Johanna LohmanMy activistPyotr Pavlensky is a thirty-one year Russian performance artist and political activist. He studied at the St. Petersburg Art and Industry Academy. He has gained worldwide attention in the last three years for his outrageous public performances, which usually involve some type of self-mutilation. The performances are intended to draw attention to political conditions in Russia. Each one is carefully planned and executed in public spaces with Pavlensky usually releasing statements of explanation after the fact. He has been arrested on multiple occasions for hooliganism and is currently in custody for vandalism after setting fire to a prominent government building.Pavlensky has carried out six major performances since 2012, each in protest to specific government actions.  His first well-known performance, entitled Seam, was carried out in May 2012. Under international media scrutiny and political pressure Utah judge Scott Johansen reversed his recent decision to remove a 9-month old foster child from the home of  April Hoagland and Beckie Peirce, a married lesbian couple in Price, Utah. Ms. Hoagland and Ms. Pierce had fostered the baby for three months and expected to adopt the child. They had the approval and consent of the child’s mother and the local department of child welfare. During the initial hearing when Judge Johansen ordered the child welfare authorities to remove the child within seven days, he  remarked that he had read literature stating that children were better off being raised in a home with a mother and a father. Are Ohio’s DUI/OVI Marijuana Laws Constitutional?

Issue 3 went up in smoke last week, so it’s still illegal to use marijuana in Ohio.  It’s also illegal to operate a vehicle under the influence of marijuana or with a prohibited level of marijuana metabolite in one’s urine.  The last article in this blog addressed the duration of marijuana’s effects and the duration of marijuana’s detectability.  The conclusion was marijuana effects last for two hours to five hours, but marijuana metabolites are detectable in urine for up to five weeks.  With that backdrop, this article discusses whether Ohio’s DUI/OVI marijuana laws are Constitutional. The part of Ohio’s OVI law with the most significant Constitutional problem is the part which prohibits driving with marijuana metabolites in one’s urine.  Ohio Revised Code section 4511.19(A)(1)(j)(viii)(II) says no person shall operate a vehicle with a concentration of at least thirty-five nanograms of marihuana…
