Jubilación AFP  vs  ONP (V parte) Este será el más extenso de mis comentarios sobre el tema, pido por favor que antes  lean con atención la entrevista que un buen amigo colgó en Internet, sobre ella y la desconfianza en el sector privado comentaré. Entrevista publicada por el Sr. Giovanni Cerín en Facebook ¿Cuándo aprenderemos....??? por Eugenio D´medina Los rumores de salida del ministro Luis Miguel Castilla sumados al intento del Gobierno por retomar la actividad empresarial del Estado y el soterrado intento de instaurar la reelección conyugal generan el temor de que la vuelta a la "Gran Transformación" no está muy lejana. Eugenio D'Medina, economista, politólogo y director de la Escuela de Posgrado de la Universidad Wiener, quien acaba de publicar un libro sobre la viabilidad del liberalismo en América Latina, nos alcanza sus reflexiones sobre esta situación. Correo: Dejando de lado aspectos legales, ¿qué opina de la reciente oferta de Petroperú para comprar los activos de Repsol (La Pampilla y grifos)? Eugenio D' Medina: Como economista debo decir que estamos ante un reverdecer de un modelo económico caduco, a pesar del apogeo que pueda tener en los países de la órbita chavista. Y esto revela una desconfianza hacia el sector privado. En lo político, me hace recordar al presidente Humala diciendo "nosotros hemos iniciado la Gran Transformación". Estoy percibiendo que luego de 18 meses de enamorar a los empresarios, hay un giro hacia el plan inicial. Puede tener que ver con la fortaleza que está alcanzando en las encuestas y que lo independiza de apoyos como los de los "garantes" Vargas Llosa y Toledo. C: ¿Ya no necesita padrinos? ED: Puede estar haciendo ese cálculo. Lo que pasa es que se ha conseguido una buena madrina en su esposa. De hecho, Nadine debe ser más conocida que Vargas Llosa o su hijo. Todo esto revela que nunca hubo el famoso "giro a la derecha" de Humala. C: Uno de los argumentos del ministro de Energía es que quieren ampliar la red de grifos de Petroperú para "controlar" que los precios de los combustibles no se disparen. ED: ¿Una intervención "romántica" del Estado en beneficio del consumidor? ¡Pamplinas! Eso se puede manejar de muchas otras maneras. La privatización de los grifos en los 90, junto con la de la CPT fue el signo más claro de la modernidad del mercado frente al viejo orden de una economía planificada que comenzó con Juan Velasco y se mantuvo durante los 80. Pero más preocupante que ver al Estado embarcarse en un mal negocio es este sesgo de cambio en la política... C: Que es justo el tema de su reciente libro "El Hilo Conductor". ¿Por qué, a pesar de los evidentes signos de desarrollo y bienestar que trae la aplicación de políticas liberales, esta no cala en la gente? ED: Esa es la pregunta clave y lo que dice se hace patente cuando la gente le exige al Estado que le suministre agua y desagüe en lugar de demandar la privatización; o cuando se apoya una iniciativa como la del Servicio Militar Obligatorio. No hay un trasvase hacia las ideas, no cala el mensaje. La respuesta que encontré en mi investigación es que carecemos de un entramado de confianza. C: ¿Confianza en qué? ED: En absolutamente todo. La gente desconfía del Estado, pero también del sector privado y hasta del colega de trabajo. Una democracia liberal requiere de un compromiso político por mantener una economía de mercado sana y vigorosa. Cuando eso no sucede, se genera un conflicto social y cuando este llega a un nivel demasiado fuerte, se rompe el vínculo entre la democracia liberal y la base social que la sostiene y la gente comienza a optar por regímenes totalitarios o autocráticos, como sucede en Venezuela o Argentina. Eso termina por borrar el discurso liberal y por eso nunca terminamos de despegar. Por eso, en el Perú, seguimos estancados en las reformas de primera generación. No podemos privatizar el agua o la educación. C: ¿Nuestra democracia es débil? ED: Un pilar de una democracia liberal es un sistema judicial sólido y creíble. Otro es la división de poderes. Otro es la verdadera libertad de expresión, que solo se puede dar en una sociedad abierta. ¿Lo somos? No lo creo. Aquí el trabajador no puede discrepar con su jefe, el alumno no puede hacerlo con el maestro, el Primer Ministro no puede discrepar con la Primera Dama. La mejor política es quedarse callado. Somos una sociedad cerrada. Aquí hemos implantado la toma de carreteras como mecanismo extrainstitucional para solucionar conflictos y cuando se quiere utilizar un mecanismo de la democracia como la revocatoria nos dicen que atentamos contra la institucionalidad. El actual debate sobre la "reelección conyugal" nos desnuda como un país