A company in Israel, Odortec, makes a substance that is non-toxic and, the developers maintain, even drinkable.  It’s only got one drawback: IT SMELLS like raw sewage mixed with putrefying cow’s carcass… And, apparently, it doesn’t wash out of clothing easily.  On the bright side, the substance, called Skunk, is remarkably effective as a riot control measure. Skunk, as it is appositely called, has been used by Israeli soldiers since 2008 to disperse Palestinian protesters. Now it has attracted the interest of law-enforcement agencies in America which, after riots in Ferguson and Baltimore, crave better ways to scatter rioters without killing or injuring them. In Israel, where it’s been in use since 2008, the main complaint against it is that it’s been used against Palestinians. The recent economic recession has affected Americans all over the country, causing hundreds of thousands of our friends and neighbors to take on multiple jobs or take out loans in order to make ends meet.  Unfortunately, Georgia is no exception and many Georgian residents have found that they simply cannot meet their monthly debt obligations.  Because of these financial issues, several individuals have contacted our office to discuss the prospect of filing for bankruptcy and how doing so may help them alleviate their families’ debts and get back on sound financial footing. It was one of those videos that didn’t seem to make much sense, the shooting and killing of Dillon Taylor by Salt Lake City Police Officer Bron Cruz.  Shaun King at the Daily Kos gave a moment by moment run down of what happened, but it clarified nothing. At 0:17, Officer Bron Cruz gets out of his vehicle. You will notice people confused by his presence. At 0:22, Officer Cruz walks past two men who were friends with Dillon Taylor. At 0:24, Officer Cruz walks behind Taylor, who has on a white T-shirt and is listening to music. At 0:33, we see the officer has his gun drawn and is yelling at Taylor, who’s holding his sagging pants up and does not appear to hear Cruz. At 0:36, the officer shoots Taylor. It would be fatal. Starting at 0:41, you will notice the headphone cord coming out of Taylor’s pocket. At 0:48, you will see that the headphones were clearly going up to Taylor’s ears. State and local police say they’ll be out in full force on a well-travelled Clay County highway after a string of serious accidents in recent weeks.  Patrol officers and others are out along the highway, checking speeds and watching for drivers who run red lights in the area, according to a report on News4Jax.com. While nothing has been reported yet in the local news media, expect a news release in the upcoming weeks about the number of violations and tickets issued in the area due to the increased patrols. Police can’t be everywhere and by no means can they prevent every traffic accident that may occur. But the presence of police officers will undoubtedly make drivers slow down. How many times have you seen a string of brake lights on the highway, only to see a highway patrol officer in the median a few hundred yards up? It was September last year when a judge in North Carolina declared Henry Lee McCollum and Leon Brown innocent of the horrific rape and murder of 11-year-old Sabrina Buie.  I wrote about it at the time, quoting Scalia explaining why Lee McCollum ought to be killed (without actually hearing his appeal).  He wrote that an 11-year-old girl [was] raped by four men and then killed by stuffing her panties down her throat.And I noted that he barely touched the surface.  I quoted the North Carolina Supreme Court.An autopsy was performed upon the body of Sabrina Buie. Linear abrasions on her back and buttocks revealed a pattern indicating that the body had been dragged over a rough surface. There was a tear or laceration deep within the victim's vagina and a tear or laceration in her anal canal. On May 27, the Office of Inspector General of the Department of Health and Human Services announced (no permalink available) that a Palm Beach Gardens, Florida, businesswoman had agreed to be excluded following the settlement of civil charges against her companies. According to the OIG-HHS’s press release: Tracy Nemerofsky – a Palm Beach Gardens, Florida private business owner – agreed to be excluded from participation in all Federal health care programs for a period of five years. OIG conducted an investigation of Nemerofsky for knowingly submitting or causing to be submitted to Medicare false claims in violation of the Anti-Kickback Statute. Based upon that investigation, OIG alleged that Nemerofsky violated the Anti-Kickback Statute through her company A Plus Home Healthcare, Inc. (A Plus), when she directed and managed A Plus’ payments to eight different physicians’ spouses, in exchange for the physicians’ Medicare referrals. OIG alleged…

Many years ago, our mother had to go to the hospital, and it took the doctors a long time to figure out what was wrong with her. During that time, she was running a very high fever and was delirious. She was also being difficult, which was uncharacteristic for her. They took her children out in the hall separately to ask us questions, and we realized they suspected that she was also suffering from alcohol withdrawal. They interviewed Ray and me together. No matter what the questions were, they kept coming back to her drinking habits. Yes, Ray said, she did occasionally have a glass of wine with dinner. He put his thumb an inch from his pointer finger to show them just how small the wine glass was. Of course their eyes lit up. They were convinced they had the found their answer. Ray and I could only laugh. It was funny for us to think that this daughter of a tee-totaling Presbyterian minister had a drinking problem. The New Mexico Court of Appeals just issued State v. Sanchez, which analyzes whether exigent circumstances existed for a seizure of a vehicle after the officer saw, in plain view, a bag of prescription pills on the floorboard of the vehicle.The officer initially pulled the defendant's car over for a routine traffic stop.The trial court denied the defendant's motion to suppress.  The Court of Appeals reversed the trial court and remanded the case back to the trial court.Holdings Regarding Appellate Review of Issues Presented to the Trail Court[An appellate court's] policy of judicial restraint, as well as the rule requiring preservation, mandates that an appellate court should decide only preserved issues and should decide those issues on the narrowest grounds possible. Cleveland is the Latest City to Enter Into Police-Related Consent Decree with USDOJ

Cleveland, Ohio has become the latest city to enter into a consent decree with the United States Justice Department (“DOJ”) concerning the conduct of its police force.  Other cities that have previously entered into similar agreements include New Orleans, Seattle and Detroit. The consent decree stemmed from a DOJ investigation that found Cleveland police officers had routinely used excessive force (e.g., tasers, pepper spray and guns) against mentally ill, unarmed and already-handcuffed suspects.  DOJ investigators reviewed approximately 600 use-of-force incidents that occurred between 2010 and 2013 and concluded that officers almost routinely used guns in a “careless and dangerous manner”.  Other problems with the police department included its apparent inability and/or unwillingness to investigate complaints against itself.
