Should I Take a Plea Bargain for a Sex Crime?

$

A defendant who is charged with a sex crime in Texas may be facing some serious legal penalties. These penalties can include jail time, fines and sex offender registration. One way to avoid the full extent of these possible penalties is to accept a plea bargain from the prosecution. A plea bargain is an agreement between the defense and the prosecution. In many cases, the prosecution will be the district attorney. In a plea bargain, the district attorney may offer a deal to the defendant after charges have been filed and before a trial takes place. In most cases, the plea bargain will require the defendant to enter a guilty plea in court. However, the defendant may only have to plead guilty to a lesser charge than the crime for which he or she was originally charged. Alternatively, if the defendant is charged on multiple counts, he or she may only have to plead guilty to one or a few of the total charges. Benefits of Plea Bargains There are several advantages for a defendant…

What steps should you take if your ex-husband or ex-wife stops paying child support in Utah?  What forms and documents do you need to prepare?  Is it legal to withhold custody until your former spouse starts making payments again?  Child support lawyer Andrew Stewart explains the do’s and don’ts of enforcing court orders in Utah. Can I Withhold Child Custody From My Ex-Husband or Ex-Wife? Many divorced parents think they can force a former spouse to resume making child support payments by withholding visitation with their children.  It is very important that you do not go down this path, no matter how angry or frustrated you might feel. Put simply, it is unlawful to withhold visitation or parent time as retaliation for nonpayment of child support (or for any other reason).  Remember, child custody is a court-ordered arrangement, so if you deviate from the terms of your custody plan, you’re essentially ignoring court orders. You might…

In a bizarre twist of events, a man named Richard Perillo was apprehended (arrested) by U.S. Marshalls in San Diego recently for a botched attempted-murder conspiracy.  Mr. Perillo and his mother, Renee Perillo, have been wanted in Hamilton County, Indiana, but they failed to appear at their initial hearing on June 5 in Hamilton County Court while out on a $20,000 bond. The mother-son duo have been accused of plotting to kill attorney in Noblesville, Indiana named Rebecca Eimerman.  Ms. Eimerman was pursuing an unpaid divorce settlement from Ms. Perillo’s boyfriend, Arnaldo Trabucco (a doctor), on behalf of his ex-wife.  They were first arrested when the two were found in Ms. Eimerman’s car.  They were found with a Glock handgun, which belonged to Dr. Trabucco, and a syringe filled with a lethal dose of anesthesia.  Police also found a car, which was insured by Dr. Trabucco and filled with latex gloves, a machete, hammer, duct tape, and a…

Bolton was convicted of sexually assaulting and kidnapping the underage victim, and was sentenced on June 30 to 14 years in prison. He was also sentenced to 10 years on the kidnapping charges. Can you fight that kind of a search? Well, the answer is yes, but how difficult is it? Contact me today about your possession of marijuana case. Video Transcription Hello. My name is Andrew Flusche. I’m your Virginia defense lawyer. Today we’re going to talk about how do you fight a search based on the odor of marijuana. One of the main questions that comes up in a lot of marijuana cases that I defend is that the officer claims they smell the odor of marijuana, and that’s what gives them the right to search. Can you fight that kind of a search? Well, the answer is yes, but it’s extremely difficult, unfortunately. The problem is that there’s no way for the officer to really prove that they smelled marijuana other than their sworn testimony in court and…

The storm of racially-charged controversy surrounding the Charleston Massacre at the Emanuel AME Church in South Carolina last month continues to steal news headlines and remain at the center of heated debate. Addressing the topic of race and racism in the aftermath of this heinous crime is both foreseeable and reasonable, due to the fact that the shooter, Dylann Roof, is white and the nine victims he gunned down were black.  But during tense times when many Americans perceive the country as teetering on the brink of a race war, the liberal agenda injected into the discussion regarding the Charleston Massacre is not so much of a discussion, but rather, pure drivel that only serves to drive a deeper wedge between Americans of different races and promote the sentiment that we are living in a racist America.  Heather MacDonald fires back in this National Review piece titled "The Shameful Liberal Exploitation of the Charleston Massacre" to - as she always does -…

“An insurer's duty to defend is broader than its duty to indemnify, such that an insurer may be obligated to defend its insured even if, at the conclusion of an underlying action, it is found to have no obligation to indemnify its insured”. “An insurer must defend its insured whenever the allegations of a complaint in an underlying action ‘suggest a reasonable possibility of coverage’. The duty to defend an insured is not triggered, however, “when the only possible interpretation of the allegations against the insured is that the factual predicate for the claim falls wholly within a policy exclusion”. “An exclusion from coverage ‘must be specific and clear in order to be enforced’, and an ambiguity in an exclusionary clause must be construed most strongly against the insurer”. “However, the plain meaning of a policy's language may not be disregarded to find an ambiguity where none exists”. …
