Only Minor Changes In Vermont's Sex Offender Laws:  A high-risk sex offender was released from a Vermont after maxing out his sentence, despite his refusal to seek treatment while incarcerated, sparking public demand for stricter sex offender laws.  Alex Keefe and Lynne McCrea of VPR report that lawmakers are considering two weak reforms.  The first would be a clarification to an existing that that states sex offenders must report their plans and activities to the registry before their release from jail.  The second would improve the sex offender registry's accuracy.  Also, several additional requirements have been considered for sex offenders labeled as high-risk. New System Screens Out Registered Sex Offenders:  A high-tech system that produces instant background checks is being used at schools in Southern Indiana to protect students from sex offenders and other threats.  Stephan Johnson of WDRB reports that the Raptor System…

Judicial Shaming of Convicted Judge Nixed by Court of Appeal

As Elton John wrote: “Sorry seems to be the hardest word”, an adage that is certainly true for convicted Pennsylvania Supreme Court Justice Joan Orie Melvin, who was ordered to deliver a written apology to every judge in the State as part of her sentence for using state facilities and staff to run her judicial election campaign. The problem Ms. Melvin had with the order was that she was to write the apology on a photograph of herself in bracelets, also known as handcuffs. Former Judge Orie Melvin and her two sisters were upwardly mobile stars in the Republican political firmament in Pennsylvania. Joan was initially appointed to the bench and thereafter ran several successful re-election campaigns. Joan’s sister Janine Orie worked with her, and sister Jane Orie was a Republican Senator for the State of Pennsylvania. Unfortunately, both sisters were also charged and convicted of improper use of state services, facilities, and staff to advance…

DID THE HERNANDEZ DEFENSE BLOW IT?

Roy Black has a new take on the "how can you represent those people" question that is the bane of the criminal defense attorney  in social situations. Check his blog here. The final take on the Aaron Hernandez tragedy is that we find it hard to believe that a person who seemingly has it all- fame, money, a sports hero, would throw it all away and act like a common street thug.  And as the comments from the last post show, we also engage in shadenfreude , which as long time and careful readers of this blog know, means taking pleasure from the misfortune of others. The jurors gave interviews here  in which they said they were shocked that the defense admitted in closing argument that Hernandez was present at the murder scene. It's easy to be a Monday morning quarterback and criticize the defense for a gamble that didn't pay off. But if the prosecution was able through painstaking evidence to…

When The Thrill Is Gone

PrawfsBlawg is ten years old.  It was already going strong when SJ was born, led by a law professor named Dan Markel who was murdered last year.  Even though I disagreed with Dan about many things, I respected him, and wrote about Dan’s ideas many times here.  But Prawfs lived on, and now it’s ten. Most of you don’t read Prawfs.  It’s an academic blog, bogged down by the language, concerns and interests that are unique to the legal academy.  It’s not always thrilling, particularly for the non-lawyers, and it was often disturbing when the prawfs navel gazed in the weird vacuum of ivy towered self-indulgence.  It was especially frustrating when prawfs wrote about the value of their scholarship, or how the education of law students would die a brutal, painful death if law school wasn’t all about their law review articles and brilliant theory. In the early days of SJ, I sought to bridge the gap between academic…

Breaking The Calm Of The Hallways*

They may be loud and boisterous on the streets, but in the hallways of the courthouse, they speak mostly in hushed tones.  Even tough street kids know better than to get too loud, attract too much attention, in the one place where their bluster won’t pay.  Courthouse hallways tend to be unnaturally calm. When 22-year-old Anthony Jones was tossed out of a Philly courtroom for wearing a hat, he broke that calm. The incident started about 11 a.m. last Friday, when a court crier in Courtroom 706 ordered Jones to remove his hat and then booted him out when he became upset, Sen said. In the hallway, Jones yelled and cursed, and Sen hurried to defuse things, Hoy and Sen said. (Sen didn’t represent Jones, but her employer, the Defender Association of Philadelphia, did.) Paula Sen was a public defender, who happened to be there as Jones got loud and angry.  Richard Hoy was a old-time lawyer, sitting on a hallway bench, watching the drama…

IS DRUNK DRIVER RESPONSIBLE FOR KILLING DRUNK MAN LYING IN ROAD?

Steven Anderson was drunk when he passed out on a rural highway. He was wearing dark clothing and went to sleep on the dark road around 1:00 am. There were no street lights in the area, and he was lying where there is a bend in the road. Darryl Saunders was drunk when he came driving around that bend. When he finally saw Anderson lying in the road, Saunders swerved to avoid him, but it was too late. He ran over Anderson, and Anderson died. Saunders’ blood alcohol concentration was tested at .150. Is Saunders criminally responsible for killing Anderson? No, according to the judge who heard this case in Manitoba, Canada. The prosecutor argued Saunders could have avoided the collision if he were sober, so his intoxication was a significant cause of Anderson’s death. In addition, the prosecutor claimed, police testified it was not uncommon for intoxicated people to pass out on the street, so Saunders should have been on guard for drunks sleeping on the road. The judge…
