At long last, the Obama administration has reportedly notified both Congress and the UK government that Guantanamo detainee Shaker Aamer will be transferred home to the UK after 13 years. Shaker’s case has for years compelled the Amnesty movement, along with many others, to call loudly for him to be transferred back to the UK. So today’s news is, to say the least, heartening. But as we celebrate, let us not forget – there is much more to be done, and not much time left to do it. Justice is expensive.  This is a fact we need to understand.  But to understand it is not to say that taxpayers should put up with every expense some sorehead litigant can think of to create.And it's not death penalty litigation I'm talking about here.  It's the story of a Municipal judge in Cleveland who was suspended by the state Supreme Court for being an abusive, arrogant prig.  She's in a trial, of sorts, seeking to undo the suspension. There are some basic truths in the world of law and legal issues. First, the wheels of justice turn slow, but they do turn. Second, is that DHR and similar agencies around the country have a hard job. I for one am not a fan for DHR. This case is a perfect example of an overzealous agency taking children. Recently in San Franciso, a family won a verdict for more than $3 million. The police had seized a couple’s children without a warrant. The City of San Jose asked the court for a new trial because the city believed the jury did not receive correct jury instructions in the decision process. The court agreed and at the conclusion of the second trial, the jury awarded the family $210,000. The Ninth Circuit ruled that the court was correct in granting a second trial and the lower verdict.The case initiated and centered on a school teacher calling the Santa Clara County Department of Family and Children’s Services in May, 2005, about an 8-year-old student in her class.…

New Jersey Supreme Court Lowers Standards for Car Searches

This past week the New Jersey Supreme Court has reversed itself from its prior ruling imposing greater restrictions on law enforcement conducting searches of automobiles. In its 5-2 decision, the Supreme Court relaxed this prior precedent. Under the prior decision, authorities could conduct warrantless searches if “exigent circumstances” existed. An exigent circumstance is, in lawyer legalese, is an emergency or the need to act fast in order to preserve evidence. For example, if a police officer hears screaming like someone is in distress in home, the police officer on the street does not need to obtain a search warrant from a judge to enter the home; rather, the law provides that he can enter the home without the warrant due to the emergency, i.e. the woman screaming. The same logic has been applied to car searches up until last Thursday. A police officer could not search a vehicle, he pulled over or walked past unless the officer had the owner’s consent or…

At the Texas Tribune, Julie McCullough has an article titled "Dip in Texas prison population continues trend." In it, she uses numbers from the DOJ to say that:the state's prison population fell by more than 2,200 inmates, or 1.3 percent, between 2013 and 2014, according to new data from the U.S. Bureau of Justice Statistics. The decline was slightly larger than the national drop of one percent. When 2014 ended, 166,043 prisoners were in TDCJ custody, the lowest number since 2002. It was the state's fourth largest annual decline in more than 35 years. (The largest drop came in 2012, when the population fell by nearly 6,000 prisoners from 2011.) The small downward shift continues a trend that began in 2010, when the number of men and women held in Texas prisons peaked at 173,649.Those numbers differ from those in TDCJ Annual Statistical Reports (available here).  Here are the annual TDCJ "on hand" population totals as of Aug. 31…
