Nelda Williams, age 91, of Arbon, was traveling eastbound in a 2002 Chrysler Town and Country. Nelda's vehicle then stopped, reversed back down the Interstate in order to turn her vehicle around through the median. Monica Johnson, age 16, of American Falls, was traveling eastbound in a 1998 Nissan Sentra, when she saw Williams' vehicle in her lane and struck Williams' vehicle. One of the first decisions made in any criminal case involves setting bail.  In New Jersey state courts, the initial bail is frequently set by a municipal court judge.  This judge will decide if the defendant will be required to post bail or be released on their own recognizance.  If bail is required, the judge will set the required dollar, as well as related terms and conditions.   These will include, among other things, whether the defendant will be required to post the entire amount of the bail, be permitted to use a bondsman, or be allowed to post 10% of the face amount of the bail with the Court which will enable the defendant to avoid paying a fee to the bondsman and possibly allow for the recovery of the amount posted when the matter is concluded.  In some cases, the judge may determine that the defendant must post the entire bail on their own.  Generally speaking, municipal judges tend to set high bails.  If the defendant cannot afford…

The insufferable David Brooks is shocked, shocked to learn that his Republican Party has "abandoned traditional conservatism for right-wing radicalism." Where has he been?  This inexorable march to utter insanity -- from Nixon's southern strategy to Reagan's dog whistle politics to the more explicit Tea Party delusions to Trumpism -- has not been all that difficult to discern.  Brooks is upset because what thinks of as traditional conservatism -- "intellectual humility, a belief in steady, incremental change, a preference for reform rather than revolution, a respect for hierarchy, precedence, balance and order, and a tone of voice that is prudent, measured and responsible" is no longer the defining characteristic of Republicans.  Like so many other things, this treacly version of the Republican Party only exists in Brook's imagination.   As Paul Krugman, points out, "conservatism was…

In 1986 the New York Mets won it all: their division, the league championship, the World Series, and the entire City of New York.  This had as much to do with the success of the team that year as it did with the colorful personalities that made up the ’86 Mets.  I wasn’t quite the baseball fan back then that I am now so my memories of the ’86 Mets are fuzzy at best.  What I remember most about the team are the individual players — their names, positions, and on some level their quirks or trademarks.  Back then there wasn’t much in the way of cable television and most of the Met games were shown on network TV (it was Channel 9, WWOR, when I was watching) so even casual television watchers came to learn something about the Mets.  At school, I recall the teachers combining classes and wheeling in a TV so the kids could watch the Met games although I suspect it was more for the teachers than anyone else. Think about the public policy implications of the latest development in Minnesota’s DWI law debacle. Under the Implied Consent Law, a warrantless breath test is legal for DWI suspects, but breath tests only detect alcohol. The state needs urine or blood to test for other substances that cause impairment. We’re still waiting to see which way the wind blows on urine testing, but finally the Court of Appeals agrees with the Constitution: DWI blood tests require a warrant. I’m sure the alcohol lobby will get right on this and set things straight. Alan Newton, an Innocence Project client who was exonerated and released in 2006 after more than two decades in prison for a rape and robbery he did not commit, is speaking out in support of a bill which could help prevent false confessions and eyewitness misidentifications in New York, leading contributors to wrongful convictions in the state and nationwide. As highlighted recently in DNAinfo, bill S 5875 /A 8157 would require interrogations of suspects in violent felony cases to be videotaped. It would also require photo lineups to be double-blind, meaning that the administering officer does not know the suspect’s identity or cannot see which photo the eyewitness is viewing.  A double-blind line-up prevents the officer from signaling, intentionally or otherwise, to the eyewitness when shown the suspect’s photo. On October 3, 2015, Governor Jerry Brown Signed into Law, AB 1328, introduced by Shirley N. Weber (D-San Diego)-  Criminal procedure: withholding of evidence.  The California Attorneys for Criminal Justice sponsored the Bill.  The law is to address the increasing number of incidents of prosecutorial misconduct.  Specifically, this bill addresses discovery violations- not turning over evidence. The penultimate Supreme Court case, Brady v. Maryland, outlines the duties of a prosecutor in turning over “exculpatory” evidence to the defense.  However, this is not always done.  Specifically, Judge Goethals of Orange County Superior Court, dismissed the entire Orange County District Attorney's from prosecuting a murder case.  The Orange County Sheriff's Office, in conjunction and in corroboration with, the Orange County District Attorney's Office, did not disclose the full extent of their jail snitch program, including…
