Nice to see bipartisan support as the Lege prepares to consider the issue: The newly created House Juvenile Justice and Family Issues Committee will hear several truancy related bills at their meeting on Wednesday.

Michigan Driver's License Restoration: A Cerebral Analysis of the Decision and Requirement to not Drink

$

In my various writings about driver's license appeals in Michigan, I must always reiterate the preliminary importance of sobriety as a necessary perquisite to winning. The driver's license restoration process is all about making sure that someone whose license was taken away for 2 or more drunk driving convictions doesn't get back on the road until there is no doubt that he or she is forever done with alcohol. Anyone contemplating a license appeal after having his or her driver's license revoked for multiple DUI's is going to have to prove that not only doesn't he or she drink anymore, but that he or she doesn't hang around with drinkers, and has, instead, adopted what can be described (and must be proven) as a "sober lifestyle." This is never a problem for anyone who is truly "sober," but plenty of people - none within a million miles of actually being sober - don't quite get this, and mistake the meaning of…

The pervasiveness of insurance fraud drives up costs for all consumers and costs the insurance industry billions of dollars each year. One authority estimates that the annual value of insurance fraud approaches $80 billion. Detecting insurance fraud is difficult because of the surreptitious nature by which the criminal perpetrates the fraud. Depending on the specific issues involved, an alleged wrongful act may be handled as an administrative action or law enforcement may handle it as a criminal matter. Generally, securities fraud occurs when someone makes a false statement about a company or the value of its stock, and others makes financial decisions based on the false information. Although the crime itself isn’t complicated, securities fraud can be particularly difficult to grasp if you lack an understanding of securities regulation. Below, you’ll find information on common forms of securities fraud and how to protect your assets. If there is any easy way to…

A Clay County man who is already a registered sex offender is now back behind bars after authorities allege he attempted to sexually assault a minor. The 58-year-old man has been jailed after allegedly attempting to contact the child through his cellphone and trying to entice the victim into sex acts, according to police. Police said they obtained permission from the alleged victim to contact the man pretending to be the child. The Sheriff’s Office also claims that at one point, the man met with the minor and tried to force his hands down his pants and touch him sexually. The man was arrested for soliciting a child for unlawful sexual conduct using computer services or devices and attempted sexual battery and is being held on a $300,009 bond. Currently, every state in the U.S. has a sex offender registration law on its books. While sex offender registration laws differ from state to state, every state requires that identifying information about a person convicted of…

Bad facts make bad law. No facts make short opinions.United States v. Mendez-Sosa, 2015 WL 868560 (9thCir. Mar. 2, 2015), decision available here.Players: Per curiam decision joined by Judges Wallace, M. Smith, and Friedland. Facts: Mendez-Soza plead guilty to illegal reentry, in violation of 8 USC § 1326(a). Id. at *1. He had been previously convicted of Criminal Sexual Contact under New Jersey law. Id. At sentencing, the district court concluded that the offense was a “crime of violence” under USSG § 2L1.2(b)(1)(A)(ii) and hit the defendant with the sixteen-level enhancement. Id. Issue(s): “On appeal, Mendez-Sosa argues the 16-level enhancement was improper for two reasons. Second, he argues that even if he had been convicted of the prior offense, it was not a…

Testimony to Continue this Week in Two High-Profile Massachusetts Criminal Trials

Two high-profile Massachusetts criminal trials are now underway and testimony is expected to continue this week in both. In Fall River Superior Court, former New England Patriots tight end Aaron Hernandez is on trial for first-degree murder, charged with shooting to death his one-time friend Odin Lloyd. Last week’s testimony dealt largely with DNA probabilities.  An employee from the state police crime laboratory testified that biological material found on a spent shell casing that police contend came from the gun that shot Lloyd matched Hernandez’s DNA profile.  The state lab analyst also testified that a marijuana joint found in the industrial park where Lloyd’s bullet-riddled body was discovered contained the DNA of both Hernandez and Lloyd. The shell casing was found in a dumpster outside of a car rental business where the prosecution claims Hernandez rented the car that drove Lloyd to his death.  When the police found the casing, it was…

NYPD Quotas and the Blue Wall of Silence

Last week, P.O. Craig Matthews' case against the NYPD alleging retaliation for his complaining about the quota system (which the NYPD won't admit to), was reinstated by the United States Court of Appeals for the Second Circuit. Now, according to the NY Post in two different articles (here and here), a dozen plaintiffs have come forward in a lawsuit against the NYPD alleging that the department is enforcing a quota system for arrests and criminal summonses. These plaintiffs are black and Latino officers who are alleging that the policy is racially driven as the targeted communities are predominantly black and Latino, and these officers are treated more harshly than their white colleagues when they don't meet their quotas. The safe thing to say is that these are still merely allegations, yada yada yada. But they follow multiple lawsuits throughout filed by officers throughout the City of New York that all generally allege that officers are told there are…

The State of Legal Scholarship

Prof. Dorothy Brown of Emory has this op-ed in the WaPo, headlined "Law schools are in a death spiral. Maybe now they'll finally change."  The article includes this passage:While law firms can fire lawyers, law schools cannot cut their largest expense: faculty. Most faculty have tenure, which equals lifetime job protection -- as long as the school remains open. While faculty could be part of the solution to legal education's woes, we are actually the problem.Legal scholarship is in a terrible state, with counter-intuitive incentives for faculty. Status comes with publishing, but more publishing means less teaching and interacting with fewer students. In the legal academy, second- and third-year law students select which law professors' articles to publish; while my second and third years are brilliant, they cannot select for quality the same way experts would. But even if you think the student-run system is fine, the value of legal scholarship,…
