First Cyberstalking, Then Murder, in Family Law Tragedy

In a divorce tragedy akin to Shakespeare’s “MacBeth”, Delaware mother Christine Belford, age 39, was murdered by her father-in-law in February 2013 after years of litigation involving child abduction, allegations of mental illness, non-payment of child support, and the eventual termination of a parental relationship. Earlier chapters of the divorce of Ms. Belford and her optometrist husband David Matusiewicz were distinguished by animosity and hatred engendered by a dispute over their children. In 2006 a psychologist examined the parties and found each parent capable and fit. The Court acted on that information and granted joint custody to the parties with Mr. Matusiewicz to have primary residence and Ms. Belford to see the children every weekend and mid-week. But that order did not suit the children’s father who believed his wife was a an unfit, neglectful mother. Selling his practice, Mr. Matusiewicz abducted their three children in 2006, spiriting…

As a U.S. citizen, you have what is known as Miranda Rights. The term Miranda Rights has its origins in a 1966 U.S. Supreme Court Case known as Miranda v. Arizona. The court’s ruling on this matter gives anyone in police custody or facing potential criminal charges to be advised of their right against self-incrimination. This is also an element of the 5th Amendment of the U.S. Constitution. If you are taken into police custody for any reason, you are required to be given a Miranda warning briefing you on your rights. The Miranda warning must include the following information: You have the right to remain silent Anything you say may later be used against you You are legally entitled to speak with an attorney If you are unable to afford an attorney, one will be provided for you at no cost The main purpose of a Miranda warning is to let the person in police custody understand that they have the right to remain silent. This must be communicated clearly to the person detained…

In April of this year, Tennessee State Representative Bill Beck was arrested on charges of driving under the influence. Now, after reviewing a police video of the stop, Cheatham County Judge Phillip Maxey has dismissed the charges against the Nashville Democrat and injury attorney. Beck is partner in a Nashville law firm specializing in personal and work-related injuries, probate estates, and more and is also a certified Civil Trial Specialist. Beck was returning home following a long night at a comedy show when he was pulled over on suspicion of DUI. According to a news article at WSMV News 4, Beck was pulled over after Metro police officer Bradley Nave passed Beck’s truck and noticed the truck straddle the center lane. The officer then turned around and pulled Beck over. After a field sobriety test that Beck cut short, he was arrested, Nave telling him that he had “way too much to drink to be driving.” Beck’s attorney maintained that after watching…

An incident involving two convicted New York prisoners who escaped from a maximum security jail brought much attention to the issue on how far an enforcer’s right to use deadly force against escapees could go. Out of the two escapees mentioned above, one ended up dead after being shot by the pursuing officers. The other escapee was captured a couple of days after the incident. He was found bleeding because of a gunshot wound. Now, the big question is: “Are law enforcement officers really given the right to use deadly force when dealing with escaped convicts?” Proper Treatment of Convicts Based on American Bar Association Standards The ABA (American Bar Association), the group responsible for the creation and implementation of humane standards for treating convicts, has a very clear answer to the question above. Yes, deadly force can be used against a convict attempting to escape but this should be under special circumstances only. “Escaping” means…
