ISP anticipates hiring approximately 20 new Troopers with positions available in all of ISP's six district offices. ISP is specifically seeking applicants to fill positions in the Coeur d'Alene and Twin Falls areas. The hiring process takes approximately 6 months to complete and successful candidates will begin training in August 2015. Trooper recruiters will be onsite and available to answer questions during a job fair on February 24th from 5:00 to 7:00 pm at the Idaho Department of Labor's Meridian and Twin Falls' offices and from 4:00 to 6:00 pm in the Coeur d'Alene office. Stratford Dr., Meridian 83642 (208) 884-7122 Fax (208) 884-7087 For Immediate Release: 2/18/14 at 4:55 p.m. MERIDIAN - The Idaho State Police have arrested a Texas man suspected of trafficking marijuana from Washington en route to Texas through Idaho. On Monday, February 16th at about 8:10 p.m. an Idaho State trooper stopped a 2009 Ford Escape traveling eastbound on I-84 near Nampa for a traffic infraction. During the stop the trooper detected the strong odor of marijuana coming from the vehicle. The trooper called for a drug detection K-9 which subsequently alerted to the vehicle. Inside the vehicle troopers found approximately 25 pounds of marijuana. The driver told troopers that he had moved to Washington to grow marijuana to then take back to Texas to sell. John Kitzhaber is no longer Governor of Oregon.  There is no news of his issuing any death row commutations on his way out the door.  AP has this story on a noncapital commutation.  Kitzhauber's December 6, 2011 reprieve, quoted in the Oregon Supreme Court's decision in Haugen v. Kitzhaber, S060761 (June 20, 2013), reads, NOW, THEREFORE, by virtue of the authority vested in me by Article V, Section 14 of the Oregon Constitution, I, John A. Kitzhaber, MD, Governor of the State of Oregon, hereby grant Gary D. The 84th Texas Legislature should be the time and place to finally eliminate the Orwellian-named Driver Responsibility surcharge, that bane of low-income drivers which has taken driver licenses from more than 2 million Texans for nonpayment, more than 1.3 million of whom remain unlicensed. Texas drivers owe billions in unpaid surcharges, most of which no one believes can ever be collected.A lot of Texas legislators by now are keenly aware of the problem, and if they're not, their staffers working constituent service are. Plus, the state enjoys billions in extra revenue (though admittedly there are many state needs competing for the money). So if there was ever a time in recent memory when it might be politically feasible to get rid of the program, on its face this would appear to be the year.Presently the Driver Responsibility surcharge sends about $55 million per year to Texas trauma hospitals and a like amount to the general revenue fund. This email went out today.  Friends & colleagues, many of you have been inquiring about our good friend Stan.  Stan underwent a very lengthy robotic surgery at UM for oral throat cancer, the surgery went very well, and in about 6 weeks he will undergo intense radiation therapy. Stan is still in ICU, and will be at UM for the balance of the week. Obviously he has taken a leave of absence from the Family Bench.  I spoke to him this morning, and he is upbeat and positive, and sends thanks to all of his well wishers for their prayers and support.  Feel free to email him gatorjudge13@gmail.com, since talking is difficult for now. I originally titled this post, “Making the World an Uglier Place One Stop at a Time.” My day ended thusly: at about 5:30 or 6 p.m., sitting in my office trying to figure out what’s going to happen tomorrow – I’d had a couple discussions with one DA, but another DA was MIA – and wondering if the tearful, anxious, 65-year-old woman who had just hired me was going to be okay, my phone rang. The man on the end of the phone claimed to be a prior client. I looked him up: I had helped him with a traffic ticket, or something, about 5 years ago, in another county. In his exceedingly gravelly voice, the man (who by now must be in his late 60s, at best, and quite possibly in his 70s) told me that he was stopped by the side of the road. Apparently, the CHP pulled him over for expired registration, and were saying they were going to impound his car. Is It Illegal To Drive With An Open Container Of Alcohol In The Car In New Jersey?

Yes, under New Jersey law, it is illegal to drive while in possession of an open container of alcohol in your passenger compartment (NJSA 39:4-51b). This includes open bottles as well as alcoholic drinks that may have been poured into a cup. Open containers of alcohol that are stored in your car’s trunk, or behind the last upright seat in a trunkless vehicle, are not violations of the open container law. Mobile homes, limousines, and chartered buses are also subject to exemption in most cases. The penalty for driving with an open container is a $200 fine on the first offense, with a $250 fine and 10 days of community service for a second and subsequent offense. This may not seem like a big deal to you, but keep in mind that if you’re the sort who is likely to run into alcohol violations in New Jersey, a history of offenses like this can lead to much more significant exposure down the road. AP reports:NASHVILLE, Tenn. - The Tennessee Supreme Court has agreed to hear a legal challenge over a law allowing the state to electrocute death row prisoners if lethal injection drugs are unavailable. The challenge is part of a lawsuit filed by 34 death row inmates over Tennessee's death penalty protocols -- both lethal injection and electrocution. The state wants the court to dismiss the challenge to electrocution protocols because none of the inmates are currently scheduled to die by electrocution. The new electrocution law was meant to jumpstart the state's stalled execution process, but it opened the door to new legal challenges. The hearing is scheduled for May 6 in Knoxville. When you are on bond with a bonding company, they may seek to get off the bond. Two reasons the company may do this is because the defendant has failed to pay or because the defendant is not checking in with the bonding company. Once a judge agrees and lets the bond company off, a warrant will be issued and the defendant is subject to arrest. There are ways to avoid this from happening. First, I have been able to intervene in some cases and re-establish contact between the company and the defendant. When I am hired on a case, I try to maintain a good relationship between the bonding company and the defendant. Second, if the bonding company is trying to get off for a trivial reason I can argue to the judge on my client's behalf and get the judge to not agree to the bonding company's request.
