There is much debate about whether parents and guardians should be charged with child endangerment for leaving a baby in a hot car and criminally negligent homicide if the child dies. Some cases are easy to note the parent willfully or negligently putting their child in danger. Other cases are more difficult to decide if […] The post Criminally Negligent Homicide for Leaving Baby in a Hot Car appeared first on Salt Lake Criminal Defense.

On Sunday, July 20, Seattle Sounders Football Club midfielder Marco Pappa was charged with driving under the influence by Seattle police. He was also charged with speeding at the time of his arrest, according to a report from Q13 FOX. Beyond his legal troubles, Pappa will now have to submit Major League Soccer's processing of players who have exhibited substance abuse. According to his team, Pappa will be assessed by their Major League Soccer's Substance Abuse and Behavioral Health (SABH) Program. Until that time, Pappa will be sidelined from any MLS play. Only once he has completed his assessment with SABH doctors—and the MLS conducts its own investigation—will Pappa be allowed back on the field. The Sounders FC General Manager and President of Soccer Garth Lagerway spoke to the press about MLS policy and Pappa's charges. "We are gathering information on this matter and have been in contact with the league office, the MLS Players Union, local…

There is a myriad of publications and articles dedicated to the improvement of legal writing. Unfortunately, in many of these materials, you need an English degree to understand anything past the first paragraph. There is, however, a simple way to dramatically improve any style of legal writing that has nothing to do with dangling participles or misuse of pronouns, etc.   “Cutting” down your writing is the key to making it better. Cutting does not require any particular knowledge of grammar or writing style.  This training update covers three basic steps that every judge and attorney should learn to follow. No, I haven't disappeared.I've been away.  There were the days at a conference on sex offender laws.  There were the days at a conference on the death penalty.  There were a couple of days of vacation, hanging out with old friends in Texas and Toledo. And as always when I'm away, there were the days catching up on the work that didn't get done while I was at conferences and R & R.  I've always said this was a hobby, which means everything else comes first. And then there's this.  Over at MimesisLaw Scott Greenfield is gathering a few lawyers to write posts about criminal, er, "justice."  The collective is called Fault Lines, which isn't particularly catchy, but all the best suggestions were ignored (and Volokh Conspiracy was taken).  The idea, Scott explained at the beginning of June when the thing launched, ispeople writing from varying perspectives, challenging bias and each other. Elder Abuse in Orange County, CA

I receive lots of inquiries about elder abuse from people who have read my previous blogs and visited my website. Most of the contacts are from folks who believe that their elderly relatives have been either physically or financially abused by strangers or relatives. Since I don't practice any kind of law other than criminal defense I'm not able to help. If someone is accused of abusing an elder than I have the experience to assist in his or her defense. So, in an effort to assist those not accused of elder abuse I would advise the following to prevent being accused and to prevent the abuse in the first place. Financial abuse is usually associated with the alleged misuse of monies and property owned by the elderly. If you are in a caretaker position it is vitally important to keep a careful accounting of all monies spent out of the elder's accounts or from cash kept by the elder. With a clear and concise accounting of any money spent on behalf of the…

Two Teen Relatives Held in Fatal Stabbing Deaths of Family:  A silent 911 call led police to a suburban Tulsa home, where the bodies of five people were discovered with fatal stab wounds, and apprehended two teenage male relatives of the victims who attempted to flee in nearby woods.  The AP reports that the deceased include adults and juveniles, though a girl survived but is in critical condition with stab wounds, and another child was left unharmed.  According to neighbors in the upper-middle class neighborhood of Broken Arrow, where violent crime is rare, the children in the family were home-schooled and "kept on a tight leash."  Broken Arrow police have sought the Oklahoma State Bureau of Investigation for assistance. What is a Hate Crime?

