Daniel Paiz, 59, of Twin Falls, was driving westbound in a snowplow, plowing the lane. Scott Leven, 55, of Logan, Utah, was driving westbound in a 2014 Kenworth Semi. The semi struck the rear of the snowplow. Both drivers were wearing seatbelts and were not transported. The lane was partially blocked for an hour approximately an hour while crews worked to remove the vehicles. The crash is under investigation by the Idaho State Police. HG/JW…

In Florida, an owner of property has strong constitutional privacy rights in his/her property. This means that, with few exceptions, the police cannot enter to search that property with consent from the homeowner or a valid search warrant. If the police knock on a property owner's door and request to search the property, the owner has every right to refuse. This right to privacy generally does not change when the property owner takes in a roommate or tenant. It generally does not change when the owner leases the property entirely to someone. However, it depends on the circumstances. The general idea is that if the law recognizes that the owner had a reasonable expectation of privacy in the property, even if it is leased to someone else, the owner maintains his/her privacy rights in that property with respect to the state. Endangering the Welfare of a Child, New York Penal Law 260.10, may not be the most serious offense in New York’s criminal code, but it is a crime that is horrifically stigmatizing and one that carries up to one year in jail upon conviction. There is no way around it. An accusation of Endangering the Welfare of a Child cannot be ignored or brushed aside. It is bad enough if the child is not your own, but if the minor is your son or daughter you should expect that either the Administration for Children Service (ACS) or Children Protective Services (CPS) will be knocking on your door to open their own parallel investigation. Simply, when an allegation is untrue or there is a misunderstanding, the consequences of an Endangering the Welfare arrest will not merely go away. Most Gun Control Policies Ineffective, Study Finds:  A report published earlier this month suggested that the policies proposed by gun control activists over the years are ineffective, concluding that "regulating firearms was less important than focusing on who possesses those firearms."  Stephen Gutowski of the Washington Free Beacon reports that the study, authored by David Kopel and published Dec. 1 by the Cato Institute, analyzed real-world examples of universal background checks, bans on high-capacity magazines, and  bans on assault weapons in the U.S. and internationally to determine their effectiveness, finding that improved access to mental health care "would likely have the biggest impact on preventing both mass shootings and everyday violent crime."  Kopel notes that approximately one-fifth of U.S. homicides are committed by individuals with severe mental illness, so rather than infringe on the constitutional rights of…

Mr. Lowe’s client was a college student at a hotel party in Richardson, Texas with underage students drinking alcohol.  When Richardson police arrived to breakup the underage drinking at the party, Richardson police requested to see the client’s Identification. There is no credible doubt that crime has fallen dramatically in the last generation, because of increased use of incarceration, more police, more aggressive and proactive policing, the aging of the most crime-prone component of the population, and probably several other factors.  But even given this welcome fact, we have vastly more crime than gets reported.The crime figures I have been using (and almost all other bloggers and academics use) are taken from the Uniform Crime Reports compiled by the FBI.  That source, however, gives only reported crimes.  The number of unreported crimes is staggering. As you can see from the chart below derived from the BJS National Crime Victimization Survey (see here), almost all types of crime are massively under-reported.  The chart shows that theft  -- perhaps the most common crime  --  is under-reported by over 70%; rape and sexual assault by about 65%; simple assault by 60%; burglary by just over…

Eustis Man Receives 37 Years in Prison for Sexually Exploiting Kids

A Eustis man has been sentenced to more 37 years in federal prison for sexually exploiting children and producing and receiving child porn. The 52-year-old was also ordered by the court to pay $2,020 restitution to the victims. According to the Department of Justice Middle District of Florida: As early as 2005, the man hid video cameras in the bathrooms of his residence so he could take pictures of four minors in his custody. In 2014, he sexually assaulted another minor in his custody and recorded the abuse with his computer. He also collected and sent hundreds of pictures depicting sexual abuse and exploitation of minors from at least 2008 to the day before his arrest on Feb. 17, 2015. This case was brought as part of Project Safe Childhood, a nationwide initiative launched in May 2006 by the Department of Justice to combat child sexual exploitation and abuse.
