WaPo Fact Checker Glenn Kessler reviews this statement by Hillary Clinton:  "It was fully above board. New York Magazine published a long piece Monday featuring exonerees Jeffrey Deskovic, Barry Gibbs, Jonathan Fleming, Fernando Bermudez, Alan Newton, Gerard Richardson, Derrick Hamilton and David McCallum describing their first days on the outside after decades in prison for crimes they did not commit. Barry Gibbs, who was released in September of 2005, recounted how an encounter with Innocence Project Co-Founder Barry Scheck’s dog helped him ease out of his prison mindset. “They opened up the door, and I saw a dog on the other side of the room. I’m looking at this dog, and the dog’s looking at me. I just couldn’t move. I was in shock when they got me out, I was really in shock. Poor grandma and grandpa…thrown in jail for their misguided efforts to assist their daughter to flee England with her two children after the Court ordered a change in custody to their father. The children’s mother had custody of her son, age 7 and daughter, age 2 until a judge ordered the children to be transferred to their father’s custody, leaving mom with one hour a month of supervised access. The mother’s “issues”, what ever they be, were plainly reflected in the draconian limitation placed on her time with the children. Incidents of DUI in Los Angeles can result in drivers exhibiting some very unusual behaviors. But when someone who saw the event tries to describe what happened, other people may find their story hard to believe. Fortunately for police officers in Rowland Heights, California, they can produce video evidence to confirm that what they said happened to cause a crash actually did occur. The dash cam on the car following Jasmine Lacey’s 2010 Hyundai Sonata on Harbor Boulevard captured the whole incident. (The car’s owner posted it on YouTube, where almost two million people have viewed it.) Last month, a Florida judge recommended permanent disbarment for three lawyers who set up their legal opponent to be arrested for a DUI. His findings will be sent to the Florida Supreme Court, which will decide the lawyers’ ultimate punishment.    A month earlier, Judge W. Douglas Baird found the lawyers Stephen Diaco, Robert Adams, and Adam Filhaut guilty of arranging the 2013 DUI arrest of opposing attorney C. Phillip Campbell to gain an advantage in a multimillion-dollar defamation lawsuit. Diaco, Adams, and Filhaut represented the defendant, a radio personality who was being sued by his rival for slander. Judge Baird placed most of the blame with Diaco, finding him guilty of almost twice as many professional violations as his colleagues, including lying to a judge regarding his cell phone provider. Diaco’s attorneys asked Judge Baird for leniency, pointing to Diaco’s years of charitable giving and the fact that he apologized…

New Blog on Forensics Launches this Week

A new blog by the name of Forensics Forum went live earlier this week. The brainchild of University of Virginia School of Law professor Brandon Garrett, Forensics Forum will cover forensic-centric news and current events, “including all forms of scientific evidence relevant in criminal cases, as well as new scientific research, policy developments, and legal developments in the area of forensic science,” says the site. Students at Virginia School of Law will be largely responsible for providing its content, while the overall blog will be managed by Garrett. According to the blog’s site, guest contributors will be featured in the future and comments and feedback from readers are welcome. The blog is funded in part by support from the National Institute of Standards and Technology Forensic Science Center of Excellence. Second Circuit Splits With Fifth Circuit Setting Up Possible Supreme Court Review: Are Internal Whistleblowers Protected Under Dodd-Frank?

On September 10, 2015, a divided panel of the Second Circuit issued an opinion in Berman v. Neo@Ogilvy LLC, No. 14-4626 (2nd Cir. Sept. 10, 2015), creating a split with the Fifth Circuit on an issue that has also divided lower federal courts: whether the anti-retaliation provisions in the Dodd-Frank Wall Street Reform and Consumer Protection Act apply to tipsters who claim retaliation after reporting internally, or only to those retaliated against after reporting information to the SEC.  The Second Circuit, granting Chevron deference to SEC interpretive guidance, held that Dodd-Frank protections apply to internal whistleblowers.  This stands in contrast to the Fifth Circuit’s holding in Asadi v. G.E. Energy (USA), LLC, 720 F.3d 620 (5th Cir. 2013), where that court found that on their face, the Dodd-Frank anti-retaliation provisions unambiguously limited protection to whistleblowers reporting to the SEC, and that, therefore, the SEC’s contrary guidance was…
