Michigan’s District Court Judge Ken Post is at it again. You may remember him as the judge who found junior lawyer, Scott Millard, in contempt for protecting his client’s right not to incriminate himself. Millard became a folk-hero of sorts for standing up to Judge Post, even as the judge directed the court sheriff to remove him from the court and escort him to the cells. Judge Post was later disciplined and suspended from the bench for thirty days. Judge Post’s latest stunt occurred when Philip Mallery, age 23, failed to appear for his scheduled court hearing on drug and traffic charges, although his lawyer was in attendance. Judge Post telephoned the young man and left the following message: “We’re waiting for you because you’re supposed to be here today, you missed a drug test yesterday, and it would appear as though you’re not coming today, so a bench warrant is being issued for your arrest. SEC Seeks Stay Pending Appeal of Preliminary Injunction Halting Administrative Proceeding in Hill v. SEC

The SEC has asked Judge Leigh Martin May for a stay pending appeal of the preliminary injunction she entered on June 8 that halted the SEC’s administrative enforcement action against Charles Hill. Judge May granted injunctive relief after finding that Hill was likely to succeed on his claim that the ALJ presiding over his case “is an inferior officer who was not appointed in accordance with Article II of the Constitution.” The SEC argues that a stay should be granted because it is likely to prevail on its appeal to the Eleventh Circuit due to three legal errors by the court. First, the SEC claims that Judge May wrongly concluded that she had jurisdiction to enjoin the administrative proceeding. Instead, the SEC says that the Exchange Act “requires that challenges to such proceedings first be heard by the Commission and then in an appropriate federal court of appeals.

One local attorney now probably wishes he thought twice before he agreed to befriend a local drug kingpin. On Monday United States District Court Judge James V. Selna sentenced Richard Brizendine to spend 3 months in prison and serve 2 years probation for laundering money. This was the result of a plea deal that Brizendine agreed to, which required him to admit that he was laundering money for John Melvin Walker, aka “Pops,” a convicted drug lord. Walker was convicted in 2013 for drug trafficking and tax evasion in connection to running no less than 9 marijuana storefronts. He was also ordered to pay restitution in the amounts of $2.4 million to the Internal Revenue Service, and $1.8 million to the California State Board of Equalization. Semi Truck Crash in Madison County

Earlier this week, there was a tractor-trailer crash in Madison County. According to WJTV News Channel 12, the incident happened on Interstate 55 at about 4:00 a.m. on Tuesday morning. Apparently, a car stopped suddenly in front of the big rig. The driver of the commercial truck tried to avoid hitting the car, and the big rig overturned in the roadway. Thankfully, the driver was not injured, but the industrial parts being shipped by the large truck were spilled across the Interstate. Overturned Big Rig on I-55 The semi truck was reportedly going from Memphis to Jackson at the time of the crash. The wreck had traffic backed up on the interstate near the Gluckstadt Road exit. Portions of I-55 had to be closed as first responders and crews worked the scene. The truck had to be set up right before it could be towed from the scene.
