Financier’s estate pays $4 million to settle False Claims Act case involving TARP

On October 16, the Department of Justice announced that it had reached a settlement of False Claims Act allegations brought against an Arkansas financier, Layton Stuart, and his estate and trusts. According to DOJ’s press release: The United States resolved for $4 million a False Claims Act action against the estate and trusts of the late Layton P. Stuart, former owner and president of One Financial Corporation, and its subsidiary, One Bank & Trust N.A., both based in Little Rock, Arkansas.  One Bank, another victim of Stuart’s frauds that is now under new management, will receive an additional $6.9 million. The United States’ complaint, filed earlier this year, alleged that Stuart and One Financial violated the False Claims Act by making false statements about the financial condition of One Financial and One Bank to induce the Department of the Treasury to invest Troubled Asset Relief Program (TARP) funds in One Financial. *   *  …

Here in Massachusetts, we've got a serious problem involving heroin use. A lot of deaths have resulted, and clearly, we need to address this problem. No one, including myself, disputes that. But you can rely on government to step in and largely botch the potential solutions to a given problem. Entirely unproductive efforts, misguided approaches and hundreds of billions of dollars of wasted taxpayer money have been the combined legacy of this country's utter and abject failure to address drug use that is harmful. Frequently, in my role as a Michigan driver's license restoration lawyer, I am called upon after someone has tried and lost a previous license appeal. Sometimes, the person will have tried on his or her own, while other times, some lawyer may have been at the helm. In this capacity, I work as a "fixer." Last week, I met with a new client who has used 2 different lawyers (well known names in the criminal/DUI world, but not regulars at license restoration cases) for each of her prior unsuccessful appeals. We spent more time than my usual 3 hours for our first meeting, and at one point, she looked at me, somewhat exasperated as we looked at the various details important to her case, and said of her prior attorneys, "We never went over any of this!" I was honestly somewhat embarrassed (for them, of course) and, to soothe her emotions, replied that they probably didn't know to get into this much detail because I spend most of every day on license…

The Dallas Morning News recently published an interview with Christopher Scott who was exonerated in Dallas in 2009. In the interview, Scott, who was cleared of a 1997 capital murder conviction, speaks about Freedom Fighters, the documentary which is wrapping up production and is scheduled to be released next year. The film follows Scott and other Texas-based exonerees who work with him at House of Renewed Hope, the organization that Scott founded to investigate cases of other wrongfully convicted people. Last year, the Innocence Blog interviewed Scott about the film project, about his case and about his life’s work post exoneration. Officer Killed by Injured Suspect in Hospital:  A sheriff's deputy of a small Minnesota town was killed early Sunday at a St. Cloud Hospital when an injured suspect being treated there grabbed his gun and shot him.  Fox News reports that 60-year-old Steven Martin Sandberg of the Aitkin County Sheriff's Department was asked by the hospital to monitor 50-year-old Danny Leroy Hammond, a suspect charged with kidnapping, assault and terroristic threats against his wife and being treated for an undisclosed condition at the hospital.  A struggle ensued between Sandberg and Hammond, who was not handcuffed, and several shots were fired before security guards entered and subdued Hammond with a Taser.  Hammond became unresponsive and died after being taken into custody.  Sandberg had been with the sheriff's department since 1981.
