The New York State parole board is comprised of political appointees with near absolute, unreviewable authority, and they wield it like a spiked bludgeon. As noted in the New York Times editorial, the Court of Appeals will hear argument in a case that could force a change in parole. On Tuesday, the New York Court of Appeals, the state’s highest court, will hear oral arguments in a case that may provide a rare chance to reform New York’s antiquated, ineffective and unfair parole system. Five Arrested in South Florida Health Care Conspiracy Scheme
A South Florida woman is the alleged leader in a healthcare fraud conspiracy that’s cost the state’s Medicaid program more than $2.7 million, according to federal prosecutors. Irma Davidian, of Boca Raton, through her husband David’s company American Advisory Associates has been accused of being the key player in a scam that involved payments to employees of the Department of Children and Families as well as the Social Security Administration in exchange for submitting fraudulent applications on behalf of her client base which she attained by advertising in newspapers. According to court documents, Davidian ran ads in local publications claiming she could acquire government benefits such as food stamp and Medicaid benefits no matter what an individual’s circumstances were. Rather, Michael Kimmel will be in charge, and he has a very different perspective. “What does it mean,” the 64-year-old sociology professor asked the group, most of them undergraduates, “to be a good man?” A series of examples follow, but I’ll cut to the chase. To Kimmel, a good man is a woman. If men were just more feminine, all would be right with the world. There’s an irony abrewing. Purdue Pharmacy continues to battle the government over its controversial prescription drug OxyContin. Now Purdue wants Medicare, Medi-Cal or Medicaid and other government programs to approve payment even after longstanding lawsuits and concerns about Purdue's actions in the past. Purdue cancelled a meeting with the FDA this past July to go over whether this formulation will deter abuse.The history here is lengthy. In 2007, in United States of America v. Wright v. Florida - Felony Firearm Conviction Challenged
Florida is fairly permissive with regard to firearm purchase and possession, but there is a major exception: Felons. In the state of Florida, it is illegal for those convicted of felonies to possess firearms and/or ammunition. There are two general exceptions to this. The first is when a convicted felon has his or her civil rights restored AND firearm authority restored through the state Clemency Board. It's not enough that one receives a general restoration of rights. In order to restore firearm authority, an application has to be filed, and there is a waiting period of at least eight years from the date the sentence expired. The second allowance is when the firearm qualifies as an antique gun per F.S. 790.001(1). The definitions of "possession" and "antique" were central in the case of Wright v. Lawsuit By Orange County Against Pharma Companies for Fraudulently Marketing Addictive Painkillers Dismissed On Grounds FDA Had Exclusive Jurisdiction
On August 27, 2015, a California state court dismissed a groundbreaking lawuit filed last year by Orange and Santa Clara counties accusing the companies of fraudulently marketing addictive painkillers to undermine the effect of warning labels required by the U.S. Food and Drug Administration. The counties say that the efforts boosted sales of the dangerous drugs at the expense of public health. As any believer in sound money will tell you, inflation eats away at the purchasing power of your dollar. But without indexing for inflation, a thief who steals $49 worth of good 15 years ago, got a lot better deal than one who stole something 15 months ago. In acknowledgement of this economic fact the legislature recently lowered the theft penalty ranges, by increasing how much shit you can steal before it becomes a felony, or class B misdemeanor.
