DUI Teen Does Double Damage to Police Cars
Police officers know that that they may be at risk when they’re called to pursue someone suspected of DUI in Los Angeles. If the driver suddenly takes a turn or doesn’t stop at a DUI checkpoint, their vehicles can suffer damage—and so can they. Last May, for example, a DUI driver injured two Detroit police officers when he smashed his truck into the rear end of their police car. But the damage didn’t end there—the truck also hit two officers who were standing nearby. But not many DUI drivers hit two separate police cars—at different sites—in the same evening. A 17-year old girl in Boise, Idaho, managed to do it. She first rear-ended a white Honda at Cole and West Ustick Roads; the Honda, pushed forward, then rear-ended a patrol vehicle driven by a deputy from the Ada County Sheriff’s Department. Instead of stopping when the deputy got out of his car, the teen drove off, hitting several garbage cans on a sidewalk along the way. She…

Driver On DUI Probation Causes Fatal Crash
Some people never seem to learn, no matter how many times they suffer the consequences of an arrest for a DUI in Los Angeles. Even as they’re paying the penalty for one DUI offense, they’re committing another. Christopher Thomas Nash of Hesperia, California, may finally understand the consequences of driving while intoxicated. But that realization comes too late for 27-year-old Andrea Anderson, who died as a result of an accident that Nash allegedly caused. The 31-year-old man was driving his white GMC truck south on Armagosa Road around 4:30 in the morning of July 30th when he crossed the double line and drove into oncoming traffic. The truck hit the red Kia Forte driven by Anderson, who suffered fatal injuries. Paramedics pronounced Anderson, who was an only child, dead at the scene. The accident, which demolished the front end of the Kia, trapped Nash in his car. Emergency workers had to extricate him before a helicopter airlifted him to Loma Linda Medical…

A Pragmatic Approach to Interpreting the Federal Rules
Elizabeth G. Porter, Pragmatism Rules, 101 Cornell L. Rev. (forthcoming, 2015), available at SSRN. Suzette M. Malveaux With seventeen decisions interpreting the Federal Rules of Civil Procedure in the last decade, the Roberts Court has doubled the number of cases decided by its predecessor, the Rehnquist Court, in the same amount of time. This record-breaking streak has given scholars a unique opportunity to examine the contours and direction of the modern civil litigation system. Elizabeth Porter has taken this opportunity to discern the interpretive methodologies used by the Roberts Court when deciding Rules cases. In doing so, she makes a unique contribution not only to the literature on civil process, but also to the study of interpretation, focusing it away from statutes and instead onto the Rules. At a time when much is at flux in the procedural world, in Pragmatism Rules, Porter discerns two primary competing interpretative methodologies in the Roberts…

The Nine-Step Walk and Turn Field Sobriety Test
Police in Minnesota are trained to administer field sobriety tests to a driver they suspect may be driving under the influence of drugs and/or alcohol. The field sobriety tests, if administered correctly and under proper conditions, can be a reliable indicator of the sobriety level of a driver. However, field sobriety tests are far from foolproof. Improper administration, improper instruction, inadequate lighting, and uneven ground are factors which will distort the accuracy of this test. During the trial, especially during cross-examination, errors in test administration, result interpretation, test explanation, and … [Read more...] The post The Nine-Step Walk and Turn Field Sobriety Test appeared first on Minneapolis DWI Lawyer Douglas T. We’ve Learned Nothing (A Rant)
The one year anniversary of the killing of Michael Brown brought protests back to Ferguson, Missouri. They were peaceful and, like the protests following the killing, were met by a wall of police in black military garb, armed to the teeth, ready to “restore calm” at the end of guns. Looting broke out, having nothing to do with the protests per se, but since the faces were black, the media wrapped it together with the protests, because all blacks are the same no matter whether they’re behaving peacefully, so as not to offend distant pale sensibilities, or violently, confirming the prejudice against them. Shots were fired and a black teen hit the ground. The cops explained the shooting, based on a story only they can verify, that they returned fire. Whether the kid they hit shot at them is a matter of faith in cops. The cops say so, and there is no one to question it. Others continued their protest, blocking the steps to the federal courthouse…

Affirmative Consent Is Unconstitutional
In a twit yesterday, the holding in Mock v. University of Tennessee was wrongly broadcast as “affirmative consent ruled unconstitutional.” It wasn’t. Chancellor Carol McCoy ruled that shifting the burden under “yes means yes” to the male to prove that he had consent, rather than placing it on the accuser to prove he did not, was unconstitutional. And it’s one of a string of decisions finally making their way out of the intellectual cesspool of Title IX adjudication in the fantasy world of academia, where no delicate flower shall feel unsafe. GW lawprof John Banzhoff made it clear: [N]o matter what the Department of Education or Department of Justice suggest, regardless of what a state’s statute provides, or what the University decides, the Constitution trumps it all. Despite the reinvention of the Constitution by every sophomore feminist and sociology prof, to match their peculiar sensibilities, this isn’t a huge…

Should Prison Sentences Be Based on Crimes Not Yet Committed?
The U.S. Constitution requires due process before a criminal defendant can be deprived of life, liberty, or the pursuit of happiness. It is also a fundamental tenet of the U.S. justice system that defendants cannot be prosecuted for things they might do or for things they think about doing- which is why even charges of attempted crimes require at least one overt action in furtherance of the wrongful act.Despite these basic long-standing principles of the justice system in the United States, there is now a move forwards basing criminal sentences on the likelihood of a defendant committing future crimes. FiveThirtyEight reported on the new sentencing tool judges will be getting in one state as early as next year, which allows them to predict the likelihood of a re-offense when determining what a defendant’s criminal penalties should be. Risk Assessments in Prison SentencingRisk assessments have existed for more than a century, but advances in social science have…

Legal Tsunami Accompanies Custody Battle
The level of vitriol, anger, and violence that finds its way into child custody litigation is beyond frightening, as common sense is displaced by exaggerated allegations, bizarre threats, and all too often, bodily harm or death. The case of Tiffany and Eric Stevens of Connecticut represents the thin edge of the wedge, a story replete with allegations of infidelity, drug abuse, domestic violence, failed stints in rehab, mental health evaluations, child protection issues, harassment leading to a restraining order, exorbitant gambling debts,a hit man, and police intervention. Whew! All it took was a five-year marriage and one little girl to create a legal tsunami that saw the Stevens’ in court on 200 occasions, the last being Tiffany Steven’s trial for hiring handyman cum hitman, John McDaid, to kill her husband for a fee of $5,000. When Mr. McDaid told Mr. Stevens of his assignment, the jig was up, and Tiffany was arrested for the attempted murder-for-hire. But…
