The Wells Fargo 5300

When news broke that Wells Fargo fired 5300 employees and agreed to a penalty of $185 million, it was shocking.   There were three reasons for this shock: The scope of the fraud was massive The penalty was, to a bank with a market valuation of $250 billion, the highest of any bank in America, trivial Of the 5300 employees fired, not one was an upper echelon corporate executive. Turned out that trench level people were being relentlessly pushed to produce new accounts, new credit cards, anything new that produced new fees, and so they did. Just without the knowledge of the putative account holders, even though they were being charged (or penalized, as the case may be) for these accounts. Former employees tell CNNMoney that they felt incredible demands from managers to meet sales quotas. The same managers turned a blind eye when ethical and even legal lines were crossed. “I had managers in my face yelling at me,” Sabrina Bertrand, who worked as a licensed…

Dharun Ravi and the Criminal Element

One thing must be admitted off the top: we don’t know why Tyler Clementi committed suicide. Even if you actually knew Clementi, which you don’t, you don’t know what was going on in his head. If you did, you would have stopped him, but you didn’t. And if you didn’t know him, and you didn’t, you have no idea what made him commit suicide. You may believe it was the humiliation caused by Dharun Ravi’s outing him as gay in their Rutgers dorm, but that’s just a belief that can neither be proven nor disproven. You don’t know. I don’t know. Nobody knows. If you can’t admit this, then there’s nothing more to discuss. But Dharun Ravi was convicted of a laundry list of crimes, none of which involved Clementi’s death. But they were all a proxy for Clementi’s decision to commit suicide, because of how Ravi’s actions made Clementi feel. Wails were heard across Middlesex County.  Curiously, the…

Smith v. Florida – State Supreme Court Rules File-Sharing Program Meets Child Porn Criteria

As our technology rapidly evolves, so too must our justice system. As we are often faced with ever-newer technological frontiers, courts are often grappling with how the law should be applied.  One such case recently before the Florida Supreme Court highlights this. In Smith v. State, the court was asked to resolve a conflict between this ruling handed down by the Fourth District Court of Appeal in 2015 and an earlier ruling in 2013 in Biller v. State by Florida’s Fifth District Court of Appeal. At issue was whether the use of a file-sharing program for purposes of disseminating child pornography in fact violates the statutory prohibition on transmitting child porn. The Florida Supreme Court ruled: Yes, it does. That means the precedent set by the 5th DCA is overturned, and those who transmit illegal sexual images of children via  file-sharing program can be charged under F.S. 847.0137. According to court records in Smith, defendant pleaded…

Gun control is a perpetual hot topic around the country, especially during this election year. And Connecticut lawmakers have joined the debate by passing legislation that seeks greater protection for Connecticut domestic violence victims when it comes to temporary restraining orders. The issue on the table? Whether gun owners who have a temporary restraining order against them—that is, one issued by a judge before the gun owner is able to be heard in court—should have the right to possess guns and firearms while the application is pending. Starting October 1, gun ownership by people subjected to temporary restraining orders will be illegal, and Second Amendment advocates are fuming… Understanding the Temporary / Ex Parte Restraining Order Process As any of the best Connecticut restraining order lawyers and attorneys can explain to you, Connecticut currently has 2 types of civil restraining orders – one for victims of domestic violence (specifically…

Journalist reports on assault against Dakota Access Pipeline protestors and asserts 1st Amendment against trespass prosecution

Whatever anyone thinks of her (bias and all), Democracy Now‘s Amy Goodman does not easily shy away from risks and physical danger, and she has repeatedly dug into news stories, advocated against corporate money interfering with getting out the news, and refused to be an embedded journalist. Among particular note is Goodman’s recounting how she narrowly avoided becoming a victim of the Indonesian military’s 1991 massacre (two years after my second and last visit to Indonesia’s Java island) of East Timorese protestors when she insisted she was a United States citizen. I have heard Amy speak live, have met her, and have been riveted by her talks, which does not mean I agree with her viewpoints or not. On September 8, 2016, an arrest warrant was issued against Ms. Goodman (see court docket), apparently arising from her September 3 coverage of anti-Dakota Access Pipeline demonstrators breaking through fencing, which…

Add racial profiling at traffic searches to law enforcement 'early warning' triggers

The Austin Statesman's investigative team today published an excellent analysis of DPS racial profiling data regarding discretionary searches conducted by troopers, coupled with an analysis of video from traffic stops which generated racial profiling complaints. This effort culminated months of team reporting on the topic and responded to DPS Col. Steve McCraw's ostensible rebuttal to their earlier findings. For background: In December, the Statesman found that African-American and Hispanic motorists were searched more often when stopped, and contraband found less often for Hispanic drivers than white drivers. Earlier this year, DPS Director Steve McCraw testified before state lawmakers that troopers do not engage in racial profiling and encouraged the public to instead look at the individual cases in which officers are accused of racial profiling. There have been about 40 in the last five years, and the Statesman requested the dashcam videos from those incidents…