de letra chica. Se llega al poder con unas reglas de juego y luego se saca una interpretación conveniente para saltarse las normas. Eso mella la democracia porque afecta la confianza. Los argentinos celebran más el primer gol de Maradona a Inglaterra en 1986, ese que hizo con la mano, que el segundo, que es el mejor gol de la historia de los mundiales porque en su mentalidad, que es la nuestra, la pillería y la sacada de vuelta es un valor. En cambio en Inglaterra, una casa de apuestas le pagó tanto a los que apostaron por el triunfo de Argentina como por el empate. Perdieron dinero, pero eso responde a otro tipo de cultura. Nuestras democracias son solo forma y no sustancia. C: En su libro sostiene que nuestra sociedad solo ha desarrollado pobladores y no ciudadanos. ¿Podría explicar mejor estas categorías? ED: Un poblador es alguien con DNI. La ciudadanía te la da tu capacidad de interesarte por los problemas de la polis, del país. Eso se vio claramente en la revocatoria donde el "No" triunfó porque muchos prefirieron "evitarse la molestia" de tener que votar nuevamente. Y eso te demuestra que puedes encontrar pobladores tanto en La Planicie como en los conos. El ciudadano defiende sus derechos pero también se pone a pensar en qué esperan los demás de él: que no orine en la calle, que no pinte paredes, que no me estacione en la vereda, que no abandone a mis hijos, etc. Son los ciudadanos los que sostienen las democracias liberales. C: ¿Y los liberales tienen responsabilidad en esta situación? ED: Muchísima. Aquí se conforman con pontificar sobre los valores de la libertad, pero poco se preocupan por inculcarle a la gente que es la libertad la que les ha permitido progresar; que no deben reclamar más Estado sino más libertad. Por eso mi libro lo dedico a los liberales que todavía no saben que lo son, porque con los otros es muy difícil construir propuestas políticas. La gente más pobre es a la que el Estado más le arrebata. C: ¿Y por qué la gente reclama siempre más Estado? ED: Porque hemos sido educados bajo patrones de desconfianza hacia lo privado. Nuestra educación, pública o privada, está infestada del pensamiento socialista. Aunque estudies en el Markham o la Pacífico. Se nos enseña que la riqueza es mala y que la pobreza es un valor en sí mismo. (el resaltado me corresponde). MI OPINIÓN ¿Se han preguntado por qué las pensiones de la ONP no se han aumentado en doce años, doce años de crecimiento sostenido? Una de las razones y que la mayoría estima más importante, es que la ONP está quebrada, que en el pasado fue la Caja chica de los gobernantes de turno y que no es posible que se siga manteniendo una institución ineficiente. Nadie repara que la crisis por la que atraviesa esta institución no sólo obedece a tales factores, sino a nuestra perversa economía, incapaz de fiscalizar el crecimiento desproporcionado de las “mype” que dan trabajo en condiciones sub humanas a millones de trabajadores sin derecho alguno, que la ley de creación del Sistema Privado de Pensiones favorece abiertamente a las AFP y que la voz de algunos “economistas” tratan de liquidar de una vez por todas. Cada día que pasa amigos, son menos los aportantes a la ONP y mayor el número de jubilados que atender, INCLUYENDO a los pensionistas de las AFP que perciben “Pensión Mínima con garantía Estatal”, es decir, el Estado no sólo subvenciona a la ONP, también a las AFP y con nuestro dinero en ambos casos. Corolario, mes a mes se reducen los fondos de la ONP para cubrir las  pensiones de sus jubilados, en este escenario no es posible, “prima facie” avisorar mejora alguna y su desaparición es una cuestión de tiempo. Un economista que trabaja para hacer más ricos a los ricos, recomendó ¡que se aumenten los descuentos al trabajador que cotiza o podría cotizar a la ONP para evitar afiliaciones a este sistema!. Recientemente se ha dictado una ley para incorporar a los independientes al Sistema Privado de Pensiones, con la condición de que sean menores de 40 años, les dan la alternativa de elegir, sin embargo, NO existe de parte del Estado, que no sea la distorsión que el ciudadano tiene de la ONP, difusión de lo importante que es mantenerla, reflotarla y reformular toda su política de atención e inversiones.  El fondo común es negativo –dicen los inversores de las AFP- ¡tú eres dueño de tú dinero y quién debe fijar su pensión!. Desde este humilde blog, invoco a todos los que estén por decidir a cual sistema desean incorporarse NO lo hagan a las AFP bajo ninguna circunstancia, parte de las razones están expuestas en las anteriores entradas. Ahora, respondamos la pregunta, ¿Por qué el Estado desde hace doce años no aumenta las pensiones que otorga la ONP? 1.