A domestic violence related criminal charge in California carries significant consequences.  In addition to potential jail time, the accused faces being required to complete a 1 year batterer’s treatment program, and a protective order banning any contact with the alleged victim.  For legitimate domestic violence charges, these consequences are usually justified.  However, for the other situations where the alleged victim lies to the police, these consequences are devastating. A common scenario that happens in domestic violence cases is when the alleged victim regrets calling the police, claiming nothing really happened, they were just arguing.  Unfortunately, when the police respond to a domestic violence call, it is too late to turn back the clock, and most likely someone will be going to jail.  California Penal Code section 836(d) provides that if a police officer is called out to a domestic violence situation, ”a peace officer may arrest…

In a prior article about women's considerations in a DUI case, I noted that there are certain issues brought to the table just because the person facing the DUI is female. In this article, I want to take the same approach and look at how a DUI case can be both very similar and yet very different when the person charged is gay. To be clear, I don't profess any special expertise here beyond considerable experience representing members of the gay community and just knowing that there are at least some unique considerations involved when the person facing the DUI is part of that community. If there is any editorializing to get out of the way, it is probably that I have absolutely no hesitation in counting gay people amongst my professional circles as well as amongst my friends and people that I love very much. Pan American Airlines (5th Cir. 1971), overturning Pan Am’s ban on male flight attendants, to illustrate how airlines and other employers tried and failed to exploit Title VII’s bona fide occupational qualification (BFOQ) exception in the years after the Civil Rights Act’s enactment. Pan Am defended its female-only policy as necessary to satisfy the “psychological needs” of its mostly male passengers, who “overwhelmingly” preferred to be served by “young girls.” In Diaz, the court ruled that the “essence” of an airline’s business was not to titillate male travelers, nor to offer maternal comfort to anxious fliers, but rather to keep passengers safe from harm. Amid accusations of an inappropriate relationship with a 15-year-old girls’ basketball player, a Jay High School teacher and coach tendered his resignation from the school district on Friday. That same day, he was arrested and charged lewd molestation in Delaware County. This post examines an opinion the New Mexico Court ofAppeals recently issued in a civil suit:  Firstenberg v. Monribot, 2015 WL 993820 (2015). The court begins its opinion by explaining how and why the suit arose:Arthur Firstenberg sued his neighbor, Raphaela Monribot, and Robin Leith, the owner-lessor of Monribot's residence, for injunctive relief and monetary damages under the theories of nuisance and prima facie tort. In his complaint, Firstenberg alleged that because he suffers from a condition called electromagnetic sensitivity (EMS)that renders him acutely sensitive to electromagnetic radiation, his health was adversely affected by Monribot's use, within her own residence, of various electronic devices that generate electromagnetic radiation, including a cell phone, a Wi–Fi modem, dimmer switches, and a microcell.Firstenberg v. While there is not a consensus definition of what "binge drinking" is, we know that college students do a lot of it and they do it with beer.  When a person consumes heavily with the intention of achieving intoxication above .08% BAC, they are 74.4 percent of the time doing it with beer. (Nami, et al. 2004). Wine bingers are rare and account for only 10.9 percent of drinkers labeled as binge drinking. (Nami et al. 2004).  As you would expect, college binge drinkers are more likely than their non-drinking counterparts to experience one or more alcohol-related problems.  One study looked at binge drinking with a ten-year follow-up and found the binge drinkers were at a higher risk of becoming dependent on alcohol later in life and that binge drinkers were likely to depart early from college (Jennisom, 2004). Alleged child rapist arrested in Tonopah

Last week 39-year-old Kenneth Cardenas of Tonopah was arrested for allegedly sexually assaulting a 3-year-old girl four years ago. Earlier this month, the Nye County Sheriff's office received an alert from an outside agency regarding the alleged assault. The Sheriff's office commenced an investigation, which included Cardenas submitting to an interview by Nye County's Detective Perry. During the interview, Cardenas allegedly made incriminating statements that aligned with the victim's story. However, the Sheriff's office did not disclose what Cardenas's statements were. Cardenas was reportedly arrested without incident. Currently it is unknown where Cardenas is being incarcerated. His bail amount also remains unknown.
