New York Driver’s License Suspension For Committing Just One Violation?!

Did you know that you can be suspended for just one violation of New York’s Vehicle And Traffic Law (“VTL”)?  That’s right, a traffic judge can suspend you for just one speeding ticket or other traffic offense.  While on their face, most moving violation statutes in New York do not mention punishment by suspension (rather most just speak of punishable by a fine and sometimes imprisonment), the VTL has another section which authorizes discretionary suspensions for just one violation.  This other statute is vague and broad, and can generally be invoked by a traffic judge to suspend as he or she deems appropriate. VTL §510(3)(a) allows for a suspension of a driver’s license “for any violation of this chapter ***,  as shall in the discretion of the officer acting hereunder, justify such revocation or suspension” (emphasis added). Jury Convicts Settlement Agent in Multi-Million-Dollar Straw Buyer Scheme

Mortgage Fraud Blog. Edward Dacy, 76, most recently of West Melbourne, Florida, has been found guilty by a jury of 10 counts of conspiracy, bank fraud, and mail fraud stemming from a multi-million-dollar mortgage fraud scheme involving 45 properties and $16 million in mortgage loans used for the purchase of residential real estate in the District of Columbia and Maryland. The verdict followed a trial in the U.S. District Court for the District of Columbia. The Honorable Reggie B. Walton scheduled sentencing for June 19, 2015. This completes a three-year investigation relating to this mortgage fraud scheme. A total of nine individuals have admitted their guilt through guilty pleas or were found guilty after trial. The government’s evidence at trial included testimony from conspirators who were involved in the scheme to defraud banks, mortgage lenders, and the Federal Housing Administration, FHA, (part of U.S. Department of Housing and Urban Development) of money by…

Mortgage Fraud Blog. Dean Rossi, 49, Warrington, Pennsylvania, was arrested in connection with an alleged mortgage fraud scheme for misappropriating funds from real estate closings intended for paying off mortgages. Rossi, a real estate investor who owned numerous low-income properties throughout the Philadelphia area, was charged by indictment, now unsealed, with conspiracy, mail fraud affecting a financial institution, and bank fraud. The indictment alleges that Rossi misappropriated in excess of $643,000 from real estate closings. After obtaining bank loans to purchase or refinance residential properties, Rossi allegedly teamed up with title/closing agents to divert a substantial portion of the loan proceeds. According to the indictment, Rossi received cash from the settlements that otherwise should have been used to pay off prior mortgages and tax liens on certain properties. To prevent the scheme from being detected, Rossi allegedly continued to cause payments to be made…

Or, at least, once Burger King and Tim Hortons decided to merge, did they choose to have a Canadian parent for tax reasons? A recent empirical study by Andrew Bird, Alexander Edwards and Terry Shevlin suggests that one tax factor—the existence of “locked out” offshore earnings—increases the likelihood that a non-U.S. acquirer will acquire a U.S. target. Bird, Edwards and Shevlin analyze thousands of merger transactions, without regard to whether the transactions might be labeled “inversions.” Their paper contributes to the considerable literature that tests the idea that accounting and tax disparities affect firm prices and transaction decisions. Most people in Georgia can likely recall when a suspected attempted robbery ended in the death of a young toddler. One of the two boys involved in the incident was only 15 at the time and was also the last to be charged. Although he initially faced felony charges, it appears that a careful articulated plea deal with the prosecution in addition to his full cooperation with the authorities has altered the outcome. The shooting occurred in 2013 and involved both the defendant as well as a 17-year-old teen. After having met earlier that day, the older of the pair suggested that they find someone to rob. However, the older teen later produced a gun and shot at a mother who was pushing a stroller. While the mother survived, her 13-month-old toddler was fatally wounded. According to those involved in the case, the young teen was little more than a witness to the shooting. The Austin Police Department has decided to make secret more police disciplinary cases by ordering training-only punishments instead of suspensions, which under law make a summary of the event a public record - the only window into police misconduct the public has in cities that operate under the state civil service code for police and firefighters (Ch. 143 of the Local Government Code).The problem is LGC 143.089(g), a secrecy provision added to state law decades after most cities (today, a few more than 70) adopted the civil service code in the the '40s and '50s.
