It never ceases to amaze me the lengths some lawyers will go to gain any kind of advantage in a trial, no matter what the ethical implications may be.  Take for instance the actions of Stephen Diaco, his partner Robert D. Adams and one of their associates Adam Fithaut, all on trial (being live streamed on ABC Action Newsin Tampa) together before a bar referee as this is being written.Diaco and Adams were representing the defendant in the trial of  the infamous "Shock Jock Case" (one shock jock suing the other for defamation) in Tampa.  The lawyer representing the plaintiff was Phil Campbell, who's office was in the same building as Diaco and Adams, PA, and was well known as one who imbibes frequently, if not daily.  Mr. Campbell, actually lived directly across the street from his favorite watering hole.Diaco and Adams were not doing particularly well in the trial.  It was conceded at the time that Campbell was kicking them…

New Report Confirms Mentally Ill Prison Inmates Receive Inadequate Services and are Abused

Human Rights Watch (“HRW”) recently issued a new Report finding that mentally ill inmates in US prisons are frequently mistreated, neglected and abused.  The Report also contains a lot of information concerning the role of prisons in the mental health system in this country. First, according to the HRW Report, prisons have become the primary mental health care facilities in the United States.  One in every six inmates is mentally ill.  In fact, there are three times as many mentally ill prison inmates as there are patients in mental health care facilities.  The rate of mental illness in our prison population is three times higher than in our general population.  Figures gathered by the US Justice Department buttress these findings.  According to a DOJ study, 75% of women and 50% of men in State prisons, and 75% of women and 63% of men in local jails, will have a mental health problem requiring services in any given year. Michael Barnett, Robert Lees and Kevin Dicello have been indicted and charged with conspiracy, fraud, and false statement charges in connection with the development of Vineyard Commons, a luxury residential complex in Ulster County, New York. According to the allegations made in the Superseding Indictment: Barnett, who was the developer of Vineyard Commons, sought kickbacks and investments from subcontractors and vendors on the project and made false statements to the project’s lender so that he could draw down on the project’s line of credit.  Lees and Dicello were a division president and vice president of operations, respectively, for a subcontractor and vendor that provided rough carpentry and lumber supplies on the project (the “Lumber Company”).  The indictment charges that Lees and Dicello agreed to have their employer pay Barnett a kickback of approximately $865,000 in exchange for the Vineyard Commons contract, as…

Remarkably, HB 65 by McClendon this evening passed by a 92-37 vote with no floor debate, after needle exchange had been one of the more contentious topics debated on the House floor in 2013. A majority of Republicans supported the bill (44-37) and all Democrats. Congratulations to Chairwoman McClendon and her staff. This was an impressive victory after the filed version of the bill faced a rocky start in its committee hearing. From there to a 9-0 committee vote to a 2.5-1 margin on the House floor has been quite a fascinating trek. From top to bottom, the Hobbs District Attorney's Office is much more talented than the Carlsbad District Attorney's Office.  However, why is it then that the Hobbs office is so inefficient and the Carlsbad Office leans in the other direction, if ever so slightly.In my opinion, the magistrate courts that both offices interact with are the difference.  Because the magistrate courts in both jurisdictions are vastly different. Vastly.In saying this I mean no disrespect to Judge Henry, who is fair to everybody and brings the hammer down on anybody who is out of line. In an op-ed published today in the Daily News, Innocence Project exoneree Jeff Deskovic writes about Adam Sirois, the man drawing national media attention for being the sole juror to vote against convicting Pedro Hernandez, the man on trial for the 1979 murder of Etan Patz. Deskovic writes that Sirois should be applauded for standing his ground and not convicting a man who he wasn’t convinced was guilty. Deskovic draws parallels between the ongoing Etan Patz case and his own wrongful conviction case in 1990.  Deskovic was convicted based on a false confession of the 1989 rape and murder of one of his high school classmates. In 2006, Deskovic was finally exonerated with the help of the Innocence Project, which used advanced DNA testing to prove his innocence. Triple Murderer Executed In Texas:  Derrick Charles, convicted of murdering his 15-year-old girlfriend, her mother and her grandfather 13 years ago, became the seventh inmate executed in Texas this year after being put to death by lethal injection on Tuesday night.  The AP reports that Charles' attorneys argued that he was mentally incompetent and sought to overturn his death sentence, but the claim was rejected by the U.S. Supreme Court.  The Texas Department of Criminal Justice has two more executions scheduled next month, but only has enough pentobarbital for one of them. A new bill introduced in Pennsylvania’s legislature aims at changing the current laws for motorcyclists and pedalcyclists in regard to red lights. Introduced by Representative Stephen Bloom (R- Cumberland), the motorcycle law has yet to be voted on in either house and is still sitting in committee.House Bill 950 The name of House Bill (HB) 950 is, “An Act amending Title 75 (Vehicles) of Pennsylvania’s Consolidated Statutes, in general provisions relating to the operation of vehicles, further providing for traffic control signals.” While the act’s name might by a mouthful to handle, the purpose of the bill is relatively simple: the act would allow motorcycles and bicyclists to pass through red lights when safe.
