Our Palm Beach and Broward County traffic ticket defense lawyers represent individuals cited for a wide range of traffic violations. In representing our clients, we know how important it is to analyze with intense scrutiny the citations issued to the individuals. As one woman recently learned, in a case that is sure to make your elementary school grammar teacher smile, a traffic citation/ticket can be tossed out if it contains a grammatical mistake which obscures or changes the meaning of the rule allegedly being broken.

Children 15, 10, and 9 Sent to Juvie for Contempt of Court in Access Case

It’s been a long time coming, but finally some family court judges are starting to understand the insidious nature of mothers and fathers who brainwash their children in an effort to prevent a normal parent/child relationship with their estranged spouse. It is a twisted, selfish parent who would warp a child’s mind only because of their hatred of their former spouse or partner, and it happens much more often that most people realize. A stark example of the extreme edge of parental alienation was on display in a courtroom in Michigan last month. Judge Lisa Gorcyca of Oakland County, Michigan, presided over yet another hearing in the five-year high conflict custody/access case involving the children of Maya and Omer Tsimhonages, named Roee, Liam, and Natalie, ages 9, 10, and 15. The Tsimhonages’ marriage broke down in 2008 when Mr. Tsimhonages sought to accept a transfer from his employer, General Motors, to work in Israel where the parties were born and…

2015.66: The Unlawful Sweetcakes Order

You’ve probably heard about the bakers in Oregon penalized $135k for refusing to bake a wedding cake for a lesbian couple. You probably haven’t read the order. I have so that you won’t have to. (It’s long—3,000-plus words—so tl;dr: The facts are fascinating, but if you must, jump over the facts to the conclusion.) You may have heard that the bakers were also ordered not to talk about the case (true) or that they were fined for doxxing the couple (false).1 The Kleins violated Oregon Revised Statute 659A.406; this is pretty clear: acting “on behalf of a place of public accommodation” they “denied full and equal accomodations” because of the Bowman-Cryers’ sexual orientation when they refused to bake a wedding cake for them. The Kleins do not appear to have disputed that they (actually, he, but she was held jointly and severally liable) violated 403; the issue is whether their right to exercise…

The Interstate Driver License Compact – the mechanism by which your New York State moving violation is recorded to your home state’s driving record

$

The Interstate Driver License Compact is a compact used to exchange information concerning license suspensions and traffic violations of non-residents and forward them to the home state where the driver is licensed. The theory isone driver, one license, one record. “State” includes the District of Columbia, Puerto Rico, a US possession or territory, or a providence of Canada. The only states that are not part of the compact are Georgia, Wisconsin, Michigan, and Tennessee. With limited exception the home state can, but is not compelled to, administratively treat the offense as if it had been committed in the state of licensing. This includes, but is not limited to, point assessments, license suspensions, and license restrictions. This reporting exchange is also the mechanism by which an insurer obtains out of state convictions of its insured to include them as part of the insurance company’s demerit system utilized to increase insurance premiums. Unlike the…

Truck accidents kill hundreds of people every year in Pennsylvania and New Jersey. According to Department of Transportation data, in 2012, 143 people died in Pennsylvania alone from truck crashes. But an innovation in traffic safety technology, engineered by Samsung, may help to decrease truck accidents. Termed a ‘Safety Truck,’ a more apt name may be a ‘See-Through’ truck, read on to learn how this development could affect your safety as you navigate I-95 and other trucking routes. The ‘See-Through’ TruckOf course, the truck isn’t see-through. However, to drivers who are driving behind a large truck, see-through is certainly what it appears to be. The technology is very simple. Samsung connected a wireless camera to the front of the 18-wheeler. Then, a live stream from the camera is displayed on four screens attached to the rear of the semi tractor-trailer.As such, a driver who’s driving directly behind a semi can see what the…

CA County Struggles with Increased Service Demand from AB 109:  Spreading thin from California's prison realignment program, known as AB 109, millions of dollars in upgrades and more staff are needed in San Bernardino County jails to address the issues the measure has caused.  Joe Nelson of the Sun reports that new sergeants have been assigned to the county's busiest facility, and $3 million has been allocated for the FY 2015-2016 budget for staffing mental health workers alone.  Prison Law Office director Donald Spector blames realignment, noting "AB 109 exacerbated pre-existing conditions at some jails." Girl Kidnapped and Assaulted by Illegal Immigrant:  A 13-year-old girl reported missing last Tuesday in Florida was found inside a Michigan home with a 23-year-old illegal immigrant from Mexico.  WNDU reports that Aurelio Hernandez-Gomez allegedly sexually assaulted the young girl, was arrested for criminal sexual conduct and…

