Parole: Absolute Power Corrupts

$

Writing about parole in New York is akin to banging one’s head on a wall. A wall with spikes. Very sharp spikes. Lots of them. The reason is both plain and, at least amongst those familiar with the system, obvious.  The New York State parole board is comprised of political appointees with near absolute, unreviewable authority, and they wield it like a spiked bludgeon. As noted in the New York Times editorial, the Court of Appeals will hear argument in a case that could force a change in parole. On Tuesday, the New York Court of Appeals, the state’s highest court, will hear oral arguments in a case that may provide a rare chance to reform New York’s antiquated, ineffective and unfair parole system. It’s not exactly correct that New York’s system is antiquated. There have been tweaks to the system intended to bring it up to speed. But these tweaks have been ineffective, because they fail to address some core problems with…

A South Florida woman is the alleged leader in a healthcare fraud conspiracy that’s cost the state’s Medicaid program more than $2.7 million, according to federal prosecutors. Irma Davidian, of Boca Raton, through her husband David’s company American Advisory Associates has been accused of being the key player in a scam that involved payments to employees of the Department of Children and Families as well as the Social Security Administration in exchange for submitting fraudulent applications on behalf of her client base which she attained by advertising in newspapers. According to court documents, Davidian ran ads in local publications claiming she could acquire government benefits such as food stamp and Medicaid benefits no matter what an individual’s circumstances were. Her fee for this service varied from $2,000 to $5,000. Her main contact at the Florida Department of Children and Families (DCF) was Gladys Roman, who worked as an as an interview…

Masculinity In The First Degree

$

SUNY Stony Brook will be offering a master’s degree in masculinity. It will not be taught by Mike Cernovich, author of Gorilla Mindset. Rather, Michael Kimmel will be in charge, and he has a very different perspective. “What does it mean,” the 64-year-old sociology professor asked the group, most of them undergraduates, “to be a good man?” A series of examples follow, but I’ll cut to the chase. To Kimmel, a good man is a woman. If men were just more feminine, all would be right with the world. There’s an irony abrewing. Feminist theory is that gender is a social construct, meaning that we take beautiful children and beat them into the monsters they eventually become, because there is no inherent difference between genders. Studies to the contrary are ignored or denied. And so, the reason guys watch football, eat bacon, get horny, are aggressive, is that socialization makes them that way. This is problematic and wrong, and must be…

OxyContin Maker Continues To Fight With Government And FDA Regarding Its Formulation In Light Of Prior Plea Agreement

Purdue Pharmacy continues to battle the government over its controversial prescription drug OxyContin. Now Purdue wants Medicare, Medi-Cal or Medicaid and other government programs to approve payment even after longstanding lawsuits and concerns about Purdue's actions in the past. Purdue cancelled a meeting with the FDA this past July to go over whether this formulation will deter abuse. The history here is lengthy. In 2007, in United States of America v. The Purdue Frederick Company, Inc., Purdue and its top executives pleaded guilty to charges that it misled doctors and patients about the addictive properties of OxyContin and misbranded the product as "abuse resistant." Prosecutors found a "corporate culture that allowed this product to be misbranded with the intent to defraud and mislead." Purdue Pharma paid $600 million in fines, among the largest settlements in U.S. history for a pharmaceutical company.Three former and current…

Wright v. Florida - Felony Firearm Conviction Challenged

$

Florida is fairly permissive with regard to firearm purchase and possession, but there is a major exception: Felons. In the state of Florida, it is illegal for those convicted of felonies to possess firearms and/or ammunition. There are two general exceptions to this. The first is when a convicted felon has his or her civil rights restored AND firearm authority restored through the state Clemency Board. It's not enough that one receives a general restoration of rights. In order to restore firearm authority, an application has to be filed, and there is a waiting period of at least eight years from the date the sentence expired. The second allowance is when the firearm qualifies as an antique gun per F.S. 790.001(1). The definitions of "possession" and "antique" were central in the case of Wright v. Florida, in which a man convicted of being a felon in possession of a firearm and ammunition appealed that conviction in Florida's 4th District Court…

