You may have been expecting to see this kind of story during our current presidential race theatrics. Sometimes, though, national political temperament is reflected by local political temperament. I am referring to a new Massachusetts assault case pending in Holyoke. It is a case now scheduled for a trail for April 4th. The former mayor of Chicopee, Michael Bissonnette (hereinafter, the “Defendant”) is charged with attacking Police Lt. John Pronovost on September 8th at a city polling location. Apparently, the dispute started when the officer asked the Defendant, who was seeking re-election, to remove a campaign sticker, believing he was in violation of a law that bars campaigning too close to a voting site. The men got into a shouting match and insulted each other. According to the Boston Herald the debate ended up with the Defendant facing four criminal charges including assaulting a police officer and disorderly conduct. The Defendant’s attorney admits…

Domestic Violence Arrest Follows Wife’s Gas-Triggered Attack

Last month, a Florida woman was arrested for Domestic Battery when she attached her husband… for passing gas in bed.  According to huffingtonpost.com, a Florida woman was so offended by her husband passing gas during the wee hours of the morning, that she elbowed him and then, literally “kicked him out” of bed.  The husband waited for things to calm down a bit before returning to bed.  A second gas-passing episode landed him in more hot water and resulted in more elbows and kicking.  The police were eventually called, and the wife, 55 year old Dawn Meikle was arrested. Although no injuries were reported in this incident, Florida criminal defense lawyers can tell you that domestic violence is taken very seriously.  Florida Statute 741.28 defines domestic violence as “any assault, aggravated assault, battery, aggravated battery, sexual assault, sexual battery, stalking, aggravated stalking, kidnapping, false imprisonment, or any…

Locked Up for Being Sick: Mentally Ill Man Sentenced 8 Years in Federal Prison for Firearms Violations

There’s no question that Des Moines, Iowa resident David Anthony Tumea had serious mental health problems in 2012.   There is also no question that Tumea had a bizarre proclivity for collecting, making, and possessing anything that could be used as a weapon.   Obsession with Weapons   In 2002, Tumea was convicted for the possession of an unregistered firearm. As part of that investigation, the police discovered that he possessed, according to a January 14, 2016 decision by the Eighth Circuit Court of Appeals, “books about evasion and making weapons, a handgun with ammunition, a blowgun with darts, two spiked instruments that could attach to one’s wrists, nunchucks, a nearly seven-inch knife, a seven-foot length of fuse, and homemade weapons including C-4, napalm, and a shotgun.”   This collection of weapons whose purpose, considered collectively along with other factors discussed in the case, certainly demonstrate that Tumea had…

Writing a prescription in another person's name is a fraudulent prescription. When that visit or prescription in the other person's name is billed to Medicare or insurance, then there is also health care fraud. When a Schedule II drug is involved, there is also a potential drug count. On January 15, 2016,  Dr. John Terry and Stephen Heffner, Jr. pleaded guilty before Chief United States District Court Judge Christopher C. Conner in Williamsport, Pennsylvania.According to the plea agreement, in April 2013, Dr. Terry caused Medicare to be billed for fraudulent prescriptions intended for Mr. Heffner knowing that Mr. Heffner was not his patient and that the Oxycodone was not actually intended for Mr. Heffner but for Dr. Terry’s patient, David Hatch of New York.  Medicare paid for the prescription received by Mr. Heffner but actually delivered to Mr. Hatch. It was also alleged that Dr. Terry also provided prescriptions for Oxycodone and other narcotics to…

Fraud Case Draws Attention to Prosecutors’ Failure to Disclose Favorable Evidence

Most people have not heard of the former Toronto broker George Georgiou who was convicted in February 2010 on one count of conspiracy, four counts of securities fraud and four counts of wire fraud in federal court and sentenced to 25 years in prison.   Georgiou’s fraud scheme cost investors more than $55 million, prompting the federal court to attach a $55.5 million restitution order to Georgiou’s sentence.   Failure to Disclose Evidence of Witness Credibility   The case probably would have drifted into legal oblivion had it not been for serious prosecutorial misconduct associated with Georgiou’s conviction.   The key witness against Georgiou at his trial was a former business partner and alleged co-conspirator named Kevin Waltzer. The co-conspirator’s testimony was critical: it not only corroborated the Government’s evidence but it was the structure needed by prosecutors to show, as they had a constitutional burden to do, that…
