College Rape Charges: Students Arrested for Sexual Assault and Fixing the Current Kangaroo Court System

Campus rape charges are being made much more often today. However, there’s a big problem with sexual assault charges when students are involved and it’s an injustice everyone needs to recognize and which needs to be fixed. Here’s the thing: allegations of rape or sexual assault on a school campus often involve a whole different system in the investigation and “prosecution” of the student rape claims. Many people assume that if a college student goes to the authorities to report a rape or sexual assault, the local police department or sheriff’s office becomes immediately involved and the standard, traditional process of the American criminal justice system swings into action. This is not true. When reports of sex crimes like rape, attempted rape, or sexual assault are made on a campus, there’s an entirely different system that goes into action — and the local city police department or county sheriff’s office may have no…

Charleston Shooter to Face Death Penalty:  Prosecutors in South Carolina stated in court documents that the death penalty will be sought for Dylann Roof, the 21-year-old man charged with the racially motivated massacre of nine black churchgoers in June.  The AP reports that prosecutors are pursuing the death penalty "because more than two people were killed, and the others' lives were put at risk" when Roof opened fire during a Bible study at the historic Emanuel African Methodist Episcopal Church.  On that evening in June, Roof, who is white and has expressed hatred for black people, went to the church's Bible study and sat in for about an hour before drawing a .45-caliber semiautomatic handgun and gunning down nine parishioners.  He has been indicted twice for the crime, in state court and in federal court. Crime Rises in Downtown LA:  Rapid gentrification in downtown Los Angeles is "crashing up against the chronic poverty,…

Michigan DUI - Jail, Counseling, or Neither?

After more than 25 years as a Michigan DUI lawyer, I am intimately familiar with the concerns and fears people have as they face a drunk driving charge. Of course, everyone's biggest and worst fear after a DUI arrest is going to jail. As it turns out (and with the only exception being 1 Judge in Bloomfield Hills' 48th district court), there simply is no jail in any standard ("standard" meaning that no one was injured or killed) 1st offense DUI. In fact, even in many, if not most 2nd offense drinking and driving cases, avoiding jail isn't particularly difficult for me. I know this precisely because I do it on a daily basis in the district courts of Macomb, Oakland and Wayne counties. While fear of jail is practically instinctive, it is also very much misplaced, not only because jail can be easily avoided in so many cases, but also because focusing on jail takes your eye off those things that will and/or are far more likely to happen as a consequence…

St Louis Traffic Tickets: How Do I Find Out The Reason Why My Driver’s License Has Been Suspended?

0

ONLY $185 FOR DRIVING WHILE SUSPENDED TICKETS IN ST LOUIS The easiest way to learn the reason for why your driving privileges have been suspended is to simply give the Missouri Department of Motor Vehicles (DMV). This department can identify clearly for you the reason(s) for the suspension. And once the reason for the suspension is learned, then a good St Louis traffic ticket lawyer can help you. Finding out the reason for your suspension in the first place is very important if you receive a Driving While Suspended ticket in St Louis. This is a very serious offense (and some jurisdictions treat it as a criminal misdemeanor). And if you plead guilty to this type of ticket, you will receive twelve (12) points to your permanent driving record (which in turn will probably lead to yet another year of suspension). “Points” are like little red flags that make it appear as if you are a bad driver. It is the existence of points on your record that cause your automobile…

"HUCKLEBERRY PRESIDENTIAL CANDIDATE" DOUBLES DOWN ON HIS ATTACK ON THE CONSTITUTION

UPDATE:  The jail house door has slammed behind Ms. Davis as she is found in contempt of court.  The bottom line: don't openly defy a federal judge, unless you are ready for 3 hots and a cot.Ms. Davis is described as being in disbelief.  She thought it would be nothing more than a fine, that others were willing to pay for her.  The judge (the son of former Kentucky Senator and Detroit Tigers pitcher Jim Bunning) said, that would act as no deterrence to further defiance on her part.  So off to the lockup she goes until her office starts issuing marriage licenses to all who are qualified. For those who may have been hiding under a rock (actually I have had that urge myself), Kim Davis, the County Clerk in Rowan County, Kentucky, is facing a judge today on a contempt charge for refusing to issue marriage licenses to gay couples.  In speaking about the ongoing nonsensical controversy regarding Ms. Davis,…

Are Sentencing "Reformers" Getting Worried?

0

In Washington, DC, one way of gauging whether you're making any headway is by the intensity of the opposition .When the other side is confident, you pass unnoticed. When they feel it slipping away, things get a little more.........heated.I suppose, although there's no way I can be sure, that this is what accounts for the increasing interest in my opposition to mass sentencing reduction, opaquely labelled as sentencing "reform."  In late July, there were articles about me on successive days in Slate and Salon.  The former was, I thought, fair-minded and thoughtful, although the author, Mark Obbie, made clear his disagreement with my substantive views.  The latter was more personal.  I answered it here and here.I see from today's edition of Sentencing Law and Policy that Ms. Julie Stewart, head of Families Against Mandatory Minimums (FAMM), has a piece in Reason Magazine, a libertarian publication, that essentially makes me out to be a…