-Por qué al hacerlo no sólo debe aumentar las del Sistema Público sino también las que, bajo el título de “Pensión Mínima con garantía Estatal” pagan las AFP. 2.- Porque al hacerlo se atenta contra los inversores de las AFP que lo único que pretenden es que la ONP desaparezca. 3.- Porque se verían OBLIGADOS  a reformular sus planteamientos, productos y coberturas, hoy en día es un atentado a la vida que paguen una “pensión preliminar” de S/. 150.00 (lean las anteriores entradas y entérense) ¡la tercera parte de lo que abona la ONP!, ¿se imaginan si el Estado subiera la pensión mínima del Sistema Público a la Remuneración Mínima Vital? El artículo que han leído tiene algunas conclusiones que necesariamente debo comentar –todas están resaltadas- veamos: a.- ¿Confianza en qué?     ED: En absolutamente todo. ¿Confianza? He aquí un tema interesante y lo que sucede en las AFP lo ilustra de manera concluyente; Su dinero o digo mejor el dinero que el empleador le descuenta mes a mes de su remuneración es depositado en las arcas de las AFP para que sea invertido y generen la rentabilidad necesaria que le asegure una vejez con dignidad; pregunta: ¿Sabe usted como invierten su dinero?, ¿Han nombrado las AFP los Directores independientes que deben formar parte de su estructura orgánica, cumpliendo con el mandato de la Ley N° 29903?, ¿sabe usted que los fondos tipo 2 y 3 son de alto riesgo y que si pierden sólo pierden ustedes y las AFP a lo mucho dejan de ganar?, ¿sabía usted que en la Ley de creación de las AFP no existían estos “fondos”?. ¿Sabe usted en que invierten y porqué la crisis mundial las ha afectado?: Pongamos un ejemplo: La situación política (Corea del Norte digamos), para no hablar de la económica que tiene al borde del colapso a la Zona Euro, podría generar otra crisis económica global, si, por su puesto, seguramente pensarán y las inversiones se perderán y con ello al traste con mi dinero depositado religiosamente mes a mes en las AFP; Seguro estoy que no se han preguntado que existen inversiones que, en lugar de perder en una posible crisis económica como consecuencia de la política,  obtendrán grandes beneficios, entre ellas las realizadas en minería (todos los metales necesarios para la industria militar crecerán de manera exponencial o la industria de los alimentos y las textiles entre otras), pero las AFP les dirán que perdieron ¿Quién controla la desaparición de cientos de millones de Dólares?, ¿La SBS?, no sé ustedes juzguen. ¿Es una cuestión de confianza  o de experiencias?. b.- No podemos privatizar el agua o la educación. Bueno, la privatización de la Educación ¿Es un chiste?, se han fijado los innumerables centros de enseñanza que se han constituido a lo largo y ancho de toda la Nación ¡en todos los niveles educativos! cada cual peor que el anterior. ¿Privatizar el agua?, el futuro y las guerras serán ¡por el agua! Están explorando caminos no les quepa duda. c.- Nuestras democracias son solo forma y no sustancia. Es decir y convengo en ello, NO existe democracia que no sea el uso del poder. d.- La gente más pobre es a la que el Estado más le arrebata. No, señores, el Estado ha enquistado en el pueblo la ¡ayuda social!, el mayor cáncer de una Nación, la destruye lentamente pero sin pausa, haciendo más ricos a los ricos y miserables a los pobres. Naturalmente el entrevistado ve  así las cosas, desde que las personas (no siempre las que necesitan, porque el Estado ha inculcado al pobre que debe vivir sin trabajar) invaden, crean caos, desorden, atropellan la propiedad privada y luego piden vivir como seres humanos y las pruebas están en todo Lima. e.- Se nos enseña que la riqueza es mala y que la pobreza es un valor en sí mismo. Bueno esta es una torpe, absurda e interesada conclusión, la riqueza no es mala, por Dios, ¿Cómo podría serlo?, lo malo, lo absurdo, lo terrorista es su pésima distribución. Les propongo un ejercicio mental, el Gobierno decide que las AFP salgan del Mercado, los cien mil millones que conservan en sus  arcas pasen a incrementar el fondo de la ONP, que se aumente la pensión mínima al nivel de la Remuneración Mínima Vital, que la Pensión Máxima, como es en la actualidad, sea el doble de la mínima, que las inversiones de esos cien mil millones las realice el Estado en Bonos del Tesoro de las Economías más estables del Mundo, que invierta en infraestructura a Nivel Nacional que tengan como condición su reversión al Estado mediante impuesto por el uso de esas infraestructuras, un cambio total para beneficio del País. ¿Aparecería en el Perú otro señor Capriles?. ¿Si el Gobierno retira del Mercado a instituciones que sólo buscan su propio beneficio estaría actuando como Socialista? ¡Confianza es la palabra!, sino confiamos ¡lo eliminamos y, muerto el perro se acabó la rabia!.