With all the talk surrounding the tragic church shooting in South Carolina last month, the news has been reporting often on the topic of hate crimes. We tend to understand what a hate crime is from a layman's perspective, but what is a hate crime in the legal sense, and how does it affect criminal defendants charged with crimes? What is a Hate Crime? In common terms, hate crimes are common crimes, even minor ones, which are made more severe if they target a specific protected class of people. This doesn't mean that a crime happens to be perpetrated on a minority or protected class, but rather means that the crime was specifically targeted to a protected group. Usually, these crimes are used to "send messages" to minority groups or to scare larger populations of people. Hate crimes can transform generally modest or low-severity crimes into very serious offenses. For example, vandalizing a street sign is a crime that many youths often find themselves in…

Kirk Bloodsworth, the first person in the United States to be exonerated from death row through DNA testing, joined criminal justice system leaders in Washington, D.C., on Wednesday at the Coalition for Public Safety Bipartisan Summit on Fair Justice and called on Congress to support efforts to address and prevent wrongful convictions. The summit brought together lawmakers, criminal justice experts, formerly incarcerated individuals, advocates and media to urge policy makers to reduce the prison population, cut incarceration costs, reduce recidivism rates, and create meaningful opportunities for formerly incarcerated individuals to lead productive lives. Bloodsworth urged law makers and other attendees to reauthorize the Justice for All Act, which would include vital innocence programs such as the Kirk Bloodsworth Post-Conviction DNA Testing Program and the Coverdell Forensic Science Improvement Program, which would provide states with federal funding for post-conviction DNA…

Field Sobriety Tests in California

With the start of the legislative session, California Senate members were given cards with a number for 24 Hour transportation.  As exposed by the Sac Bee, California Senate officials have hired two part-time employees to provide late night rides for members while they are out in Sacramento, following the high-profile drunk driving arrests involving lawmakers in recent years.  In particular, Assemblyman Roger Hernandez (D-West Covina) has failed three field sobriety tests, Sen. Ben Hueso (D-San Diego) recently plead guilty to a “wet reckless” charge, and Assemblyman Martin Garrick (R-Solana Beach) and Sen. Roy Ashburn (R-Bakersfield) have both plead no contest to DUI charges. It is no secret that California has a high rate of DUIs, and police will be cracking down.  It seems as if both lawmakers as well as citizens will likely encounter a field sobriety test at one point or another—even if they have not been drinking at all. What is a Field…

A New Port Richey woman has been sentenced to prison for trafficking in counterfeit cosmetics. The 45-year-old woman was sentenced to 18 months in federal prison. A money judgment was also issued against her for nearly $1 million. She pleaded guilty to the charges against her in September 2014. According to court documents, the woman sold more than $1 million worth of counterfeit Make-up Art Cosmetics, Inc., otherwise known as MAC cosmetics, between March 2012 and March 2014. Investigators claim she purchased bulk quantities of counterfeit MAC cosmetics from a source in China, then sold the cosmetics as legitimate products at significantly higher prices. Investigators believe she sold the cosmetics across the country using a website for her company through eBay and directly to some wholesale customers. This case was investigated by U.S. Immigration and Customs Enforcement’s Homeland Security Investigations. Intentionally trafficking or attempting to traffic in goods that…

Guest post by Ian Sonego:The en banc Seventh Circuit has ruled 6-5 that a federal prisoner under a death sentence may circumvent the prohibition upon successive collateral attacks in 28 U.S.C. § 2255(h), which is similar to 28 U.S.C. § 2244(b)(2)[limiting successive habeas petitions filed by state prisoners in federal courts], by filing a habeas petition under 28 U.S.C. § 2241 in the district where he is incarcerated instead of the district where he was convicted and sentenced. Webster v. Daniels, 784 F.3d 1123 (7th Cir. May 1, 2015)(en banc)(No. 14-1049).Federal prisoners under death sentences are incarcerated in the federal prison in the State of Indiana, which is within the Seventh Circuit. This federal prisoner (Webster) claims to be sufficiently mentally retarded or intellectually disabled to be exempt from the death penalty. Free lunches, feel-good policies, and cold reality

WaPo editorial writer Charles Lane has this article on sanctuary cities:In reality, there is no free lunch. In the alternate reality known as the American political debate, however, that's the only kind on the menu. Conservatives say tax cuts boost economic growth, which yields higher revenue. No need to worry about bigger budget deficits. Meanwhile, over on the left, we have laws and policies in more than 200 jurisdictions, including some of the largest cities and counties in the country, that are meant to protect immigrant communities by preventing local authorities from cooperating with federal deportations of undocumented immigrants who have run-ins with the law.Advocates claim that "sanctuary," as they call it, achieves a moral goal -- peace of mind for people who, whatever their immigration status, are often longtime residents, leading productive lives -- at little or no practical risk or cost to…
