How the Flawed Science of Bite Mark Analysis Put an Innocent Man behind Bar

An article in the Intercept takes a detailed look at the flawed science of bite mark analysis and the case of Bill Richards, a California man who was convicted in 1997 of murdering his wife, Pamela. Richards’ conviction was primarily based on the testimony of forensic odontologist Dr. Norman Sperber, who concluded that a photograph of a possible bite mark on Pamela’s hand specifically matched Richards’ dentition. According to the Intercept, not only did Sperber claim that Richards’ teeth matched the mark, but he also testified that only “one or two or less” out of 100 people would have such unique dentition. Dr. Greg Golden, an odontologist called by the defense, also testified and eventually agreed with Sperber’s conclusion that only about two percent of the population would have similar dentition. In my role as a Michigan driver's license restoration lawyer, I often hear some say that he or she hasn't driven for years and years, as if that might help win his or her license back. While I completely understand the frustration behind such a statement, the cold, hard truth is that it couldn't matter less how long someone you have been without a license. My job is to help people win back their driver's licenses, and a part of that (the part that has me spending as much time as I do writing these articles) is to help them understand how things work, and why. Part of that, in turn, is not wasting time on those things that don't work. Driver's license appeals have nothing to do with how long you haven't driven, and raising this issue amounts to nothing more than a waste of breath. The legal standards to be applied in evaluating a motion to dismiss are well-settled. In determining whether a complaint is sufficient to withstand a motion to dismiss pursuant to CPLR 3211(a)(7), the sole criterion is whether the pleading states a cause of action. If from the four corners of the complaint factual allegations are discerned which, taken together, manifest any cause of action cognizable at law, a motion to dismiss will fail. The court's function is to '"accept each and every allegation forwarded by the plaintiff without expressing any opinion as to the plaintiff's ability ultimately to establish the truth of these averments before the trier of the facts'". One of many benefits I see in giving crime victims certain rights in the criminal justice system is to ensure their voices are heard and their experiences are memoralized in courtroom proceedings even when those voices and experiences may not directly impact sentencing outcomes. In turn, I think it now worth highlighting the on-going proceedings in a Colorado courtroom that are effectively and potently reported in this CNN piece headlined "A parade of pain at James Holmes sentencing." FinCEN Proposes Rule Requiring Investment Advisor AML Compliance

Investment advisors may soon face increased costs and scrutiny thanks to a proposed rule issued by the Financial Crimes Enforcement Network (FinCEN).  On Tuesday, August 25, FinCEN proposed a rule that would require many investment advisors to implement AML compliance programs, including the filing of suspicious activity reports (SARs) and currency transaction reports (CTRs). The CTR requirement comes with FinCEN’s proposal to include investment advisers in the definition of “financial institution” in the operative regulation. FinCEN Director Jennifer Shasky Calvery explained in the agency’s press release, “Investment advisers are on the front lines of a multi-trillion dollar sector of our financial system . . . .  If a client is trying to move or stash dirty money, we need investment advisers to be vigilant in protecting the integrity of their sector.” As the proposed rule explains, “The investment advisers…
