 2011. William Johnson was sentenced to 18 months in jail; his wife Gail Johnson was sentenced to six-months in jail for her role in the harassment scheme. Rarely has a group of people exposed their true disdain for all others as clearly as the New York police officers who turned their back on Mayor Bill de Blasio at the funeral of Rafael Ramos.  They wanted to send a message, that they demand to be treated better than all others.  They sent a message, but not the one they thought. They are given training, guns and shields, not to mention a paycheck and a pension, to do a job.  That’s not enough for them. They demand two more things to which they are not entitled: impunity for their violence and protection from harm above all others. The NYPD was given the nickname “New York’s Finest.” They are not. Some may be, but the ones who turned their back have no business wearing a shield.  They are untrustworthy.  They are ignorant of their duty. A profile of outgoing Bexar County DA Susan Reed in the SA Express-News (Dec. 27) mentioned, while recounting her "missteps" sandwiched between mostly positive reviews, that "Her refusal to appoint a special prosecutor to review claims that Ruben Cantu was wrongly executed in 1993 after an eyewitness reportedly recanted. The decision raised eyebrows because Reed, as a judge, had denied one of Cantu’s appeals and set his execution date. A 19-month investigation by her office found Cantu was not wrongly sent to the death chamber." FINRA and Due Diligence: On-Site Checks Are Indispendible

Due diligence is all about following up on red flags, but if you don’t find them, there’s nothing on which to follow up. Thus, our tireless refrain: turn over every piece of public record information you can about a person, and don’t leave it to others. We were reminded of this by the story this weekend in the Wall Street Journal, which found that the brokerage industry regulator, FINRA, leaves a lot of red flags concerning members off its BrokerCheck website. While it’s laudable that FINRA recommends that investors check to see if brokers have ever been subjected to disciplinary action, that check is of limited use if bankruptcies, state-level actions and litigation are left off of BrokerCheck. We have been writing for years about the need to do thorough searches when conducting due diligence on anyone – pre-employment, pre-deal, or during litigation.
