Dallas Police Face Unfair Discipline, Stress:  Officers in the Dallas Police Department have been taking longer to respond to 911 calls, partly due to officers being "mentally beaten down," according to the head of the Dallas Police Association.  J.D. Miles of CBS DFW reports that the association's president, Ron Pinkston, says that many of the 3,000 officers he represents "are moving slower because of concerns over safety and fears about violating department policies."  Dallas Police Chief David Brown attributes new training requirements to the slower responses to priority one calls, which at eight minutes and 13 seconds is the highest it has been in three years.  Ultimately, there is a lack of motivation within the force due to the fear of doing the right thing coupled with the fear that "nobody's going to support them."  The Georgia Innocence Project will ask a judge today for DNA testing in the case of their client Johnny Lee Gates, who was convicted of armed robbery, rape and murder in 1977. Gates became a suspect in the 1976 rape and murder of Katharina Wright when he was picked up on an attempted robbery charge the following year.  A police informant claimed he loaned Gates the same make and model gun used in the crime.  The informant told police that, upon returning the firearm, Gates said he had killed Wright. When police recovered the gun, however, ballistics showed it was not the one used in the crime. According to a motion filed by Gates’ attorneys, the informant later denied owning a gun or lending one to Gates. Lawyers from the Georgia Innocence Project claim investigators took Gates to the crime scene to explain how they believe Wright was killed, then took him back to the scene the next day to videotape him supposedly retelling how he committed the crime.…

In the quest for a better and more comfortable life, man has various types of technological gadgets. This has opened up the tech age on which we are part of now. Even if the technological era has made our life simpler, it also brought some disadvantages. It appears that some of the technologies we are enjoying today are also violating our legal right to privacy. Wearable Data Technologies: Harvesting Our Personal Information The popularity of biometric gadgets that people are wearing today might not raise some red flags. The influx of such gadgets is seen by many as a blessing. This is because they can monitor everything about their bodies: pulse rate, metabolism, sleep patterns, and many other things. A lot of these data are stored up in the “cloud” where access can be enjoyed anytime. The alarming thing about this is that with the correct skill and resources, anybody can pry into such private data. Of course, there are also other wearable technologies out there…

Massachusetts Attorney General Proposing Fentanyl Trafficking Be Made a Crime

Heroin Trafficking Defense Attorney Fentanyl is an opioid used for pain management therapies that has become a popular street drug in recent years. It is classified as a Class B controlled substance under Mass. Gen. Laws Chapter 94C, Section 31. It is used to cut heroin, cocaine, and other drugs, often without the knowledge of the person taking the drugs. Fentanyl is a powerful drug that increases the potency of heroin and other drugs when mixed with them. Heroin overdose deaths in Massachusetts have been on the rise for many years, and increasingly, toxicology investigations find that the fentanyl being mixed with the heroin is contributing to these deaths. While there are already laws on the books that make possession and the intent to distribute fentanyl a crime, there is no law against trafficking the substance. That might be about to change. According to the Boston Globe, Massachusetts Attorney General Maura Healey has proposed a bill that would make fentanyl trafficking a…

According to the Marijuana Resource Center: State Laws Related to Marijuana: Since 1996, 23 states and Washington, DC have passed laws allowing smoked marijuana to be used for a variety of medical conditions. It is important to recognize that these state marijuana laws do not change the fact that using marijuana continues to be an offense under Federal law. Voters in Alaska, Colorado, Oregon, and Washington state  also passed initiatives legalizing the sale and distribution of marijuana for adults 21 and older under state law.  District of Columbia voters approved Initiative 71, which permits adults 21 years of age or older to grow and possess (but not sell) limited amounts of marijuana. There are critical differences in marijuana laws from one state, county, or city to another. For more information, refer to the National Conference of State Legislatures (NCSL).It is important to note that Congress has determined that marijuana is a dangerous drug and…

I know, right? It’s a take on an old lawyer joke. That oughtta attract some troll traffic. But I just can’t help it. All of the online negativity in general, and that directed at lawyers specifically, is beginning to get to me. I’ll have more on the general negativity later, but for now let’s look at the lawyer stuff. If you have followed these posts you will have noticed that I dropped out of sight for a while, since July 8th to be precise, which was when one of my last posts was buffered to hit the airwaves… precisely as my cardiac surgeon was busy cracking my chest wide open so he could stop my heart, hand my life functions off to a machine and hack away at my innards. You think I was about to make any surgeon jokes right about then? No way. My life was in his hands, literally. Then why is it that everyone takes such glee in ridiculing, criticizing, and mocking lawyers? People put their lives in the hands of their lawyers. In reality most…
