This past week, the Sun Sentinel reported on a story that's been making national headlines ever since: a Broward County Deputy dragged a woman through a courthouse by her feet. The officer, who pulled the woman by the shackles around her ankles, has been placed on restricted duty. The woman, especially in light of the fact that a court had recently determined she was "mentally incompetent," deserves better. Realignment Offender Arrested After Violent Attack: A California man released from custody and placed on light supervision under Realignment is behind bars once again after authorities say he was involved in a violent assault and robbery Wednesday evening.  Susan C. We have previously written about the changing approach to drug policy in various parts of the United States. Although marijuana is illegal here in Louisiana for any and all purposes, a significant number of states have legalized marijuana for medical use. At least two states have legalized recreational use, and a number of jurisdictions around the country have decriminalized the possession of certain amounts of marijuana. Has the sky fallen? Have other types of crime skyrocketed? Has America doomed the future of its young people? According to a major government study, the answer is no. In fact, marijuana use among teenagers actually seems to have declined. In December, the National Institute on Drug Abuse published the results of its annual survey, which is called "Monitoring the Future." The gentlemen was convicted of a felony drug offense over ten years ago. Police got a tip from another felon that he sold a gun to his buddy. The buddy was another convicted felon. Upon investigating the tip, police found the gun under the felon’s bed and arrested him. The felon was referred to a lawyer and hired the lawyer to defend him. The lawyer who was hired took the client’s money and waited for the case to be filed as a felony. The lawyer appeared in court with the client and pled not guilty to the felony charge. At this point, the lawyer sought to get the client’s old charge reduced to a misdemeanor under Proposition 47. At some point in the future, this will surely happen. Having just reversed itself in the face of an en banc rehearing in Garcia v. John and Jane Does, the Second Circuit next addressed the case of Matthews v. City of New York. This interesting case concerns a NYPD officer's claims that his bosses punished him for complaining about a precinct-wide quota policy. Not too surprisingly, management rewarded Matthews for voicing his concerns by making his life difficult. He sued on First Amendment grounds. The district court dismissed, finding that he was acting as a public employee when he complained, rather than simply as a citizen. The Court of Appeals reversed. It's a good decision that puts a bit of a dent in the controlling Supreme Court case, Garcetti v. Ceballos.Many people assume that the First Amendment protects everyone's right to say anything to anybody at any time without fear of reprisal. This is not only untrue but entirely unworkable. What is the Admin Per Se? 1)   When you are accused of a DUI, MVD or the Police Officer will suspend your license for 90 days. This is the Admin Per Se Implied Consent suspension.
