The U.S. Constitution provides Americans with many rights, including the right to be represented by a lawyer in most criminal proceedings. But you are probably more curious about whether the Constitution affords you the right to have a lawyer appointed to you, meaning that you don’t have to pay for the lawyer’s services. In 1963, the U.S. Supreme Court held that criminal defendants who cannot afford to hire their own lawyer and face the possibility of incarceration have the right to free legal representation. What that means is that you must prove to the court that you cannot afford a lawyer, and then a public defender will likely be appointed to your case if you face significant time in jail or prison. Three Ohio Innocence Project Clients Released Pending New Trial

According to a story published on Wednesday by City Beat, Ohio Innocence Project clients Eugene Johnson, Laurese Glover and Derrick Wheatt were released from prison late last month after serving nearly 20 years for a murder which new evidence shows they did not commit.   Johnson, Glover and Wheatt were convicted in 1996 of the shooting death of 19-year-old Clifton Hudson Jr. in East Cleveland. The case hinged on the testimony of Tamika Harris, who was 14 years old at the time of the trial. Harris testified that she saw a man jump out of a truck, shoot the victim, and jump back into the truck. She admitted she could not see his face, but during the trial she positively identified Johnson as the shooter. Wheatt and Johnson were sentenced to 18 years to life in prison; Glover was sentenced to 15 years to life. In 2004, Harris came forward to recant her testimony. Businessman Sent to Prison for $44M Loan Fraud Conspiracy

Mortgage Fraud Blog. Pedro “Pete” Benevides, 45, Astatula, Florida, was sentenced by Senior United States District Judge Gregory J. Presnell to nine years in federal prison for his role in obtaining 20 fraudulent commercial and residential loans and lines of credit from several federally insured financial institutions totaling approximately $44,059,565. In addition, Benevides was ordered to forfeit $44,059,565.00, including several bank accounts containing approximately $40 million in cash and two exotic sports cars: a 2008 Lamborghini Murcielago and a 2009 Audi R8.  He will also be ordered to pay full restitution to the financial institutions that were the victims of his offense. The amount will be determined at a later hearing.  Benevides pleaded guilty on July 14, 2014. Domestic Assault Results in Criminal Charges for Bay City Man

On Monday, April 13, Bay City police received a call from a woman claiming domestic assault. The woman was calling from a 7-Eleven store when police arrived at approximately 1:30 in the morning. The 19-year-old woman told police that she was attacked at a South End home by her boyfriend, 25-year-old Jeremiah J. Leffew. According to a news article at Mlive.com, Leffew intimidated the victim with a pair of scissors and a frying pan; he now faces several criminal charges, including domestic violence, assault by strangulation, assault with a dangerous weapon, and interfering with an electronics communication device. The alleged victim told police that an argument began after Leffew dumped a container of trash on the floor of the home. Leffew disputes the allegations, saying that the fracas began after his girlfriend struck him with an empty liquor bottle. Leffew claims that the victim is “crazy,” and that he did grab her wrists at one point during the argument to keep…

Real Estate Agent Pleads Guilty to Investment Scheme

Brenda Ashcraft, 45, Milford, Ohio, pleaded guilty in U.S. District Court to defrauding investors of at least $15 million between 2009 and 2013 in a fraudulent investment scheme to purchase and sell real estate through real estate investment trusts (REITs). According to court documents, Aschraft owned and operated French Manor Properties, which she told investors was acting as the REIT Trustee that would “secure residential and commercial real estate at wholesale pricing.” Investors believed that their investments were secured by real estate and Ashcraft promised them 40% annual returns on their investments. These representations were false. Instead, Ashcraft used new investor money to pay earlier investors and diverted investor funds to her own personal use and benefit, including a $50,000 investor payment that she used to pay for Cincinnati Reds season tickets. Jeffery Allen Gardner, 61, Hopkins, Minnesota, and Stuart Alan Voigt, 66, Apple Valley, Minnesota, have been indicted and charged with conspiring to defraud individuals and financial institutions, bank fraud and making a false statement in a loan application. Over the past several months, I have been working to implement the Women’s Independence, Safety and Empowerment curriculum, (originally developed at the Midtown Community Court) here in the Bronx. The groups cover themes of stereotypes and stigma attached to having a prostitution arrest, safety and harm reduction, psycho-education on trauma and trauma reactions, as well as feeling identification and coping skills.  Because the AP-8 population is comprised of women and trans women who may be lacking stability (for example, clients may not have consistent housing from week to week, and are often experiencing ongoing trauma and violence), adhering to a strict schedule can be understandably challenging. In order to help address this challenge, the AP-8 group schedule was changed to be more accommodating to the needs of our clients. Getting a lower sentence in a federal criminal case by using proposed amendments to the Federal Sentencing Guidelines

Readers know that we handle lots of federal criminal cases, in Georgia, Florida, Alabama, and throughout the country.  I just finished a sentencing this afternoon in which we got a lower sentence by pointing the Judge to some proposed changes to the Federal Sentencing Guidelines.  Along with some other factors, these proposed changes led the Judge to decide that the Guidelines were too high, and he reduced my client’s sentence.  I always set my sights pretty high, and had hoped that the Judge would reduce my client’s sentence even more than he did, but the fact that we got a lower sentence at all shows how there are many ways to get the Court to impose something below what the Guidelines recommend.
