The plaintiff sustained serious and catastrophic injuries when he fell while transversing a trench at a construction site in the Bronx. As a result of plaintiff's fall into a trench at the job site he became impaled on a reinforcement bar (rebar) that was surgically removed several hours after his admission to the hospital. It is in this setting that the jury, after a trial and after hearing testimony from plaintiff's physicians and other experts (that was largely uncontroverted) regarding the devastating and traumatic nature of the injury he sustained, rendered a verdict in the sum of $86 million including $20 million for past pain and suffering and $55 million for future pain and…

Interesting to see a meme I've heard from several Texas conservatives this year repeated in the pages of the New York Times. See Ross Douthat's "Our Police Union Problem," in which he declared that there is "a strong argument that the rise of public sector unions represents a decadent phase in the history of the welfare state, a case study in the warping influence of self-dealing and interest-group politics." However, he lamented, "this argument also applies to a unionized public work force that conservatives are often loath to criticize: the police." Ex-Professional Surfer Charged With Real Estate Fraud

The former co-owner of clothing brand RVCA and professional surfer, Conan Hayes was charged in Orange County Superior Court with Real Estate fraud.  According to authorities, Hayes lied to Bank of America causing them to lose $586,245 on the short sale of a Costa Mesa home. Hayes, who sold his interest in RVCA for over $7 million is alleged to have told bank officials that he had lost his job and got the bank to agree to short sell the Costa Mesa home.  The bank was unaware of Hayes’ assets from the sale of RVCA which may have been able to prevent the need for the bank to short sell the home. Hayes, 40 was charged with one felony count of grand theft with sentencing enhancements of property losses over $200,000.  If he is convicted, Hayes faces up to five years in prison.

When someone’s convicted of a DUI in Los Angeles for the third or fourth time, the penalties can be steep and include up to 16 months in state prison. If a death resulted from that DUI, the punishment for the offender can rise to five years in jail. But California’s DUI punishments are very light compared to those imposed by a Pennsylvania judge on a man convicted of DUI in his courtroom. Thomas Gallagher Jr., age 29, will be spending 20-50 years in prison after killing 18-year old Meredith Demko in an accident last July. The crash also injured one of the two passengers in Demo’s car, although the injuries were not life-threatening. Gallagher was speeding and weaving through traffic on the afternoon of July 8th when he rammed his Volkswagen Jetta into Demko’s Toyota Prius. At the time of the accident, Gallagher was driving on a suspended license due to a previous DUI conviction. His blood alcohol content was measured at .26—nearly triple the legal…