Lansing Woman to Stand Trial on Charge of Assault With a Dangerous Weapon in Slashing of Acquaintance

On Thursday April 11, 26-year-old Pamela King was bound over to circuit court by Lansing District Judge Hugh Clarke on a charge of felonious assault, also known as assault with a dangerous weapon. King allegedly slashed an acquaintance in the course of an argument on March 31 of this year. According to news articles at Mlive.com, King and the alleged victim who is 23 years old became involved in an argument inside the apartment where King lives; as the victim was attempting to leave, King allegedly slashed the back of the woman's neck. When police arrived, the alleged victim was in the parking lot of the apartment complex. Lansing police arrested King inside her apartment located in the 500 block of W. Saginaw St. On April 1 King posted $1,875 bond according to court records. She was prohibited from having any contact with the alleged victim, and also from using controlled substances or alcohol; she is required to submit to random urine testing. King's alleged victim was hospitalized with injuries which were determined to be non life-threatening. Michigan felonious assault attorneys understand the seriousness of these types of charges. According to the Michigan Penal Code 750.82, an individual convicted on a charge of assault with a dangerous weapon may face penalties which include fines of up to $2,000 and up to four years in prison. The penalties may be even more severe if the assault was committed in a school area.

Ypsilanti Man Convicted of Sexual Assault in March Faces Additional Charges

On March 15, 76-year-old Dervin Mood was convicted by an Oakland County jury on a charge of third-degree criminal sexual conduct; Mood was on federal probation for child pornography at the time. Now it has been revealed in a news article at AnnArbor.com that Mood will go on trial for five charges of CSC in Washtenaw County. These charges stem from incidents which allegedly occurred at his home in Ypsilanti. The criminal sexual conduct charges against Mood in both Oakland and Washtenaw County are related to the same victim. News articles state that the man has mental health issues, including Asperger's syndrome. He was assaulted by Mood according to prosecutors at the age of `12, 15, 16, and 19 in a time period that spanned from 2003 to 2011. Mood is a former child care provider and school teacher who was on federal probation for possessing child pornography when charged with CSC in Washtenaw County. Oakland County Prosecutor Jessica Cooper stated in news articles regarding last month's conviction that Mood would likely be sentenced to 51 to 106 months in prison. Now, Mood will again go on trial in Washtenaw County; his trial date is scheduled for April 29. While it wasn't revealed how the current allegations would affect Mood's federal probation, Cooper said it was bound to in some way. The federal charges were related to child pornography found on Mood's computer, along with diary entries and recordings. Whether for first-, second-, or third-degree criminal sexual conduct, Michigan sex crime attorneys know the penalties are harsh - and the damage done to the accused individual's future and reputation cannot be undone. Being required to register as a sex offender is perhaps the worst penalty of all, as the consequences can last a lifetime. Show Me The Warrant In (some) DUI Blood Cases

U.S. Supreme Court filed Missouri v. McNeely today, refusing to recognize a categorical exception to the warrant requirement in DUI cases where the police order a person's blood drawn against his or her will. Drawing a person's blood is a search described by the Court as a compelled physical intrusion beneath one's skin into one's veins to obtain a sample of blood for use in a criminal investigation. While the natural dissipation of alcohol may allow blood to be drawn without a warrant in a specific case, whether a warrantless blood test of a drunk driving suspect is reasonable under the Fourth Amendment must be determined case by case on the totality of the circumstances.The court explained the importance of requiring authorization from a "neutral and detached magistrate" before allowing a cop to invade another's body in search of evidence is indisputable and great. In those drunk driving investigations where police officers can reasonably obtain a warrant before a blood sample can be drawn without significantly undermining the efficacy of the search, the Fourth Amendment mandates that they do.

