A deputy with the Boise County Sheriff's Office, David Lee, was patrolling the area in his marked 2004 Ford Explorer. As Lee attempted a U-turn on the highway to catch up to a speeding vehicle, he was struck by the vehicle traveling behind him, a 2010 Ford Escape, driven by Joseph Kaiser, age 69, of Salmon. Many years ago, I first met Nipponzan Myohoji Nichiren Buddhist monastics Denise Laffin and Gyoshu Utsumi of the Atlanta Dojo and Great Smoky Mountains Peace Pagoda in Tennessee, who on June 10 represented the Buddhist tradition at Muhammad Ali’s funeral. Nipponzan Myohoji is a small order that focuses on peace walks and spiritedly chanting and drumming the Odaimoku, Na Mu Myo Ho Ren Ge Kyo, which is the essence of the Lotus Sutra, and is my license plate’s acronym. The U.S. Justice Department (DOJ) monitors lawless local police departments and state prisons across the country – and there are plenty of them in need of oversight.   In a June 6, 2016 opinion piece, To Stop Bad Prosecutors Call the Feds, the editorial board of The New York Times cited a federal judge who called prosecutorial misconduct—the withholding of exculpatory Brady evidence—an “epidemic” in this country. Las Vegas resident Joey Kadmiri has been sentenced to 10 years after being convicted of a host of offenses. Court documents say that Kadmiri was arrested after being caught trying to steal costumes and props from the Thunder from Down Under show at the Excalibur. When confronted by performers, Kadmiri tried to argue that he was a new cast member. He pulled a gun, firing twice before being subdued. Kadmiri’s lawyers presented evidence regarding their client’s history of mental health issues and detailed the abuse he suffered at the hands of his father. Ultimately, the defendant pled guilty to felony theft, battery and weapons charges. Kadmiri’s situation was made worse by the firearm he had in his possession at the time of the attempted theft. He broke Nevada law NRS 202.290 when he aimed the gun at people. Depending upon the value of the items he attempted to steal, he may have also broken NRS 205.240 for petit larceny or NRS 205.220 for grand larceny. Being…

Texas Supreme Court Holds Exclusionary Rule Does Not Apply to Civil Asset Forfeitures: Why call it Punishment When You Can Call it a Remedy? The Texas Supreme Court recently found that illegal searches and seizures do not stop the State from trying to keep the property it illegally took. In State of Texas v. One (1) 2004 Lincoln Navigator, the Court, in a departure from the recent trend curtailing certain asset forfeiture practices, held that civil asset forfeiture actions are not quasi-criminal, and thus are not covered by the protection of the exclusionary rule. In this case, a vehicle was stopped and the driver was arrested. As a result of the arrest an inventory of the vehicle was taken and drugs were found. A civil forfeiture commenced arguing that the vehicle was used to acquire, store, or deliver drugs. However, a hearing concluded that the arrest was illegal and the evidence found within it was suppressed, or thrown out. This left the State with no means to connect…
