Celebration Nets Teen Another DUI Arrest

A driver might be very happy when a judge reduces a charge of DUI in Los Angeles to a lesser charge, like wet reckless. But getting intoxicated and driving down a busy main street is not a good way to celebrate. Just ask 18-year-old Lucas Brandenberg of Knoxville, Tennessee. He’d likely be in less trouble today if he had found a quieter and less dangerous way to express his satisfaction with the outcome of his court case. On Thursday, June 14th, Brandenberg appeared in a court in Knox County, where Judge Scott Shipplett accepted a plea deal that reduced a DUI charge against him to reckless driving. (Another judge, Stephen Mathers, had initially rejected the plea deal, but Brandenburg’s case ended up in Shipset’s courtroom.) Around 2 a.m. on the morning of Friday, June 15th, police responded to calls about a pickup truck driving through Knoxville with two occupants throwing beer cans out the window. What the Houston district attorney’s office did to a rape victim known as “Jenny” was nothing short of atrocious. In Houston, Keith Hendricks was on trial for the rape of “Jenny.” Jenny, who suffers from bipolar disorder, couldn’t continue her testimony on Dec. 8, 2015. Court transcripts show she was incoherent, broke down and ran from court saying she’d never return. Which is understandable. Having to relive that experience would be tough on anyone, let alone someone already suffering from mental health issues. The trial was adjourned until January, but the prosecutor, Nicholas Socias, wanted to make sure that Jenny would be available to testify. He asked for a body attachment, which the judge granted. Initially, she went to the local mental hospital, where eventually her condition improved. Lawyer Jailed for Refusing to Remove “Black Lives Matter” Pin

Ohio lawyer, Andrea Burton, was handcuffed and led out of a courtroom by an attending sheriff when she refused to comply with Judge Robert Milich’s  multiple requests that she remove her Black Lives Matter pin.  After her refusal, the Judge and Ms. Burton  adjourned to his chambers to discuss the impasse created by Ms. Burton’s position. She argued that the Court’s ruling was an unjustified infringement on her First Amendment right of free speech. Judge Robert Milich reminded Ms. Burton  that based on Supreme Court case law, he had authority to prohibit any symbolic political expression in his courtroom. He later spoke to the media declaring, “There’s a difference between a flag, a pin from your church or the Eagles and having a pin that’s on a political issue”. What made lawyer Andrea Burton wear a Black Lives Matter button to Judge Milich’s Youngstown courtroom? She wanted to. When it comes to an expression of political opinion, it requires no more reason than that. Which is why some found it outrageous that Judge Milich held Burton in contempt for her refusal to remove the button. Burton argued that her First Amendment rights overrule the Supreme Case law — and Milich’s discretion — and refused the his instructions because she didn’t want to remain “neutral to injustice.” There is a serious question as to why Judge Milich felt it necessary to flex his judicial muscles over a BLM button. It’s not as if Burton’s button was disruptive to the decorum of the courtroom. If anything, the judge’s demand that the button be removed was more disruptive at the time, and certainly more disruptive in the long haul as it becomes a source of debate and anger.