If you tried to design a Los Angeles petty theft crime that would make you look like a classic “bad guy,” you'd have a hard time beating this guy. cookie-theft-in-los-angeles.jpg According to NBC Los Angeles, a skateboarder recently stole over $400 worth of cookie money from a local Girl Scout troop that had been stationed outside a grocery store in San Bernardino County. Deputies later stopped and arrested 20-year-old Colin Sawyer, after they saw footage of the theft on NBC4 news. Girl Scout troop 1303 had been selling cookies outside of a Stater Brothers store in Phelan all day. They were folding up for the day, when the thief snatched their money and took off. A young Girl Scout, who gave her name as Victoria, ran after him. But she fell and got scraped up. She told reporters “My sister put the money on the table, and as fast as he can, he took the money and ran off… my first instinct was to run after him.” A local restaurant gave Girl Scout Troop 1303 20% of their profits to make up for the lost cookie revenue. Since Sawyer allegedly stole over $460 worth of cash, he will likely face a more serious Los Angeles theft charge – not a petty theft charge. Even if he had “only” taken $100 worth of cash from the Girl Scouts, he'd still be in legal hot water. Even a minor misdemeanor theft conviction can complicate your life. Not only will you have to pay restitution, serve community service, and so forth – and in some cases jail time! – but prosecutors can really bring the hammer down on you if/when you get arrested again. For instance, if you collect two misdemeanor theft charges separated by a few years, prosecutors can elevate your second charge to a felony and get you thrown in jail for over a year. Convicted felons lose important rights (such as voting rights), and they may suffer thousands of dollars worth of indirect costs and inconveniences over a lifetime -- e.g. increased difficulty getting loans, renting a place to live, et cetera. Although this blog focuses on Long Beach DUI cases, we’ve been covering a surprisingly sizable number of cases out of the Big Sky State of Montana recently. long-beach-dui-trumaine.jpg To wit, The Associated Press is reporting that Trumaine Johnson, a cornerback with the St. Louis Rams, got arrested for a misdemeanor DUI, after police saw him driving without his headlights. Like many Long Beach DUI defendants do, he refused a breath test. Police booked him into jail. He later secured his released on a $700 bond. The former University of Montana star had a great first year with the Rams, racking up 31 tackles and 2 interceptions as a first year player. Not bad. Obviously, without knowing any more details, we can only speculate on what happened -- why he got the DUI. Perhaps, for instance, he would have passed the breath test had he chosen to take it. As we’ve reported in multiple posts, DUI breath tests are surprisingly unreliable – in both directions. For instance, if you exhale very lightly into a machine -- or if the machine isn’t calibrated -- you can blow a negative, when really you're technically positive for Long Beach DUI. On the other hand, if you blow a very deep breath -- or if you're on an intense ketogenic diet, or if you have diabetes -- you can easily blow a false positive. Call it mercy or grace.  Call it generosity of spirit if you're made uncomfortable by the seemingly religious sound of those words.  (This atheist isn't.  I believe deeply in mercy and in grace.)Whatever the name, the idea is that like all gifts, it reveals the giver.So it is, as I've said repeatedly, for clemency.  Do we open our hearts and offer? Or do we hold fast to righteousness?  Do we repay hatred with kindness?  Do we say we won't do unto you as you did?For the moment, at least, and in this one case, we know the answer.  Governor Kasich today denied clemency to Steven Smith.  No surprise there, but disappointment.There was always hope, if not expectation, that he, in our names, would be better than that.   Kasich denies clemency for SmithSteven Smith is due to be killed on May 1.  Next is Billy Slagle on August 7.
