Vincent Bugliosi: The Legacy

Vince Bugliosi, who first achieved fame as the Manson Family prosecutor and then as a first rate author, died June 6, 2015. His true legacy is the books he left behind. Too obsessive and detailed for the casual reader but perfect for us. The Lee Bailey, Gerry Spence and Bugliosi trial-centric books are major sources for learning the business of trying cases. Bugliosi started as an Deputy DA in Los Angeles and was assigned to prosecute Charles Manson and his gang. The investigation and trial was the highlight of his career and became the subject of his most famous book. I admired Bugliosi because of his obsessive personality; good for trial work, not so good for relationships. Thus the high lawyer divorce rate. He told me he spent 100 hours preparing every final argument. If another lawyer claimed that I would have doubts; but with Vince I believe it. His obsessive, almost manic, attention to detail comes across in all his writings. The best example is the Kennedy assassination…

INSANITY DEFENSE FAILS FOR SOUTH BOSTON CONVICTED MURDERER

Jurors in Suffolk Superior Court found Edwin Alemany guilty of first-degree murder and 15 other counts, including premeditated murder, for the killing of Amy Lord. Alemany was also found guilty of attacking two other women before and after killing Lord. In July of 2013, Alemany kidnapped Lord from outside her South Boston apartment and forced her to withdraw money from several ATM machines. Prosecutors said he then raped her and stabbed her more than 75 times. He then dumped her naked body in Hyde Park and set her car on fire. At trial, Alemany’s attorneys admitted their client killed Lord, but tried to prove he was not guilty by reason of insanity. A defense of lack of criminal responsibility, also known as the “insanity defense” is often used as last resort for criminal defendants. 15-year-old boy charged as adult in St. Johns County Murder Case

Prosecutors announced this month that they have charged a 15-year-old boy with first-degree murder in the killing of a store clerk.  The boy is accused of demanding money from a convenience store clerk and then shooting him when the clerk wasn’t moving fast enough, according to a report in the Florida Times-Union. After the shooting, the boy got into a stolen car driven by a 16-year-old boy who led police on a high-speed chase into another county, the newspaper reported. The 15-year-old boy is also charged with armed robbery with a firearm and aggravated assault with a firearm, the newspaper reported. All three are serious felony charges, but the main charge in this case is first-degree murder. In a typical St. Johns County Murder Case, there are two possible sentences if someone pleads guilty to or is convicted of first-degree murder: life in prison without the possibility of parole or the death penalty. RCRA Violations – Low Hanging Fruit??

One of the common RCRA criminal violations is the poor management practices surrounding the handling of hazardous waste containers.  And one of the easiest to overlook is the storing of hazardous waste containers for over-ninety (90) days because the accumulation start date is absent or non-existent.  This is a proverbial low hanging fruit that often times supplement other criminal charges.           The over-ninety day storage typically starts with accumulation start date issues.  These can come about simply because the facility does not identify the accumulation start date on the label on the hazardous waste container with the month, day, and year or the facility changes the date after adding additional hazardous waste to that container (start date is when the first waste enters the container).  These two “oversights” alone probably lead to the most common problems that result in the over-ninety (90)…

Starting in September of 2012, New York State and the NYS Department of Motor Vehicles re-doubled their efforts to keep recidivist drunk and drugged drivers off of the road. These new laws and regulations are the toughest in the nation. Under the new regulatory scheme licenses and / or driving privileges of motorists who have racked up three or more DWI convictions in the past 25 years are suspended for at least 5 years. Those who hit 5 or more convictions in their lifetime are permanently ineligible for driving privileges for life. This causes a huge problem, because if your driver’s license or privileges are suspended, revoked, or otherwise encumbered in any way in one state, no other state will issue you a driver’s license. Since 2012 the total number of licenses lifted is 7,521. New York State has also permanently revoked license or privileges for 3,942 drivers who had five or more alcohol- or drug-related convictions in their lifetime.…