Lite Guv blasts media for reporting police lawbreaking, misconduct

The discourse in Texas surrounding police accountability reached a new low last week with the Lt. Governor's contribution. Reported the Houston Chronicle's Bobby Cervantes (Sept. 3):Lt. Gov. Dan Patrick, no stranger to radio interviews, had to stop and think about whether he would record one for a Texas outlet. He ended up doing it -- talking about his recent call for Texans to treat officers with respect -- but not without chastising the program's host when he tried to steer the discussion to cases of police violence."Your type of interview has to stop," Patrick told The Texas Standard's David Brown on Thursday. "Quit focusing on the small percentage of those in law enforcement who have made a mistake or have broken the law themselves." ..."When I was asked to do an interview on NPR, I thought to myself, you know, do you really want to do this?" Patrick wondered aloud on the air. "They're not in the police…

What Happens if I Accept a Plea Bargain?

It might surprise the average person to know that most criminal cases don’t follow the steps depicted in TV procedurals and crime dramas. In practice, most convictions are not the result of a careful jury deliberation but of an agreement between the prosecutor and the accused which is known as a plea bargain. This deal generally comes with a promise to reduce or remove prison charges, lower fine amounts and introduce less punitive measures like probation in exchange for pleading guilty to some of the charges or to lesser charges. But what can happen after a defendant accepts this deal? What’s the Usual Procedure for Plea Bargains? According to estimates provided by the Bureau of Justice Assistance, between 90% and 95% of criminal cases are resolved through a plea bargain. Thus, understanding this mechanism is key for understanding the process and procedure for most criminal matters in the U.S. justice system today. In most criminal cases, there’s a discussion…

Happy Labor Day, or Not Simple Advice When Searching for aCriminal Defense or DUI Lawyer I woke up this morning, happy to not to have to shave, put on a suit and drive to court somewhere in Southern California. Although I know I will have to pay for the holiday somehow, I can enjoy today as any other day off: I get up later, I leisurely read the newspaper, sip my coffee and there it is, staring at me in black and white, another DUI checkpoint snares several unlucky drivers. I guess these folks didn't read my last post about how to avoid a DUI over Labor Day. For those of you who were the unlucky few to get caught or if you otherwise had the misfortune of losing your liberty this weekend, I have a prepared a few pieces of advice in your search to hire a lawyer. Please note that this list is by no means exclusive and is in no particular order. If the person you speak to on the phone is not a lawyer or is not THE lawyer who will be representing you in court there may be a…

Lawsuit By Orange County Against Pharma Companies for Fraudulently Marketing Addictive Painkillers Dismissed On Grounds FDA Had Exclusive Jurisdiction

On August 27, 2015, a California state court dismissed a groundbreaking lawuit filed last year by Orange and Santa Clara counties accusing the companies of fraudulently marketing addictive painkillers to undermine the effect of warning labels required by the U.S. Food and Drug Administration. The counties say that the efforts boosted sales of the dangerous drugs at the expense of public health. See Los Angeles Times article on this ruling. In Thursday's hearing before Orange County Superior Court Judge Robert J. Moss, the companies asked that the case be dismissed on the grounds that the FDA had exclusive jurisdiction over the matter. The court ruled that the FDA had exclusive jurisdiction. The 105-page lawsuit, filed in Orange County by District Attorney Tony Rackauckas, alleges five pharmaceutical companies spent millions of dollars to convince the public that drugs meant only for short-term use by cancer patients should be taken for chronic pain.  The marketing…

Been Caught Stealin? New law lowers theft penalties in Texas.

As any believer in sound money will tell you, inflation eats away at the purchasing power of your dollar. But without indexing for inflation, a thief who steals $49 worth of good 15 years ago, got a lot better deal than one who stole something 15 months ago. In acknowledgement of this economic fact the legislature recently lowered the theft penalty ranges, by increasing how much shit you can steal before it becomes a felony, or class B misdemeanor. The new amounts, for theft offenses committed after 9/1/2015, are as follows- $99.99 or less – Class C Misdemeanor (like a ticket) $100.00 to $749.99 – Class B (like a DWI or small pot case) $750.00 to $2,499.99 – Class A (like family violence, or over 3 ounces of chronic) $2,500.00 to $29,999.99 – State Jail Felony (like possessing 1/2 a gram of cocaine) $30,000.00 – $149,999.99 – Third Degree Felony (like failure to register, or your 5th DWI) $150,000.00 to $299,999.99 – Second Degree…