DUIs Spark Arrests Over Holiday

Police officers patrolling Los Angeles County highways found little to celebrate over the Fourth of July holiday weekend. From Friday, July 3rd at 6 p.m. through midnight July 6th, they made 229 arrests for DUI in Los Angeles County and dealt with the aftermath of accidents that killed two people. During that same time period, the California Highway Patrol reported that its officers made 930 DUI arrests throughout the state, while twenty-six people were killed in vehicle collisions. One deadly accident not included in this total occurred in the early morning hours of July 3rd in Lompoc. TV Station KSBY reported that 29-year-old Manuel Santos let his Toyota Corolla drift off the road, where it hit a culvert, a boulder and then a power pole. But that didn’t stop the car. It spun out of control and went back onto the highway where a Toyota Avalon smashed into it. The two people in that car went to the hospitals for non-life-threatening injuries. The crash killed 22-year-old…

St Louis Criminal Defense: How Hard Is It To Take Care Of A Misdemeanor?

$

MOST ST LOUIS MISDEMEANORS CAN BE HANDLED FOR ONLY $675 It depends on a number of factors. For instance: Is it your first offense? Were there multiple citations issued by the police officer? Where were you when the crime was allegedly committed? Several factors play into whether or not the misdemeanor charge can be taken care of. But let’s assume that this is your first offense. And let’s further assume that the charge is for theft / stealing in St. Louis (in which the alleged amount stolen has a value of less than $500). This is described as a Class A Misdemeanor (which can come with up to one (1) year of jail time, and a $1,000 fine). If you do nothing with this charge (for instance, if you do not hire an attorney, or even show up on the court date, then a bench warrant will be issued for your arrest, and that’s not something you want to happen (but if it does, we can take care of that as well). Assuming there are no priors, the next thing that an St. Louis…

Two Strikes and He’s Out

A good rule of thumb: if cops pick you up for a DUI in Los Angeles, don’t hit the road again before the intoxicating substance has left your bloodstream. If a West Virginia man had followed that advice, a teenager in that state might have avoided some unwelcome time at the hospital. According to TV station WOWK in Charleston, police got a summons on July 6th to the vicinity of the Smiley Motel. A woman there told them that Randy Bailies was driving on Route 60 under the influence of alcohol. (It’s not clear whether she was Bailies wife or his ex-wife.) The officers tracked Bailies down, pulled him over and found his blood alcohol content was .268, more than three times the legal limit. They booked him for DUI and released him—into the custody of a sober driver—after he posted a $600 bond. That incident occurred around 9:30 a.m. Around 12 hours later, Bailies was driving along Route 62 near Poca City when he hit a teenager walking along the side of the…

Is the NC Court of Appeals Lightening Up on Indictment Issues?

Indictment issues are the bane of the prosecutor’s existence. The rules about how an offense must be alleged in the indictment are highly technical. And because the rules are neither intuitive nor entirely consistent across offenses, they are hard to keep straight. Not surprisingly indictment issues account for a lot of black ink in the […]

When Can Oral Communications Be Secretly Recorded in Florida?

$

With cell phones that have the capability to record audio and video, people record other people's communications all of the time. However, that may not be legal in Florida. There is a statute that addresses this issue, but its interpretation is not clear. The Florida statute basically says it is illegal to record another person's conversation without that other person's knowledge and consent. This means you cannot call someone on the phone and record the conversation without telling the other person you are recording the conversation and getting his/her agreement. There are exceptions to the rule, and it is not exactly clear how the exceptions apply. Of course, as indicated, knowledge and consent of the other party makes recording legal. Also, there is a legal exception for law enforcement officers to intercept an oral communication when the officer is a party to the conversation and for law enforcement to record a conversation involving other people if…

It’s Such a Good Feeling

Not too long ago I transcribed for this blog a piece George Orwell wrote for Tribune, a British newspaper to which he was a regular contributor.  Orwell had his own column in the paper which he called As I Please and the piece at issue was one that Tribune thought best captured Orwell’s character and outlook, so much so that it re-printed the piece as its official obituary for Orwell following his death, one that came all too early. At the end of this piece, Orwell quoted the following passage from The Thoughts of the Emperor Marcus Aurelius: In the morning when thou risest unwillingly, let this thought be present — I am rising to the work of a human being.  Why then am I dissatisfied if I am going to do the things for which I exist and for which I was brought into the world?  Or have I been made for this, to lie in the bed-clothes and keep myself warm?  — But this is more pleasant — Dost thou exist then to take they pleasure, and not…
