Senior Court Clerks Jackie Oates and Anthony Dorsey (middle) with our BCS internsThe following post was written by Bronx Community Solutions' Compliance Coordinator, Lovis Nelson-Williams.  Among the many hats she wears, Lovis organizes a quarterly "Career Talk", an opportunity for BCS interns to learn about the many career opportunities within our court system.   “Upward mobility”, “job security” and “lifelong friendships”.  These are key words used by Senior Court Clerks Jackie Oates and Anthony Dorsey to describe working for the New York Unified Court System.  Ms. Oates and Mr. Dorsey were invited to speak with Bronx Community Solutions’ interns as part of a quarterly career talk hosted by BCS.  The two clerks provided an overview of how they came into their careers and insight into their role in the courts.  Oates and Dorsey have both previously worked in the private sector and were…

Some drivers install dash cameras in their cars. It is a useful device to have. It is not costly to buy one. At the same time, a dash camera can save you a lot of money. It will definitely help you if you get into the accident. For example, it will be easier for you to prove that you stopped at the red light when another driver claims that you did not. However, are dash cameras Illegal to mount? There are specific rules that regulate where a driver can mount those cameras. In Iowa, you cannot mount a camera on a windshield. Pursuant to 321.438 of the Iowa Code, a person shall not drive a motor vehicle equipped with a windshield that do not permit clear vision. Many other states have similar laws. For example, in Illinois, no person shall drive a motor vehicle with any objects placed or suspended between the driver and the front windshield, rear window, side wings or side windows immediately adjacent to each side of the driver, which materially obstructs the driver’s view.…

  In recent years, technical tools that can record a cop’s every act have shined a bright light on police abuses. This is especially true now with the ubiquitous dashcams attached to almost every police cruiser in the nation. Apparently some cops don’t like this. As the police have become increasingly scrutinized by the public eye, their dash cams have become increasingly “broken.” In Chicago, over 80% of the dash cams are not working properly and this isn’t a case of a lot of faulty equipment. Chicago police officials acknowledge that Chicago police are sabotaging the equipment! Reports include batteries being pulled out of the units, antennas broken or removed, and dashcam microphones missing. But, after all, it’s Chicago. Well, it’s not just Chicago.   Did this Napa school bus driver take a wine tasting detour? A school bus driver in Napa was recently arrested for driving under the influence after she damaged the undercarriage of her bus with 28 students on board. Fortunately, none of the students were injured. As hard as it is to believe that a school bus driver would be driving under the influence, this Napa driver is not the only one. The same week the Napa driver was arrested, another bus driver was arrested for driving under the influence of prescription drugs in Boulder County, Colorado after she lost control of her bus, which resulted in the serious injury to two of the eight children on board. A month before these two incidents, a school bus driver in Lincoln Rhode Island stumbled off her bus after having driven students from school. She was arrested for drunk driving. And yet another school bus driver in Stroudsburg Pennsylvania was arrested for DUI after scaring the children on her bus by her erratic driving.…

In Illinois, you can be charged with theft of stolen property if you obtained control over stolen property knowing it to have been stolen, or under such circumstances as would reasonably induce you to believe that the property was stolen. (See 720 ILCS 5/16-1(a)(4), Illinois Theft Statute.) As with most crimes, the state must prove you guilty of all the elements of the crime beyond a reasonable doubt. A recent Illinois appellate case overturned a defendant’s conviction because the state failed to do just that. In People v Netisingha, undercover officers sold Target merchandise to the defendant. Although the defendant believed the merchandise was stolen, in fact, it was not. Thus, the state failed to prove the first element of the crime. This does not mean that if you bought property from an undercover cop, you are in the clear. After reportedly plowing into seven vehicles at a Boynton Beach intersection, the driver of a pickup reportedly failed a number of field sobriety tests. He was arrested by police for DUI and driving on a suspended license.  James Dean Martin, a 47-year-old from Delray Beach, was hauled out of his pickup truck by several people at the scene shortly before 4 p.m. on a Saturday and held on the ground until police got there, according to The Sun-Sentinel. An 18-year-old woman who had recently purchased a new car told a reporter he approached a line of vehicles waiting at the intersection traveling, “probably like, 50, 70 mph and he just bumped each car.” No one was injured, but the teen said she was shaken up because there were children in other vehicles and her brand new vehicle was damaged.  Martin is facing a serious situation, to be sure, but he is fortunate that no one was hurt. When a search of his clothing produced nothing, officers could then make him remove his clothes to search underneath them. Drugs were hidden in his buttocks. State v. Collins, 2016 N.C. App. LEXIS 138 (Feb. 2, 2016). USMJ’s recommended denial of a motion to suppress a cell phone for lack of standing is remanded back for a hearing. United States v. Mobely, 2016 U.S. Dist. LEXIS 11936 (N.D.Ga. Feb. 2, 2016).* Defendant consented to a search of his bag in the baggage compartment of a Greyhound bus at the Albuquerque station. He contended that the DEA officer conducted an illegal tactile search by feeling the bag for its contents before seeking consent (as in Bond v.
