Der Beschwerdeführer brachte vor, dass der Gutachter mit allen drei Tätern intensive Gespräche geführt habe, wobei er unbewusst beeinflusst worden sei und dadurch seine Beurteilung verfälscht worden sei. If a person has never been convicted of a crime in the past, the minimum period of incarceration for a class A-2 drug felony is three years in prison. The maximum period is 10 years. If a person has previously been convicted of a felony within the past 10 years of the instant offense (excluding time spent in prison), then the minimum period of incarceration is six years and the maximum is 14 years. About that Time I was Falsely Accused of Making a Rape Threat...
I'm a controversial fellow who posts mean Tweets online. I get a lot of heat, and much of it is deserved. In fact, if you said you viewed me as the biggest asshole online, I'd be OK with that. Unfortunately people have gone beyond calling me out and instead have been falsely accusing me of making rape threats online. Background: Why was I falsely accused of making a rape threat? A few months ago I attracted a large hate mob for my support of the First Amendment. I was able to obtain court records showing a woman abused the court system (even lying under oath) in order to obtain an unconstitutional restraining order. As regular readers of Crime & Federalism know, I have often ordered court records out of my pocket to expose abuse of legal process. I even had to pay a considerable legal bill after being sued for defamation by Joseph Rakofsky. (I and my co-defendants won that case.) AA and Michigan Driver's License Restoration Cases
Being in AA can certainly provide an advantage in a license reinstatement case. Although AA is not required to win a Michigan driver's license restoration or clearance appeal (more than half of my clients are not in the program and I guarantee to win every case I take), it's time to revisit how AA can help. For anyone who has quit drinking, whether through AA or just because you said "Enough!" and meant it, the simple reality is that staying quit means understanding you can't pick up another drink. While AA didn't invent this reality anymore than Sigmund Freud invented the subconscious, each discovered, and, more important, named these respective concepts. As Freud gave us the language of psychology, AA has given us the "language" of recovery. This has shaped the very way we describe a person's relationship to alcohol: How and when it becomes problematic, and how and why that does, or does not change. Indeed, it is almost…
